MINUTES FOR THE REGULAR COUNCIL MEETING

AUGUST 12, 2020

The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting held in accordance with Governor Raimondo’s Executive Order 20-25 on August 12, 2020 at 6:30 p.m.

 

The CITY CLERK called the roll, and the following members were present:

1.   CONSENT CALENDAR

(THE CONSENT CALENDAR IS APPROVED IN ITS ENTIRETY UNLESS THE COUNCIL REMOVES AN ITEM FOR DISCUSSION.  ALL LICENSES ARE GRANTED SUBJECT TO COMPLIANCE WITH ORDINANCES #31-80 AND #98-40.)

 

a.   Minutes of the Council Meetings held June 2, 2020, June 16, 2020 and June 24, 2020 (Approve)

 

b.   Special Events:

 

1)   newportFILM, d/b/a newportFILM Drive in Documentary Film Screening, Rough Point, 680 Bellevue Ave.; August 13, 2020 from 7:30 p.m. to 10:30 p.m.

 

REMOVED:  2)   Mend LLC, d/b/a Yoga Class with Mend, Morton Park; Fridays, Saturdays and Sundays, August 14, 2020 through September 28, 2020 from 8:30 a.m. to 9:30 p.m.

 

COUNCILOR TAYLOR moved to approve the application.  Seconded by COUNCILOR NAPOLITANO.  COUNCILOR LEONARD had questions regarding the classes and use of amplification.  Lexi Geschke, Mend Yoga, addressed the Council regarding working with the neighbors regarding any noise concerns.  CITY SOLICITOR BEHAN addressed the Council regarding the application.  The motion to approve was VOTED UNANIMOUSLY.

 

3)   Newport Elks #104, d/b/a movie, Newport Elks Lodge, 141 Pelham St.; August 20, 2020 from 8 p.m. to 10 p.m. (Rain date -August 27, 2020)

 

REMOVED:  4)   Bike Newport, d/b/a Ten Spot Ride, ten locations in Newport (see map); August 23, 2020 from 11 a.m. to 4 p.m.

 

COUNCILOR MCCALLA recused.

 

COUNCILOR TAYLOR moved to approve the application.  Seconded by COUNCILOR CEGLIE.   COUNCILOR LEONARD had questions regarding the event.  Bari Freeman, Bike Newport, addressed the Council to answer questions.  The motion to approve was VOTED UNANIMOUSLY (6-0).

 

c.   Holiday Selling License, New, IYRS School of Technology & Trades, d/b/a IYRS School of Technology & Trades, 449 Thames St. Ste III

REMOVED:  f.   Communication from Hilary B., re:  Requesting permission to create a Say Their Names Memorial at the Martin Luther King Jr. Community Center (Approve subject to details being worked out with city administration)- Continued from July 22, 2020

 

COUNCILOR TAYLOR moved to receive the communication subject to details being worked out with city administration.  Seconded by COUNCILOR CEGLIE.  Hilary Block addressed the council regarding the proposal.  Discussion occurred among the Council and Ms. Block regarding the plan.  COUNCILOR CEGLIE moved to continue the communication to August 26, 2020.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

COUNCILOR TAYLOR moved to adopt the Consent Calendar in its entirety with the exception of items b(2), b(4) and f.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

LICENSES AND PERMITS

 

2.   Victualing License, New Location, Radish Patch, LLC, d/b/a Vieste & Vino Wine Bar, Yagi Noodle and The Café, 580 Thames St. Units B101, B102, B103 and B104 (In conjunction with liquor license transfer)- Continued from             July 8, 2020

 

MAYOR BOVA moved to continue the application to be heard after the Board of License Commissioners.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

3.   Entertainment License, New, Class A (indoors), L & B Associates, LLC, d/b/a Stoneacre, 151 Swinburne Row, to have entertainment Sunday through Saturday from 11:00 a.m. to 9:00 p.m. (Hearing)

 

MAYOR BOVA opened the public hearing.   As there was no representative from the establishment, COUNCILOR CEGLIE moved to close the public hearing.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

COUNCILOR LEONARD moved to continue the application.  Seconded by COUNCILOR NAPOLITANO.  Discussion occurred among the Council.  The motion to continue failed 2-5 with COUNCILOR CEGLIE, COUNCILOR MCCALLA, COUNCILOR TAYLOR, COUNCILOR MCLAUGHLIN and MAYOR BOVA opposed.

 

MAYOR BOVA moved to approve the application on first reading.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

4.   Entertainment License, Expansion, Class B (outdoors), Newport North Hotel Property, LLC, d/b/a The Wayfinder, 151 Admiral Kalbfus Rd., to have entertainment located on the pool/deck area Monday through Sunday from 1:00 p.m. to 11:00 p.m. (Hearing)

 

MAYOR BOVA opened the public hearing.  The following members from the public addressed the Council:

MAYOR BOVA moved to close the public hearing.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.  MAYOR BOVA moved to approve the license.  Seconded by COUNCILOR MCLAUGHLIN.  The motion to approve failed 0-7.

 

APPOINTMENTS TO BOARDS AND COMMISSIONS

 

Energy and Environment Commission

Paige Myatt- Continued from July 22, 2020

 

MAYOR BOVA moved to withdraw the appointment as the applicant is not a registered voter in Newport.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

RESOLUTIONS

 

5.   Celebrating the Ida Lewis Yacht Club for receiving the St. Petersburg Yacht Club Trophy- K. Leonard, L. Ceglie, S. Taylor

 

COUNCILOR LEONARD introduced the resolution and moved for its passage.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

6.   Endorsing the Newport Tartan- L. Ceglie, J. Napolitano, K. Leonard, J. Bova, S. Taylor, A. McCalla

 

COUNCILOR CEGLIE introduced the resolution and moved for its passage.  Seconded by COUNCILOR NAPOLITANO.  Kelley Coen, creator of the Newport Tartan, addressed the Council regarding the design.  The motion to adopt the resolution was VOTED UNANIMOUSLY.

 

7.   Naming Pell School Gymnasium the “Paul L Gaines Gymnasium” – L. Ceglie, S. Taylor, J. Napolitano, J. Bova

 

COUNCILOR CEGLIE introduced the resolution and moved for its passage.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

COMMUNICATIONS FROM THE CITY MANAGER

 

8.   Memo from the City Manager:  Update on Transportation Master Plan and Green & Complete Streets

 

MAYOR BOVA moved to receive the communication from the City Manager.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

9.   Memo from the City Manager:  Recommendations on Short-Term Traffic Solutions

 

MAYOR BOVA moved to continue the memorandum to August 26, 2020.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

10. Action Item #5938/20 – RE:  RIDOT Transportation Improvement Program (TIP)  (w/accompanying resolution)

 

COUNCILOR TAYLOR moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR LEONARD.  CITY MANAGER NICHOLSON addressed the Council regarding the program.  The motion to receive and approve was VOTED UNANIMOUSLY.

 

11. Action Item #5939/20 – RE:  Award of Bid #20-035 – Historic Gravestone Restoration and Resetting (w/accompanying resolution)

 

COUNCILOR TAYLOR moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

12. Action Item #5940/20 – RE:  Capital Budget Amendment (w/accompanying resolution)

 

COUNCILOR TAYLOR moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR LEONARD.  William Riccio, Director of Public Services, addressed the Council regarding the budget amendment.  The motion to receive and approve was VOTED UNANIMOUSLY.

 

13. Action Item #5941/20 – RE:   Newport Area Career & Technical Center (NACTC) Automotive Shop Concrete Repairs Award of Bid #NPS21-001  (w/accompanying resolution)

 

COUNCILOR TAYLOR moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

14. Action Item #5942/20 – RE:   Ordinance Revision – 10.24.030 -  Special parking limits during certain hours on certain streets (w/accompanying ordinance)

 

COUNCILOR TAYLOR moved to receive the communication and adopt the accompanying ordinance.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

COUNCILOR TAYLOR moved to adjourn as Council and convene as Board of License Commissioners.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

BOARD OF LICENSE COMMISSIONERS

           

CONSENT CALENDAR   

 

      1.   Communication from Turner C. Scott, Esq., on behalf of Newport North Hotel Property, LLC, re:  Notification in change of d/b/a to The Wayfinder (Receive and make part of licensee’s file)

 

COMMISSIONER TAYLOR moved to receive the communication and make part of licensee’s file.  Seconded by COMMISSIONER CEGLIE and VOTED UNANIMOUSLY.

 

LICENSES AND PERMITS

           

2.   2020 Class A Liquor Sunday Selling Renewals:

a)   KRG Enterprises, Inc., d/b/a Bridge Liquors, 23 Connell Highway

 

COMMISSIONER TAYLOR moved to approve the license.  Seconded by COMMISSIONER CEGLIE and VOTED UNANIMOUSLY.

 

b)   New Newport Liquor LLC, d/b/a Point Wine & Spirits, 3 Thames St.

 

COMMISSIONER TAYLOR moved to approve the license.  Seconded by COMMISSIONER CEGLIE and VOTED UNANIMOUSLY.

 

3.   Application of Newport Prescription Center, Inc. d/b/a Island Wine & Spirits, 291 Broadway and portion of 289 Broadway, holder of a Class A alcoholic beverage license to expand the licensed premises into 287 Broadway (Hearing)

 

COMMISSIONER CEGLIE moved to close the public hearing.  Seconded by COMMISSIONER MCLAUGHLIN and VOTED UNANIMOUSLY.   MAYOR BOVA moved to approve the license.  Seconded by COMMISSIONER TAYLOR and VOTED UNANIMOUSLY.

 

4.   Application of Radish Patch, LLC, d/b/a/ Vieste, 515 Thames St., holder of a Class BL alcoholic beverage license to transfer the location to 580 Thames St. Units B101, B102, B103 and B104 and to change the d/b/a to Vieste & Vino Wine Bar, Yagi Noodle and The Café (Hearing)- continued from July 8, 2020

 

MAYOR BOVA opened the public hearing.  David Martland, Esq., addressed the Council on behalf of the applicant and introduced proposed changes to the licensed premises which includes removal of unit B101.

 

The following members from the public addressed the Council.

MAYOR BOVA moved to close the public hearing.  Seconded by COUNCILOR LEOANRD and VOTED UNANIMOUSLY.

 

MAYOR BOVA moved to amend the application to reflect the removal of unit B101 and the service to end at 11:00 p.m.  CITY SOLICITOR BEHAN suggested no access be given to Unit B101.  MAYOR BOVA moved to amend the application to include no access to Unit B101.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

MAYOR BOVA moved to approve the application as amended.  Seconded by COUNCILOR LEONARD and vote 6-1 with COUNCILOR LEONARD opposed.

 

COMMISSIONER TAYLOR moved to adjourn as Board of License Commissioners and reconvene as Council.  Seconded by COMMISSIONER CEGLIE and VOTED UNANIMOUSLY.

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR CEGLIE.  MAYOR BOVA moved to amend the application to include the restriction of no access to Unit B101 and service to end at 11:00 p.m.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

MAYOR BOVA moved to approve the application as amended.  Seconded by COUNCILOR TAYLOR and voted 6-1 with COUNCILOR LEONARD opposed.
