All items under “CONSENT CALENDAR” are considered to be of a routine and noncontroversial nature by the City Council and will be enacted by one motion.  There will be no separate discussion on these items unless a Council member so requests, in which event, the item will be removed from the “CONSENT CALENDAR” and will be considered in its normal sequence on the docket.

A.    Council Journals

1.      Regular Council Meeting November 15, 2016

A motion to approve the Consent Calendar is made by Assistant Mayor Cunha, seconded by Councilman Britto and on a roll call vote it is unanimous 4-0 with Councilman Conley absent. 

The below public comment was granted by the City Council:

1.      Dan Landry regarding the renewal on the docket of the Rumford Motor Inn License. 

2.      Scott Scienzo, 58 Woodbine Street regarding the appointments listed on the docket and also to thank the outgoing Council.

Councilman Britto requests the Assistant Solicitor to address the issues.

Assistant Solicitor Dias explains the Fire code violations have all been corrected. The Zoning officer addressed the defunct sign on the property and a permit to remove the sign was obtained and the sign was removed.  An agreement or weekly contract with the hotel was going to have been provided to the law department for review and Mr. Dias notes he will be working with their attorney on this item.  

Councilman Britto stated that based on all the issues being addressed and as far as the contract with the East Providence Police Department and also the owners agreement to come before the Council for review of the license every 3 months going forward he is good with the license moving forward.  He knows how the community feels and hopes the owner takes their words into consideration as they cannot tell them who they can do business with but the owner can take into consideration and take action as it does present as a black eye to community.

Jim Moran and Robin Robinson show a video created as a promotional video for the East Providence Waterfront.  It was created in conjunction with Sean McVay Media. It is a 2 minute video and they note it is just the beginning of how the website will be put together. They note they are very excited about the outcome of the video to promote the City and improve the economic development climate in the City.

VII.          NEW BUSINESS

A.    City Managers Report  (by Acting City Manager Timothy Chapman)

1.      Lease/Disposition of City Owned Property

       0 Bold Point Park, Map 6, Block 1, Parcel 3

Acting City Manager Chapman stated previously up until tonight they had made changes as there were a couple of items he didn't agree were in the best interest of the City.  He notes Live Nation was cordial about this.  He adds that Director Boyle, Mr. Luba and he along with the Live Nation attorneys and members of their Corporation and subject to RI DEM and the National Park Service, and with an initial approval from RI DEM on the plan worked hard on this lease.   The City increased the fee from $1 to $1.10 and then $1.20 each year. The East Providence Police Department is directly involved in any noise violations, tree removal and grading and replacements are at the expense of Live Nation via the City’s Parks Department.  Live Nation is present only for 6 months after which Live Nation must restore the area to its natural state.  Trailer and boat parking are required as well as access to the Park.  The City will monitor to make sure it gets paid in due course and there are termination clauses.   Live Nation did agree to the conditions.  They will provide notice of the events when booked and scheduled to the East Providence Police Department and the East Providence Fire Department.  This is a very solid lease and though Live Nation may not be completely happy with the final outcome changes they worked together on a 3 year term of 6 month seasons with 20-30 events and projected a revenue to the City of $60,000-$100,000 per year to City Parks and Recreation Departments.   

A motion to approve is made by Councilwoman Capobianco, seconded by Councilman Britto and on a roll call vote it is unanimous 4-0.

Councilwoman Capobianco requested unanimous consent to speak stating that she enjoyed her two terms. It was a great experience and she is thankful to all the people she met and helped.  It is an on the job training and it is not always easy but she notes she did the best she could and is proud to have worked with both Council administrations.  She adds she will miss some of this.  She thanked her family and friends and noted there were tears of joy at the start and the end.

Assistant Mayor Cunha echoed those statements.  Noting is was a pleasure working with all. There were tough decisions and they didn’t always agree what was better for the City but they did what is best they could and at the end of the day those who know what you do everyday and who you are understand.  He added that he learned a lot and looks forward to working with everyone at the State House.

Mayor Rose stated that as they watched the video it was clear they all worked hard and accomplished a lot because of the City Departments which have done so much and it is easy to realize it when you look above the City like tonight’s video.  It is just one part and with Live Nation it will be another.  He notes they agreed to disagree and they did their very best and leave their position with the City in a better place then when they started.  East Providence has a bright future and they were here on the cutting edge.  Some days it was like a roller coaster and it was a learning experience which he will carry with him to the next phase in his life.  He thanked everyone for all their hard work and dedication and wished the incoming Council the best   concluding with God bless and Merry Christmas.

B.     Introduction to Ordinances

1.      No parking North Broadway (west side) 50 feet north of Cadorna Street.

A motion to Dispense with the Reading of the Ordinance is made by Councilwoman Capobianco, seconded by Assistant Mayor Cunha and on a roll call vote it is unanimous 4-0.

AN ORDINANCE IN AMENDMENT OF CHAPTER 18 OF THE REVISED ORDINANCES OF THE CITY OF EAST PROVIDENCE, RHODE ISLAND, 1998, AS AMENDED, ENTITLED“VEHICLES AND TRAFFIC”

SECTION I.  Section 18-307 entitled “Parking prohibited at all times.” of Article X entitled “Stopping, Standing and Parking” of Chapter 18 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as amended, entitled “Vehicles and Traffic” is amended by adding thereto the following:

North Broadway (west side) 50 feet north of Cadorna Street

SECTION II.  This ordinance shall take effect upon its second passage and all ordinances or parts of ordinances inconsistent herewith are hereby repealed.
