A regular session of the City Council is held Wednesday, February 10, 1993, at eight five o’clock p.m. All the members are present except Councilors Calista and Rabbitt and President Barry presides.

With majority consent of the Council, the following Motion made by Councilor Moran, seconded by Councilor Vieira, is passed on a unanimous voice vote:

The Clerk is instructed to send a communication to Jack Rahill, Director of Finance, to ask why only two of the six transactions regarding the American Express charges were on the Turnaround Reports. He would like to know where the other four charges are reported.

The Council would also like a monthly report from him on all American Express charges and all other travel and entertainment charges. Included with that report, the Council would like copies of the American Express bills.

The Clerk is instructed to send a communication to Mayor Robert E. Metivier, requesting the following information regarding the hiring of temporary employees:

1.         The number of temps hired since January 1, 1992.

2.         Status of these employees.

3.         Why the temporary worker at the Pound did not appear on the list of hirings sent to the Council in October, when he was hired.

4.         What is the Administration’s position on the hiring of temps, considering that a hiring freeze is supposed to be in place.

The Clerk is instructed to send a communication to Ferdinand C. Ihenacho, Director of Public Works, to have former Mayor Sarault’s name removed from the Veterans Monument on the corner of Roosevelt Avenue and Exchange Street.

The Council would like him to find out the costs to do this and let them know prior to taking any action on the Motion.

THE CHAIR RECOGNIZES COUNCILOR MORAN.

With majority consent of the Council, Councilor Moran moves, seconded by Councilor Doyle, that the Council take a roll call vote on its intentions regarding placing a referendum on the ballot regarding the fate of the Slater Park Zoo.

The Council votes not to place on the ballot a referendum on the fate of the Slater Park Zoo, on a roll call vote, as follows:

Ayes - President Barry, Councilors Bray, Clement, Doyle, Kinder, Moran, Rabbitt and Vieira.

Petition for AUTO REPAIR SHOP LICENSE of Norman A. Tremblay & David J. Thoman d/b/a Pride Auto Repair, (previous owner Glen Carnes d/b/a Family Car Care Center) 814 Central Avenue, Tax Assessors’s Plat 12, Lot 220, to keep a shop for repairing automobiles, which was advertised for a hearing at this time, is taken up:

Speaking in favor is David Thoman, 310 Schumucknuck Hill Road, Charlestown, Rhode Island, and Norman Tremblay, 85 Columbine Avenue, Pawtucket, RI.

Mr. Thoman states that they have both been in the auto repair business. There will be no body work or painting. The hours are from 8:00 a.m. to 6:00 p.m., Monday thru Friday, and Saturday until 1:00 pm.

They state that they do not have any employees other than themselves.

The establishment has 3 bays in front to work on cars. There is parking for 3 cars in front of the bays and 2 storage bays in the back for parking. There will be no parking of cars on the street, only on the lot.

Mr. Thoman introduces a letter from Jeanne Theberge, the owner of the property.

Speaking in opposition is Mr. Arthur Vadnais, 324 Grand Avenue, Pawtucket, RI.

Mr. Vadnais states that he is not really opposed to the transfer, he is only concerned about parking. He states that it is O.K. if the parking is limited to the lot.

There are no other speakers.

The Clerk is instructed to send a communication to Gerald Resnick, Chairperson of Pawtucket School Committee, and to Dr. Emile Cheverette, Superintendent of Schools, requesting answers to several questions which were brought up at the pre-council session on bonding for the School Department, prior to approving the resolution on these bonds.

These questions concern such matters as double sessions, the use of parochial school classrooms; filling the empty classrooms at Pawtucket Schools, such as Goff Junior High School; where a new school, if approved, will be built and other alternatives to building a new school in the City.

The Clerk is instructed to send a communication to Frank L. Ribaudo, Program Coordinator, New England Regional Office, Norma Terris Humane Education Center, requesting that he continue to search for homes for all of the animals in the Slater Park Zoo and report back to the Council with his findings.

330      CH 2296 ORDINANCE IN AMENDMENT OF CHAPTER 2276 OF THE ORDINANCES OF THE CITY OF PAWTUCKET ENTITLED "AN ORDINANCE ESTABLISHING A PAY PLAN FOR THE CITY OF PAWTUCKET". (Account clerk II, Skating Rink Coordinator and Looff Carousel Manager)

THE CHAIR RECOGNIZES COUNCILOR CLEMENT.

With majority consent of the Council, the following Motion made by Councilor Clement, seconded by Councilor Kinder, is passed on a unanimous voice vote:

The Clerk is instructed to send a communication to Mayor Robert E. Metivier, to inform him that no work is to be done at the Zoo until it comes before the Council, per the Resolution regarding Slater Park.

When he comes before the Council for this approval, the Council would like to know the following:

1.         What is the liability for the volunteers working on this project?

2.         Are volunteer workers a violation of the AFSME Contract?

3.         Will the renovations meet USDA and Zoological standards?

4.         What will happen to Fanny while the work is being done; e.g. will she have to moved; and if not, what is being done to guarantee her health while the work is going on?

THE FOLLOWING ORDINANCE, WHICH THE ORDINANCE COMMITTEE RETUNED WITH A RECOMMENDATION FOR APPROVAL WITH THE FOLLOWING AMENDMENT AND WHICH WAS LAID ON THE TABLE AT THE MEETING HELD JANUARY 20, 1993, IS AGAIN TAKEN UP:

ORDINANCE ENTITLED "HOUSING COURT"

Section 3. (B) shall be amended to read as follows:

(B)       There shall be a Housing Court Judge and an Associate Housing Court Judge to hear and determine all actions brought before the Housing Court by the Director of Zoning and Code Enforcement concerning violations of state and local housing laws and ordinances and all actions brought for the prevention thereof, and to hear and determine any other actions brought to promote, protect, or enhance the residential environmental quality of the people.

Section 3. (C) shall be amended by adding to line two between the words, "said" and "Judge" the words "Municipal Court"

Section 3. a new subsection (D) shall be added to read as follows:

(D)       The Associate Housing Court Judge shall serve simultaneously as the Associate Judge of the Pawtucket Municipal Court; said Associate Municipal Court Judge being appointed by the Housing Court Judge in his or her capacity as Judge of the Municipal Court and in accordance with Section 2-501 of the City Charter.

Section 3. subsections (D) (E) (F) and (G) shall be changed to subsections (E) (F) (G) and (H)

Section 3. a new subsection (I) shall be added to read as follows:

(I)        The fees and costs assessed by the Pawtucket Housing Court shall at all times be consistent with those of the Pawtucket Municipal Court.

Section 4. (B) shall be amended to read as follows:

(B)       In all matters within its jurisdiction, the Housing Court shall have equitable powers pursuant to Section 45-24.2-8 and in accordance with Chapter 24.3 of Title 45 of the Rhode Island General Laws. In accordance with Section 8-8-3.1 of the Rhode Island General Laws, these equitable powers shall include the power to grant temporary restraining orders and preliminary and permanent injunctions as justice and equity may require, as well as the power to order a dwelling into receivership pursuant to Section 34-44-3 of the Rhode Island General Laws.

Section 5. shall be amended to read as follows:

Section 5. Sessions. The Housing Court shall conduct business in the Pawtucket Municipal Court House on each and every Wednesday evening and on Friday mornings as the Housing Court Judge deems necessary. The Housing Court shall also conduct business in the Pawtucket Municipal Court House at such other times and under such conditions as the Housing Court Judge may from time to time direct.

Section 7. (A) shall be amended by placing a period on line four, after the first time the words Associate Judge appear and eliminating the rest of the paragraph.

Section 9. shall be amended to read as follows:

Section 9. Authority and Duties of Clerks. The Housing Court Clerk shall serve simultaneously as the Clerk of the Pawtucket Municipal Court. In addition to any other authority or duties provided by this chapter, the Housing Court Clerk shall have the authority to carry out the duties with respect to the Housing Court that are exercised or performed by the clerks of the District Courts in housing matters.

Section 11. shall be amended to read as follows:

Section 11. Appeal. Any party aggrieved by final judgment, decree, or order of the Housing Court, may within twenty days (20) days after entry of judgment, petition to the Supreme Court of the State of Rhode Island for a writ of certiorari to review any errors involved. The petition for the writ of certiorari shall set forth the errors claimed. Upon the filing of such a petition with the clerk of the Supreme Court, the Supreme Court may if it sees fit, issue a writ of certiorari to the Housing Court to certify to the Supreme Court the record of the proceedings of the case together with any transcript of the proceedings furnished by the petitioner at his expense.

Upon Motion made by Councilor Clement, seconded by Councilor Kinder, the AMENDMENT to the Ordinance Entitled "HOUSING COURT" is passed on a roll call vote, as follows:

Ayes - President Barry, Councilors Bray, Clement, Doyle, Kinder, Moran, Rabbitt and Vieira.

THE CHAIR RECOGNIZES COUNCILOR CLEMENT.

With majority consent of the Council, the following Motion made by Councilor Clement, seconded by Councilor Vieira, is passed on a unanimous voice vote:

The Clerk is instructed to send a communication to Mayor Robert E. Metivier, requesting an update on the contract negotiations with the three Municipal Unions.

Councilor Clement strongly recommends that, if not already begun, the negotiations begin as soon as possible.

THE CHAIR RECOGNIZES COUNCIL PRESIDENT BARRY.

With majority consent of the Council, the following Motion made by Council President Barry, seconded by Councilor Vieira, is passed on a unanimous voice vote:

The Clerk is instructed to send a communication to William Mulholland, Director of Recreation, requesting a list of all city employees working at Lynch Arena. This list should include all full and part time workers; and also include those people working at the arena who may be on a different payroll.
