The following items of business, filed with the City Clerk under the Rules of the Council, come before the Council at its regular meeting held on March 13, 2019 at 6:30 p.m.

MAYOR BOVA moved to add item a 7 to the Consent Calendar.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

MAYOR BOVA opened the public hearing.  COUNCILOR TAYLOR moved to close the public hearing.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY. 

 

MAYOR BOVA moved to adopt the accompanying resolution.  Seconded by COUNCILOR CEGLIE.  COUNCILOR LEONARD had comments regarding the CIP.  The vote on the motion to adopt the resolution was VOTED UNANIMOUSLY.

 

2.   CONSENT CALENDAR.

COUNCILOR TAYLOR moved to receive the communication.  Seconded by COUNCILOR MCLAUGHLIN.  Discussion occurred among the Council regarding the short term rentals and moving forward.  The vote on the motion to receive was  VOTED UNANIMOUSLY.

 

COUNCILOR TAYLOR moved to adopt the Consent Calendar in its entirety with the exception of items a5, j, k, d and e.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

LICENSES & PERMITS

 

3.   Special Event and Sound Variance Application, NZK Productions, Inc., d/b/a Bachelorette 15, for two one minute fireworks displays on March 28 or March 30, 2019 from 11:00 p.m. to 11:45 p.m. to be launched from Gurney’s Hotel, 1 Goat Island, North Lawn (Hearing)

 

MAYOR BOVA introduced a request from the applicant to withdraw the application. 

 

COUNCILOR TAYLOR moved to allow the application to be withdrawn.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

5.   Victualing License, New, Carpionato Group, LLC, d/b/a Admiral Newport, LLC, 150 Admiral Kalbfus Rd. (In conjunction with liquor license transfer)

 

            COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

6.   Sidewalk Café License, New, 22 Washington Square Inc., d/b/a Bar Cino, 22 Washington Sq., four tables with four chairs each (In conjunction with liquor license transfer)

 

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR NAPOLITANO.  COUNCILOR MCLAUGHLIN had questions regarding the service of liquor at the café.  The vote on the motion was VOTED UNANIMOUSLY.

 

7.   Entertainment License, New, Class A (Indoors), Newport North Hotel Property, LLC, d/b/a Mainstay Inn, 151 Admiral Kalbfus Rd. (Second Hearing)

 

COUNCILOR CEGLIE moved to close the public hearing.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.  COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

8.   APPOINTMENTS TO BOARDS & COMMISSIONS

Historic District Commission-

Reappointment of Daniel Dias- 3 year term expiring 2/3/2022

 

COUNCILOR TAYLOR moved to appoint Daniel Dias to the Historic District Commission.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

ORDINANCES

 

9.   Amending Chapter 12.28.020 of the Codified Ordinances, entitled, “Definitions”:

 

a.  Amending definition of “dinghy” (First Reading)

 

COUNCILOR TAYLOR moved to adopt the ordinance.  Seconded by COUNCILOR MCLAUGHLIN.  COUNCILOR MCLAUGHLIN moved to continue the ordinance until April 10 and that the City Manager be instructed to provide a report to the Council on that date that outlines actions that could be taken to address the use of dinghy docks by residents who do not have a mooring.  Seconded by COUNCILOR LEONARD.  Discussion occurred among the Council.  Tim Mills, Harbormaster, addressed the Council to answer questions.  The vote on the motion was VOTED UNANIMOUSLY.

 

b.   Adding definition of “domestic partner” (Second Reading)

 

COUNCILOR TAYLOR moved to adopt the ordinance.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

10. Amending Chapter 12.28.060 of the Codified Ordinances entitled, “Anchoring Regulations” (Second Reading)

 

COUNCILOR TAYLOR moved to adopt the ordinance.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

11. Amending Chapter 12.28.072 of the Codified Ordinances, entitled, “Requests for Mooring Permit, Permit Changes and Transfers” (Second Reading)

 

COUNCILOR TAYLOR moved to continue the ordinance to March 27, 2019.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

12. Amending Chapter 12.28.073 of the Codified Ordinances, entitled, “Mooring Waiting List” (Second Reading)

 

COUNCILOR TAYLOR moved to adopt the ordinance.  Seconded by COUNCILOR NAPOLITANO.  COUNCILOR MCLAUGHLIN moved to amend the ordinance.  Seconded by COUNCILOR NAPOLITANO.  Robert Anton, Toppa Blvd. addressed the Council regarding the amendment.  COUNCILOR MCLAUGHLIN moved to continue the ordinance to March 27, 2019.  Seconded by COUNCILOR LEONARD.  Further discussion occurred among the Council regarding the use of the word “private”.  The vote on the motion to continue the ordinance failed 3-4.  COUNCILOR NAPOLITANO moved to amend the ordinance to add the word “private” in front of the word mooring in section 6.  Seconded by COUNCILOR CEGLIE.  CITY SOLICITOR BEHAN addressed the Council to answer questions.  The vote on the motion to amend the ordinance was voted 6-1 with COUNCILOR MCLAUGHLIN opposed.   MAYOR BOVA moved to adopt the ordinance as amended.  Seconded by COUNCILOR CEGLIE and VOTED 6-1 with COUNCILOR MCLAUGHLIN opposed.

 

13. Amending Chapter 12.28.074 of the Codified Ordinances, entitled, “Permit (mooring space) assignment and renewal” (Second Reading)

 

MAYOR BOVA moved to continue the ordinance.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY. 

 

14. Amending Chapter 12.28.075 of the Codified Ordinances entitled, “Mooring surrender for a season to the city” (Second Reading)

 

COUNCILOR TAYLOR moved to adopt the ordinance.  Seconded by COUNCILOR MCLAUGHLIN.  COUNCILOR LEONARD had a question regarding the ordinance.  CITY SOLICITOR BEHAN addressed the Council to answer questions.  Discussion occurred among the Council.  The vote on the motion to approve was VOTED UNANIMOUSLY.

 

15. Amending Chapter 12.28.076 of the Codified Ordinances, entitled, “Forfeiture of Mooring Permit” (Second Reading)

 

COUNCILOR TAYLOR moved to continue the ordinance to March 27, 2019.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

 

16. Amending Chapter 12.28.077 of the Codified Ordinances, entitled, “Mooring tackle requirements” (Second Reading)

 

COUNCILOR TAYLOR moved to approve the ordinance.  Seconded by COUNCILOR LEONARD.  COUNCILOR MCLAUGHLIN addressed the ordinance regarding missing language and moved to continue the ordinance to March 27, 2019.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

17. Amending Chapter 12.28.080 of the Codified Ordinances, entitled, “Seasonal dry storage areas” (Second Reading)

 

COUNCILOR TAYLOR moved to adopt the ordinance.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

18. Amending Chapter 12.28.150 of the Codified Ordinances, entitled, “Harbormaster Authority and Duties” (Second Reading)

 

COUNCILOR TAYLOR moved to adopt the ordinance.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

19. Action Item #5835/19 – RE:   Award of Bid #19-027 – Install New Electric Fire Pump Controller and Rebuild or Replace Existing Fire Pump at the Edward King House (w/accompanying resolution)

 

COUNCILOR TAYLOR moved to approve the bid award and adopt the accompanying resolution.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSYLY.

 

20. Action Item #5836/19 – RE:   Award of Bid #19-030 - Vernon Park Tennis/Pickleball Courts (w/accompanying resolution)

 

COUNCILOR TAYLOR moved to approve the bid award and adopt the accompanying resolution.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSYLY.

 

21. Action Item #5837/19 – RE:   Purchase and Sale Agreement – Connell Highway Land (w/accompanying resolution)

 

COUNCILOR TAYLOR moved to continue the item.  Seconded by MAYOR BOVA.  Discussion occurred among the Council regarding the item. CITY SOLICITOR BEHAN addressed the Council to answer questions.   John Murphy, Esq. and Brendan O’Donnell addressed the Council regarding the purchase and sale agreement. 

 

COUNCILOR TAYLOR withdrew her motion to continue.  MAYOR BOVA moved to approve the sale and adopt the accompanying resolution.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

4.   Action Item #5820/19, re:  Show Cause Hearing:  Salvation Café, Inc., d/b/a Salvation Café – Operating Without a Valid Class C Alcoholic Beverage License- continued from February 13, 2019

 

CITY SOLICITOR BEHAN addressed the Board to provide an update and recommended to continue the hearing to April 10, 2019.  COMMISSIONER TAYLOR had questions for the owner.  Susan Lamond, owner, addressed the Council to answer questions.  COMMISSIONER NAPOLITANO moved to continue the hearing.  Seconded by COMMISSIONER LEONARD and VOTED UNANIMOUSLY.
