7:00 P.M. Open SESSION
The Mayor calls the meeting to order at 7:05PM.
A. Council Members
1. Discussion of Interim City Manager (by Councilwoman Capobianco)
Councilwoman Capobianco states she put this item on to have an open discussion.
Councilman Britto explains the date change was due to his work travel schedule which at the time they all selected the date was not in sync with phone. He had contacted the Council and informed them and Councilwoman Capobianco responded she was not opposed to moving the date. With that being said, he doesn’t know how they ended up at this date. He feels things took a turn for the worse.
Mayor Rose stated he can explain that. The Council had a series of text messages regarding scheduling a date and time and the last one he received was that the 20th and 21st worked for all.
Assistant Mayor Cunha stated that he specifically responded that he couldn't.
Mayor Rose disagreed adding that he felt that moving the meeting to the 29th gives them even less time for budget preparation.
Councilman Britto stated it wasn't conducive to Assistant Mayor Cunha and that wasn't a date set in stone. There were a couple of dates thrown out there and how it got posted so quickly and originally contained the old resolution as opposed to the current way the agenda reads he doesn’t know. There were three individuals who did not want this meeting to happen.
Councilwoman Capobianco stated the last time she spoke to the Mayor he was going to have a discussion with Councilman Britto regarding the meeting date and time.
Councilman Britto stated the recommendation for an Interim City Manager as was stated in the past, the City Solicitor would have to relieve his duties as City Solicitor. He added he has the resume of Planning Director Jeanne Boyle and that she is more suitable for the position with her prior experience working on the Budget. She is a full time employee already and has served in an interim city manager position in the past from March 2006-August 2006. He added that he feels she would be the most qualified person and that she brings a lot to the table. People in the City have a great deal of respect for her.
Assistant Mayor Cunha stated he too feels she is more qualified in that particular department.
Councilwoman Capobianco added she would have been between the Tim Chapman and Jeanne Boyle as well but feels that Tim Chapman has worked for the City for a long time and is a good candidate. He has been in the position of Solicitor or Assistant Solicitor for 20 years and participated in 20 budgets.
Councilman Britto stated the last budget funneled through the City Manager not the Law Department.
Mayor Rose asked Solicitor Chapman if in his 20 years has he ever been involved in the budget not just sat in but involved with it.
Solicitor Chapman stated only as it related to his own department.
Mayor Rose stated that many times in the past it has been the Solicitor who has filled the interim City Manager position such was the case with Bill Conley and Andy Andreoni. It's a temporary position and the incoming Council is going to pick the City Manager. The interim City Manager is a pressing issue as there are contracts to review and checks to be written which are waiting.
Councilman Britto stated he is not going to jump out and make a decision. He added he doesn’t understand this is decision that they all should have talked about it openly. He is not aware of any and all of this. The Council needs to do our due diligence and listen as opposed to talk. Take a deep breath and decide. He was confused himself as to why. Let’s hash out our problems and work through them. He understands the power of 3 and respects that but eliminating a position that has ramifications it should be well thought out.
Assistant Mayor Cunha asked the Solicitor if he has a full time law office.
Solicitor Chapman replied he did but he would handle it the way others have done and he is confident his staff and assistants at his own practice will handle this.
Councilwoman Capobianco makes a motion to nominate City Solicitor Tim Chapman for the position of Interim City Manager.
Assistant Mayor Cunha asks if the Human Resource Director is present.
Solicitor Chapman stated that at this time the City Human Resource Director has been suspended and since that action took place there is no documentation from City Manager Kirby which shows who the Interim Human Resource Director is.
Mayor Rose stated Mr. Kirby never appointed anyone in writing.
Councilman Britto asked for confirmation that there was no interim Human Resource Director.
Assistant Mayor Cunha stated the School Human Resource Director has been filling in.
Councilwoman Capobianco asked if she/he as interim could negotiate the terms of the hiring resolution.
Councilman Britto stated he feels it is a conflict that the Mayor be asked to negotiate.
Councilman Conley asked if the School Human Resource Director has been helping out but has not been appointed has her pay changed.
Solicitor Chapman stated that he had no idea.
Councilwoman Capobianco stated that she would be willing to make the motion subject to whoever the Human Resource Director is and they can negotiate the terms and that she/he will return the resolution to the Council for a final vote.
Councilwoman Capobianco makes a motion to make Tim Chapman Interim City Manager and to have the School Human Resource Director negotiate the terms subject to Council approval,the motion is seconded by Councilman Conley who adds that he respects both Tim Chapman and Jeanne Boyle but his choice tonight would be Tim Chapman, and on a roll call vote the motion passes 3-1 with Assistant Mayor Cunha and Councilman Britto voting Nay.
2. Selection of Interim City Manager (by Councilwoman Capobianco)
A motion to Adjourn at 7:30PM is made by Councilwoman Capobianco, seconded by Councilman Conley and on a roll call vote it is unanimous.
A motion to Un-Adjourn the meeting is made at 7:39PM by Councilwoman Capobianco, seconded by Councilman Conley and on a roll call vote it is unanimous.
Councilman Britto stated that he still has the question regarding Mr. Chapman wearing two hats. Although he does see the difference regarding a money savings, they did talk about this and all agreed at that time.
Councilman Conley stated that issue can come back within the offer which is presented to him.
Councilman Britto stated they have enough issues and they should have that option.
Mayor Rose asked if the resolution would still need to be voted on.
Solicitor Chapman stated that was correct.
A motion to Adjourn at 7:42 is made by Councilwoman Capobianco, seconded by Councilman Conley and on a roll call vote it is unanimous.
