COUNCILOR TAYLOR moved to receive the communication.  Seconded by COUNCILOR MCLAUGHLIN who went on to state there are several questions that still need to be answered before a plan is approved.    The vote on the motion to receive was VOTED UNANIMOUSLY.

COUNCILOR TAYLOR moved to approve the Consent Calendar in its entirety with the exception of items b (11) b and b (11) k and g.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR CEGLIE.  COUNCILOR MCLAUGHLIN questioned how many licenses are available.  Discussion occurred among the Council regarding the number of licenses available.   The vote on the motion to approve was VOTED UNANIMOUSLY.

 

3.   Victualing License, New, Denise C. Montoya, d/b/a Sunya, 359 Thames St. Unit E

 

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

4.   Victualing License, New, Old Battle Axe Inc., d/b/a The Reef, 10 West Howard Wharf (in conjunction with liquor license transfer)

 

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR CEGLIE.  COUNCILOR LEONARD had questions regarding the right of way.  MAYOR BOVA read existing restrictions into the record.  Michael Murray, Esq., addressed the Council on behalf of the applicant regarding the existing restrictions and stated they would comply.  Turner Scott, Esq., representing Lee’s Wharf Condominium Association, addressed the Council regarding the restrictions.  COUNCILOR TAYLOR moved to amend the license to include the existing conditions imposed by the City Council on June 9, 2010 shall apply to the new license.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

 

MAYOR BOVA moved to approve the license as amended.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

5.   Sound Variance, Island Moving Company, July 5, 2019 from 7:30 p.m. to 12:00 a.m., Bellevue House, 304 Bellevue Ave. (Hearing)

 

COUNCILOR TAYLOR moved approve the license.  Seconded by COUNCILOR CEGLIE.  COUNCILOR MCLAUGHLIN moved to amend the license to include a decibel limit of 75 until 11:00 p.m. and 65 decibels until midnight.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.  COUNCILOR TAYLOR moved to close the public hearing.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

 

MAYOR BOVA moved to approve the license as amended.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

6.   Entertainment License, New, Class A (indoor) and B (outdoor), Old Battle Axe, Inc., d/b/a The Reef, 10 W. Howard Wharf from 11:30 a.m. to 12:00 midnight (Hearing)

 

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR CEGLIE.  MAYOR BOVA opened the public hearing.   Turner Scott, Esq., representing Lee’s Wharf Condominium Association, addressed the Council and requested the existing conditions remain on the license.  MAYOR BOVA read the restrictions into the record.  MAYOR BOVA moved to close the public hearing.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.  COUNCILOR TAYLOR moved to approve the application with the conditions as previously imposed.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

7.   Daily Entertainment Licenses, Class B (outdoor), NPG Hospitality, LLC, d/b/a Gurney’s Newport Resort & Marina, 1 Goat Island, North Lawn:

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR MCLAUGHLIN.  The following members from the public addressed the Council opposing the license.

Discussion occurred among the Council.  The motion to approve the license failed (0-7).

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR CEGLIE.  David Smiley, General Manager, Gurney’s, addressed the Council to answer questions.

Discussion occurred among the Council the event noting it is part of the Pell Bridge 50th Anniversary Celebration.  The vote on the motion to approve was voted 4-3 with COUNCILOR MCCALLA, COUNCILOR MCLAUGHLIN and COUNCILOR LEONARD opposed.

COUNCILOR TAYLOR moved to continue the application based on the request from the applicant.  Seconded by MAYOR BOVA.  Discussion occurred among the Council.  David Smiley, General Manager, addressed the Council regarding the application.  The motion to continue failed (0-7).

 

MAYOR BOVA moved to approve the license.  Seconded by COUNCILOR MCLAUGHLIN.  Discussion occurred among the Council regarding the application.  The motion to approve failed (0-7).

 

9.   Entertainment License, Expansion, Class A (indoors), @ The Deck, LLC, d/b/a @ The Deck, 1 Waites Wharf, to expand indoor entertainment from 12:00 midnight to 1:00 a.m. (Second Hearing)

 

COUNCILOR LEONARD recused.

 

COUNCILOR TAYLOR moved to approve the license.  Seconded by COUNCILOR CEGLIE.  MAYOR BOVA opened the public hearing.  The following members of the public addressed the Council opposing the application:

The motion to approve the license failed (1-5) with COUNCILOR MCCALLA, COUNCILOR MCLAUGHLIN, COUNCILOR TAYLOR, COUNCILOR NAPOLITANO and MAYOR BOVA opposed.

 

10. APPOINTMENTS TO BOARDS & COMMISSIONS

COUNCILOR TAYLOR moved to appoint Paul Marshall to the Planning Board.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

Historic District Commission – Rosemary O’Brien (move from Alternate to Full-Member, filling term which expires on 2/3/20)

 

COUNCILOR TAYLOR moved to appoint Rosemary O’Brien as full member to the Historic District Commission.  Seconded by COUNCILOR MCLAUGHLIN and VOTED UNANIMOUSLY.

 

RESOLUTIONS

 

11. Establishing a policy regarding Fireworks Displays- K. Leonard, J. Napolitano

 

COUNCILOR LEONARD introduced the resolution and moved for its passage.  Seconded by COUNCILOR NAPOLITANO.   Discussion occurred among the Council regarding fireworks.  Lisa Lewis, Bridge St., had a question regarding current fees for fireworks.  COUNCILOR CEGLIE moved to amend the resolution to include a workshop being scheduled by August 30, 2019.  Seconded by COUNCILOR TAYLOR and VOTED UNANIMOUSLY.

 

MAYOR BOVA moved to approve the resolution as amended.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

12. Opposing H5774/5730 which would require sellers of real estate to provide buyers a disclosure of the annual building energy cost estimate- K. Leonard

 

COUNCILOR LEONARD introduced the resolution and moved for its passage.  Seconded by COUNCILOR NAPOLITANO.  Discussion occurred among the Council regarding the resolution.  The vote on the motion to approve failed (3-4) with COUNCILOR MCCALLA, COUNCILOR TAYLOR, COUNCILOR MCLAUGHLIN and MAYOR BOVA opposed.

 

13. Requesting a temporary road closure on Courthouse Street to simulate the proposal of the Newport Spring Project, Beta Group, Inc. and VHB from July 1-September 30, 2019- K. Leonard, J. Napolitano

 

COUNCILOR TAYLOR moved to approve the resolution.  Seconded by COUNCILOR MCLAUGHLIN.   COUNCILOR NAPOLITANO introduced the resolution.  Discussion occurred among the Council regarding the road closure.  Steve Ostiguy, Church Community Housing Corp. addressed the Council and mentioned a proposal they had received from Beta Group regarding the process for the data collection during the trial.   He further stated the proposal was forwarded to the city for review and the expense would be paid by Church Community Housing Corp.

 

William Riccio, Director of Public Services, addressed the Council regarding the measurement and collection of data.

 

Bob Carbone, 392 Spring St., addressed the Council regarding traffic concerns.

 

The vote on the motion to adopt the resolution was VOTED UNANIMOUSLY.

14. Amending Section 5.12.040 of the Codified Ordinances, entitled, “Number of License Permitted” (First Reading)- Continued from May 22, 2019

 

COUNCILOR TAYLOR moved to table the item to be heard under the Board of License Commissioners.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

4.   Action Item #5855/19 – RE:  Show Cause Hearing:  Unity 3, LLC, d/b/a Area - Violations of the Conditions of the Class BL Alcoholic Beverage License – Abandonment of License- Continued from May 22, 2019

 

CITY SOLICITOR BEHAN, addressed the Council to provide information regarding the hearing.  Rui Reis, addressed the Council regarding the license.  Discussion occurred among the Board members regarding the status of the license.  Wendy Dwyer, 39 Everett St., addressed the Board regarding the status of the license.

 

COMMISSIONER MCLAUGHLIN moved to classify the license as abandoned and moved to have it revoked.  Seconded by COMMISSIONER NAPOLITANO.

 

James Kiker, 34 Howard St. addressed the Board.

Frank Dwyer, 39 Everett St., addressed the Board.

 

COMMISSIONER CEGLIE moved to continue the item for sixty days to August 28, 2019.  Seconded by COMMISSIONER NAPOLITANO and VOTED UNANIMOUSLY.

 

COMMISSIONER TAYLOR moved to adjourn as BLC and reconvene as Council.  Seconded by COMMISSIONER MCLAUGHLIN and VOTED UNANIMOUSLY.

 

ORDINANCES

 

14. Amending Section 5.12.040 of the Codified Ordinances, entitled, “Number of License Permitted” (First Reading)- Continued from May 22, 2019

 

COUNCILOR TAYLOR moved to continue the ordinance for sixty days to August 28, 2019.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.
