City Council, June 20, 1990.

A regular session of the City Council is held Wednesday, June 20, 1990, at eight forty-six o’clock p.m. All the members are present and President Houle presides.

The Council recesses immediately to conduct a Public Hearing on the following:

CIRCUS (NEW)

Allan Hill Entertainment Corp., for license to conduct Circus at McCoy Stadium, on Saturday July 21, 1990. LIC #607M

The Council reconvenes at eight fifty-three o’clock p.m.

The reading of the records of June 6, June 15, 1990, is dispensed with and the records are approved as prepared by the Clerk.

Upon Motion made by Councilman Barry, seconded by Councilman Kinder the ^*Consent Agenda is approved on a unanimous voice vote.

With majority consent of the Council, the following Motion made by Councilman Rabbitt, seconded by Councilman Kinder, is passed on a unanimous voice vote:

The Clerk is instructed to send a communication to Fred E. Joslyn, Jr., City Solicitor, requesting that he prepare an ordinance in time for the July 11, 1990, meeting to require a 30 day payment schedule by the City of Pawtucket using the provisions of the State Law as a guide.

THE CHAIR RECOGNIZES COUNCILMAN VIEIRA.

With majority consent of the Council, the following Motion made by Councilman Vieira, seconded by Councilman Barry, is passed on a unanimous voice vote.

The Clerk is instructed to send a communication to Michael Burns, Traffic Engineer, requesting that a traffic study be done on Carpenter Street, especially at the corner of Carpenter and Conant Streets to determine ways of slowing down traffic.

THE CHAIR RECOGNIZES COUNCILMAN BARRY.

With majority consent of the Council, the following Motion made by Councilman Barry, seconded by Councilman Kinder, is passed on a unanimous voice vote:

The Clerk is instructed to send a communication to Roger F. Giraud, Director of Planning and Development, thanking him for the report on Housing Standards violations and asking that any and all Municipal Court fines associated, with these violations be put into the report. Also, requested is a similar report on Zoning violations.

Petition for Auto Repair Shop License and Second Hand Shop License of Precision Harley Davidson Inc., 269 Armistice Boulevard, Tax Assessor’s Plat #25, Lot #244 for the purpose of purchasing and selling second hand articles, specifically Sale of motorcycles and automobiles, parts and accessories and repair of same, which is adverted for a hearing at this time, is taken up: LIC #124 & #111

Speaking in favor is Attorney William Burke, 75 Park Place, Pawtucket, Rhode Island.

Mr. Burke states that this is the same proposal, only at a new location at the corner of Industrial Highway and Armistice Boulevard, across from the police annex.

He also states there is a showroom in front of Armistice Boulevard and the service is in rear. The parking is adjacent to the building.

Mr. Burke states that the applicant will post signs asking patrons to use Industrial Highway as the main street, and the sign will be put in the front of building.

Speaking in favor is Charles Duranlean, John J. McHale & Sons, 775 School Street, Pawtucket, Rhode Island.

Mr. Duranlean states that he owns the abutting property and is in favor of the application, but is requesting that parking be restricted on McHale Ct.

Councilman Raymond W. Houle, Jr., requests Mike Burns to post "No Parking" signs and that this location is properly zoned.

There are no other speakers.

The hearing is closed.

Upon Motion made by Councilman Calista, seconded by Councilman Barry, the following petition is GRANTED with the following stipulation on a unanimous voice vote:

Upon Motion made by Councilman Rabbitt, seconded by Councilman Kinder, the Petition of Robert Langlois and Douglas Whalen requesting the Abandonment of a portion of Olive Street, said parcel contains approximately 40 square feet of land, is approved on a roll call vote, as follows:

Ayes - President Houle, Councilmembers Calista, Doyle, Kinder, Robert Lynch, William Lynch, Rabbitt and Vieira.

It appearing that the City Council on the 20th day of June, 1990, ordered the abutters on that portion of Olive Street, be notified to appear before the City Council at its meeting to be held on Wednesday June 20, 1990, to show cause, if any they have, why said portion described in detail as follows:

That certain tract or parcel of land situated westerly from Assessor’s Plat 44B Lot 344 in the City of Pawtucket, County of Providence, State of Rhode Island being bounded and described as follows:

Beginning at the southeasterly corner of Lot 127. Said point being the northeasterly corner of the herein described tract;

Thence running westerly bounded northerly by land (Lot 127) belonging to Robert Langlois and Douglas Whalen a distance of forty-two and 28/100 (42.28) feet to corner;

Thence turning and running southwesterly forty-four and 12/100 (44.12) feet to a point of the westerly line of land (Lot 319) now or formerly of Robert Langlois and Douglas Whalen;

Thence turning and running southeasterly bounded southerly in part by said Robert Langlois and Douglas Whalen land a of forty-eight plus or minus (48.0 +/- ) feet;

Thence turning an angle and running northeasterly to a point ten (10) feet north of the southwesterly corner of Lot 344 and the easterly corner of Lot 319.

Said parcel contains 40 +/- square feet of land;

should not be abandoned between certain points, and to be heard as to the damages, if any, which they could sustain thereby; and it appearing from the return of the certified mail receipts that notice of the pendency of the matter was served upon each of the abutters and that further notice has been given by publication in the Evening Times on May 30; June 6, 13, 1990, said matter was heard on June 20, 1990, and is ORDERED AND DECREED BY THE CITY COUNCIL THAT THIS PORTION OF OLIVE STREET, which has ceased to be useful to the public and the same be and hereby IS ABANDONED, and that no damage is sustained by any abutting owner or other person by reason of such abandonment, and IT IS FURTHER ORDERED THAT THE CITY CLERK shall cause a notice thereof to be published in the Evening Times for three successive weeks and to cause to be served a further notice upon very owner of land abutting said portion of Olive Street, which has been abandoned, who is known to reside within said State. FURTHER THE DIRECTOR OF PUBLIC WORKS shall cause a sign to be placed on said portion ordered abandoned having thereon the words "NOT A PUBLIC HIGHWAY."
