The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at its regular meeting held on November 13, 2019 at 6:30 p.m.

 

COUNCILOR CEGLIE provided an update regarding the christening of USNS Newport in Mobile, Alabama.

The vote to approve the remaining licenses was VOTED UNANIMOUSLY.

MAYOR BOVA moved to appoint Donald Ross to the Historic District Commission.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

Planning Board – Stephen Berlucchi, P.E. (3-year term ending10/31/22), Richard J. Haggis, Jr. (3-year term ending 10/31/22)

 

MAYOR BOVA moved to appoint Stephen Berlucchi to the Planning Board.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

MAYOR BOVA moved to appoint Richard J. Haggis, Jr. to the Planning Board.  Seconded by COUNCILOR NAPOLITANO and voted 6-1 with COUNCILOR MCLAUGHLIN opposed.

 

North End Zoning Updates Working Group Liaisons  Councilor Taylor, Councilor Ceglie, and Councilor McLaughlin

 

MAYOR BOVA moved to appoint Councilor Taylor, Councilor McLaughlin and Councilor McCalla to the North End Zoning Updates Working Group.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

MAYOR BOVA moved to continue the appointments to December 11, 2019.  Seconded by COUNCILOR TAYLOR.  Discussion occurred among the Council regarding the board and the Council encouraged citizens to apply.  The vote on the motion to continue was voted 6-1 with COUNCILOR LEONARD opposed.

 

RESOLUTIONS

 

9.   Amending the Rules of the Council-  J. McLaughlin, S. Taylor, K. Leonard

 

COUNCILOR TAYLOR introduced the resolution and moved for its passage.  Seconded by COUNCILOR MCLAUGHLIN.  Discussion occurred among the Council regarding the changes to the Council rules.  The vote on the motion to amend the rules was VOTED UNANIMOUSLY.

 

10. Future School Funding- J. McLaughlin

 

COUNCILOR MCLAUGHLIN introduced the resolution and moved for its passage.  Seconded by COUNCILOR TAYLOR.  COUNCILOR LEONARD moved to amend the resolution to remove the reference to property transfer fees from the resolution.  Seconded by COUNCILOR NAPOLITANO.  Discussion continued among the Council.  COUNCILOR MCLAUGHLIN moved to remove all language after the term “future” in the resolve.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

MAYOR BOVA moved to adopt the resolution as amended.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

11. Citizen Survey in 2020- J. McLaughlin

 

COUNCILOR MCLAUGHLIN introduced the resolution and moved for its passage.  Seconded by COUNCILOR NAPOLITANO.  COUNCILOR MCLAUGHLIN moved to correct the resolution by changing the year 2010 to 2020 in the final resolve.  The vote on the motion to approve was VOTED UNANIMOUSLY.

12. Closure of Courthouse Street- K. Leonard

 

COUNCILOR LEONARD introduced the resolution and moved for its adoption.  Seconded by COUNCILOR NAPOLITANO.   COUNCILOR LEONARD presented the Council with past plans of the area from a constituent.  MAYOR BOVA moved to receive the documents.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

 

Discussion continued among the Council regarding the proposal and the historical significance of the area.  CITY MANAGER NICHOLSON addressed the Council regarding the delay of the street reopening.  The vote on the motion to adopt the resolution was VOTED UNANIMOUSLY.

 

ORDINANCES

 

13. Approving the financing of improvements to the Newport Water System (Second Reading)

 

COUNCILOR TAYLOR moved to adopt the ordinance on second reading.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

14. Amending Chapter 5.12.040 entitled, “Number of Licenses permitted”, to increase the number of Class BT licenses (Second Reading)

 

COUNCILOR TAYLOR moved to adopt the ordinance on second reading.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

 

COMMUNICATIONS AND PETITIONS

 

15. Communication from John P. Shevlin, P.E., Senior Vice President, Pare Corporation, re:  Tiverton Casino Hotel Off-Site Project, Newport, Middletown, Portsmouth & Tiverton, Rhode Island

 

COUNCILOR TAYLOR moved to receive the communication.  Seconded by COUNCILOR MCLAUGHLIN.  John Shevlin, Pare Corporation, addressed the Council regarding the proposal for sign placement in various locations throughout the city.  Discussion occurred among the Council and Mr. Shevlin.  COUNCILOR LEONARD requested the City Solicitor send a letter opposing the proposal.  Seconded by COUNCILOR MCLAUGHLIN.  COUNCILOR TAYLOR moved to receive the 11x17 plans.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.  MAYOR BOVA moved to receive the communication and requested the City Solicitor to draft a letter stating the city is opposed the proposal.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

16. Communication from Church Community Housing Corp. and Newport Spring Advisory Committee, re:  Court House Street Closure- Traffic Analysis

 

COUNCILOR TAYLOR moved to receive the communication.  Seconded by COUNCILOR MCLAUGHLIN.  Jeremiah C. Lynch, Esq. addressed the Council regarding the traffic analysis.  Steve Ostiguy, Church Community Housing Corp. addressed the Council regarding the updates made to the property.  Paul Bannon, Senior Project Manager, Beta Group, addressed the Council to present the findings from the Traffic Analysis.  The following members from the public addressed the Council:

 

David Pedrick, 37 Second St., presented the Council with a proposed plan.  MAYOR BOVA moved to receive the document.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

Andrew Teitz, Esq., representing an abutter to the property discussed earlier proposals for the traffic in the area.

Dale Clark, 1 Coddington St., presented plans to the Council.  MAYOR BOVA moved to receive the plans.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

Jeremiah C. Lynch, Esq., addressed the Council and requested the communication be withdrawn.  Steve Ostiguy, Church Community Housing Corporation, regarding the need for additional funding for the park.

 

COMMUNICATIONS FROM THE CITY MANAGER

 

18. Memo from the City Manager RE: Status Report #3 on Zoning Code Update

 

Patricia Reynolds, Director of Planning and Economic Development, addressed the Council to provide an update.  MAYOR BOVA moved to receive the update.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

 

19. Action Item #5888/19 – RE:   Award of Contract - Pay by Phone App for City Parking (w/accompanying resolution)

 

COUNCILOR TAYLOR moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR NAPOLITANO.  COUNCILOR LEONARD had questions regarding the phone app.  Patrick Segerson, Transportation Supervisor and Erik Reis, Recreation Administrator, addressed the Council regarding the Pay by Phone App.  Discussion continued among the Council, Mr. Segerson and Mr. Reis.  The vote on the motion to approve was VOTED UNANIMOUSLY.

 

20. Action Item #5889/19 – RE:   RIDEM 2020 Recreation Acquisition and Development Grant Applications (w/accompanying resolution)

 

COUNCILOR TAYLOR moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR MCLAUGHLIN.  CITY MANAGER NICHOLSON addressed the Council.

Scott Wheeler, Supervisor, Parks, Grounds and Forestry, addressed the Council regarding the grant applications and management plan for the parks.  Discussion continued among the Council and Mr. Wheeler regarding the future use of Murphy Field.  The Council requested Mr. Wheeler work with neighbors and abutters for upcoming meetings on the project.  The vote on the motion to approve was VOTED UNANIMOUSLY.
