City Council, May 1, 1995
A special session of the City Council is held Monday, May 1, 1995, at four thirty-four o’clock p.m. All the members are present except Councilors Moran and Rabbitt; President Barry presides.
The following ordinance is taken up::

Upon recommendation of the Ordinance Committee, the following Ordinance is read for the first time, and passed on a roll call vote, as follows:

THE ORDINANCE COMMITTEE RETURNS THE FOLLOWING ORDINANCE WITH A RECOMMENDATION FOR APPROVAL WITH THE FOLLOWING AMENDMENT:
ORDINANCE REGULATING BUILDINGS WHICH ARE DESIGNATED AS PUBLIC NUISANCES IN THE CITY OF PAWTUCKET.
The following ordinance shall read as follows:
Section 1. The Public Safety Director shall have the authority to declare any building in the City of Pawtucket as a public nuisance.
For the purpose of this Ordinance the term "public nuisance" is defined to mean any condition or use of premises or of building exteriors which is detrimental to the property of others or which causes or tends to cause substantial diminution in value of other property in the neighborhood in which such premises are located, or a building that is a menace to the public health, welfare, or safety or that is structurally unsafe, unsanitary, or not provided with adequate safe egress, or that constitutes a fire hazard, or is otherwise dangerous to human life, or is otherwise no longer fit and habitable, or that in relation to existing use constitutes a hazard to the public health, welfare, or safety by reason of inadequate maintenance, dilapidation, obsolescent, or abandonment. This includes, but is not limited to, the keeping or the depositing on or the scattering over the premises of any of the following:
a. Lumber, junk, trash, or debris;
b. Abandoned, discarded or unused objects or equipment such as automobiles, furniture, stoves, refrigerators, freezers, cans, or containers.
c. Any compost pile which is of such a nature so as to spread or harbor disease, emit unpleasant odors or harmful gas, or attract rodents, vermin, or other diseased carrying pests, animals or insects, provided that the presence of earthworms in a compost pile shall not constitute a nuisance.
d. The using of any part of the property or any public property adjacent thereto for the manufacture, sale, use or delivery of a controlled substance or from possessing on the property or any public property adjacent thereto with the intent to manufacture, sell, use or deliver a controlled substance classified in Schedule I or Schedule II of the Rhode Island General Laws, Chapter 28 of Title 21.
e. The using of any part of the property or any public property adjacent thereto, to receive or offer or agree to receive any person into any place, structure, house, building, or room, for the purpose of pandering or committing prostitution or for any other lewd or indecent act.
Section 2. This ordinance shall go into effect upon passage.
Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the AMENDMENT to the Ordinance entitled "ORDINANCE REGULATING BUILDINGS WHICH ARE DESIGNATED AS PUBLIC NUISANCES IN THE CITY OF PAWTUCKET, is passed on a roll call vote, as follows:

THE ORDINANCE COMMITTEE RETURNS THE FOLLOWING ORDINANCE WITH A RECOMMENDATION FOR APPROVAL WITH THE FOLLOWING AMENDMENT:
The following ordinance shall read as follows:
AN ORDINANCE IN AMENDMENT OF CHAPTER 13 OF THE REVISED ORDINANCES OF THE CITY OF PAWTUCKET (1966) ENTITLED, "GARBAGE, PAPER AND RUBBISH" (large item pick-up).
Section 1. Chapter 13 of the Revised Ordinances of the City of Pawtucket (1966) shall be amended as follows:
SECTION 13-11.2 (h) shall be amended to read as follows:
(h) The department of public works or its designers should be called for instructions regarding the pick-up of large items, household furniture and appliances. No resident of the City of Pawtucket shall place any large items on the sidewalk for such pick-up without first having made an appointment with the Department of Public Works or its designee.
SECTION 13-11.6 shall be amended to read as follows:
(a) Violation of the provisions of this article or failure to comply with any of its requirements shall constitute a misdemeanor. Any person who violates this article or fails to comply with any of its requirements, except section 13-11.2 (h), shall, upon conviction thereof, be fined no less than ($100.00), and, an addition, shall pay all costs and expenses involved in the case. Each day such violation continues shall be considered a separate offense.
(b) Any person who violates section 13-11.2 (h) shall upon conviction be subject to a fine of ($200.00) for the first offense, ($300.00) for the second offense, and ($500.00) for each subsequent offense.
Section 2. This Ordinance shall take effect upon passage.
Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the AMENDMENT to the Ordinance entitled "ORDINANCE IN AMENDMENT OF CHAPTER 13 OF THE REVISED ORDINANCES OF THE CITY OF PAWTUCKET, 1966, REGARDING LARGE ITEM PICK-UP, is passed on a roll call vote, as follows:
Ayes - President Barry, Councilors Bray, Demopulos, Doyle, Hodge, Kinder and Vieira.
Noes - 0.
The following ordinance is read for the first time and passed on a roll call vote, with a new Title, AS AMENDED:
