City Council, March 6, 1991.

A regular session of the City Council is held Wednesday, March 6, 1991, at eight sixteen o’clock p.m. All the members are present and President Houle presides.

The reading of the records of February 20, 1991, is dispensed with and the records are approved as prepared by the Clerk.

The Clerk is instructed to send a communication to Roger F. Giraud, Director of Planning and Development, concerning the Moshassuck Valley property owned by the Redevelopment Agency. Councilman Vieira would like to know who will be doing the clean-up of the property, and who will be paying for it.

Further requested is all information on roadway improvements and a list of potential tenants for the property.

Upon passage of the legislation prohibiting the sale of knives to minors, a notice shall be placed on all Second Hand Shop Licenses and Sunday Sales Licences prohibiting such sales.

Speaking in favor is Mr. James Martins, 108 Anthony Avenue, applicant.

Mr. Charles J. Rogers, Jr., Attorney, 25 South Angell St., Providence, representing applicant.

Mr. Rogers states that the objectors were heard by the Board of Appeals, and the Board approved the use of the premises for the purposes which Mr. Martins intends to use them. He states that an appeal has been taken, but that the taking of an appeal does not stay the decision of the Zoning Board. He also states that Mr. Martins currently is located at Quincy Street and Main Street, but wants to move to this location. He states the applicant does not intend to go into the sales of used cars on a retail basis, but only intends to sell on a wholesale basis. The applicant will repair vehicles on the premises; he is regulated by OSHA and DEM. He currently employs six people.

Mr. Martins states that he does on occasion do towing at night; usually once a night on the average. All the auto body work will be done inside the building, which holds six cars. He says that an OSHA spray booth contains the fumes inside the building. Business vehicles will be stored inside because he has a larger yard than he does at his other location, where the vehicles are stored on the street. He says that if he is towing a car for a dealership, the car goes back to the dealership, not to his lot.

Speaking in opposition is Michael Horan, Attorney, 393 Armistice Blvd., Pawtucket, RI, representing the abutters.

062 Mr. Horan states that he is speaking on behalf of the neighbors and presents a petition, which is filed.

He states that he is confident the appeal will succeed. He states that the applicant wants four different businesses at this location; towing, auto body, auto sales, and auto repair. He states that the back yard is adjacent to residential homes and further states that there will be an increase in noise. It will impede the enjoyment of the use of the property of the abutters. He says that there are other similar establishments in the area and enough is enough.

062 The next speaker is Mr. Robert Quinn, 280 West Ave., Pawtucket, RI.

Mr. Quinn states that he has a 2 1/2 family home across the street. He is renovating it into a one family home. Mr. Quinn reads a statement which is filed.

Next speaker is Mr. Peter Mullin, 40 Sterry Street, Pawtucket, RI.

Mr. Mullin states that this type of business is not good for this location. It is a congested area and the residents are trying to improve the area and this type of business will not help.

Also, requested is the number of accidents which have occurred at the intersection of Clyde Street and Pawtucket Avenue over the last six months.
