A regular session of the City Council is held Wednesday, March 24, 1993, at eight seven o’clock p.m. All the members are present and President Barry presides.
THE COUNCIL RECESSES IMMEDIATELY TO CONVENE AS THE BOARD OF LICENSE COMMISSIONERS AND TO CONDUCT THE PRE-COUNCIL SESSION.

THE COUNCIL RECESSES AT 10:07 P.M. TO CONVENE THE PUBLIC HEARING ON THE FOLLOWING:
FRIENDSHIP GARDENS PROJECT.

THE CHAIR RECOGNIZES COUNCILOR RABBITT.
With majority consent of the Council, the following Motion made by Councilor Rabbitt, seconded by Councilor Vieira is passed on a unanimous voice vote:
The City Council shall develop a list of maintenance projects in City parks and recreational facilities which need to be done, at which time this list shall be forwarded to Jim Kulczycki, Director of Parks requesting that he respond within 30 days as to what actions have been taken to complete these jobs or what plans are in place to complete them. After his response, the Council will reconsider the Frienship Gardens Project.
The Council further requests that Mr. Kulczycki, be informed that no work is to be done on the Frienship Gardens Project until such time as approval is granted by the Council.
The reading of the records of March 10, 1993, are dispensed with and the records are approved as prepared by the Clerk.

The Clerk is instructed to send a communication to Wiley Archer, Acting Chief Engineer, regarding a supposed agreement between the Water Board and Colfax, allowing them to purchase water from Providence during the recent water crisis.
Councilor Vieira has heard that this agreement exists and has not been rescinded.
The Council would like information on this agreement if it exists, including whether or not it has been rescinded, and whether Colfax is now buying its water from Pawtucket.

The Clerk is instructed to send a communication to John T. Gannon, City Solicitor, regarding the vouchers he provided to the Council on investigative services in the worker’s comp department.
The Council would like additional back-up on these vouchers showing how many hours of work were paid for in these vouchers.
Councilor Vieira commented that if we are spending this much on outside investigators, it may be cheaper to hire a full-time investigator for the City.
THE CHAIR RECOGNIZES COUNCILOR CLEMENT.
With majority consent of the Council, the following Motion made by Councilor Clement, seconded by Councilor Calista, is passed on a unanimous voice vote:
The Clerk is instructed to send a communication to Bruce Young, Director of Collections and Disbursements, to ensure him and his staff that the Council knows that his office is neither crooked nor untrustworthy, and they apologize if they allowed the line of civil conduct to the crossed at the last meeting.
Council President Barry would like to assure him that it was not him who was being referred to as crooked, and untrustworthy, but the collections agency.
THE CHAIR RECOGNIZES COUNCILOR BRAY.
With majority consent of the Council, the following Motion made by Councilor Bray, Seconded by Councilors Clement and Kinder, is passed on a unanimous voice vote:
The Clerk is instructed to send a communication to William T. Noonan, Administrative Assistant, regarding the message on the City’s phone line.
Councilor Bray is concerned that only a few extensions are on the message and wishes to know if the administration intends to somehow publicize all the extensions for the different departments.
If the administration intends to publish the extensions in a newspaper, she recommends that all newspapers print them, including Hispanic and Portuguese newspapers.

Councilor Vieira would like a backup to the purchases, which were made by the School Departments.

Petition for AUTO REPAIR SHOP LICENSE AND SECOND HAND SHOP LICENSE of Julio Martinez d/b/a J Company (previous owner Antonio Fonseca d/b/a Fonsecas Auto Sales & Repair, 540 Weeden Street, Tax Assessor’s Plat 48, Lot 256, to keep a shop for the purpose of purchasing and selling second hand articles, specifically used automobiles and repairing the same, which was advertised for a hearing at this time, is taken up:
Speaking in opposition is Joseph DaCosta, 534 Weeden Street, Pawtucket, RI.
Mr. DaCosta states that he is not opposed to this license, if it is run as a sole business in the building.
Mr. DaCosta states that several businesses in the past were run there on one license. He states that he is concerned about the area, and he does not wants auto body work done because of the paint spray.
Speaking in favor is Mrs. Antonio Fonseca, 18 Fonseca Road, Cumberland, RI.
Six months ago they had a bad tenant who has been removed. She states that Mr. Martines is nice man.
Speaking if opposition is Laura Cordeiro, 526 Weeden Street, Pawtucket, RI.
Ms. Cordeiro states that Mr. Julio Martinez, applied twice for the license and didn’t show up.
She states that her driveway is being blocked. She doesn’t want multiple businesses at this location, and doesn’t oppose a single shop.
There are no other speakers.

The Clerk is instructed to send a communication to John T. Gannon, City Solicitor, requesting that he review the lease on the proposed transfer station at the incinerator, and to rewrite it to include any changes he feel are in the best interest to the City.
The Council has specific changes they would like him to make, including the following:
1. On Page 7, No. 15 - any changes he thinks should be made as to this paragraph. The Council questions why the City must rebuild this transfer station if something happens.
2. Include a security clause making McCaughey Standard responsible for all security inside and outside of the building.
3. Include a rental escalation clause.
4. Include a clause requiring that Pawtucket residents be allowed to drop off their trash for free.
5. On Page 4, No 9 - Increase the insurance amount from $1,000,000 to $5,000,000.
6. Include a clause requiring that all amendments to the lease be approved by the City Council.
7. Include a clause in the lease showing exactly how much land is going to be used, and a copy of the plans for the area.
