A. Waterfront Commission Presentation by Interim Chair William Fazioli
It has been 10 years since the Waterfront Commission was developed.
Some highlights are Ross Commons, Rumford Center, Aspen Aerogels, upgrade to Squantum State Park, Tockwotten Home, Bold Point, Waterfront Drive, Eaton Aeronautical Project, Kettle Point, Village on the Waterfront, Watchemoket Square, old Odd Fellows structure, Philipsdale Landing, Valley Street establishing. All projects bring jobs, development and taxes. Going forward they will be conducting more community meetings to hear from residents. This is important for East Providence and the State. There are communities which are looking to model a Waterfront Commission after ours. East Providence taxes are in the middle of the rest of the State and our waterfront is a very attractive quality. People can view the website for additional information.
Mayor Briden stated that there was a very nice series in Providence Business News regarding the development on the East Providence Waterfront.

Councilwoman Rossi asks if all license holders/establishments are reviewed for compliance with all required inspections each year such as building and electrical inspection.
The City Clerk explains not on most renewals only particular ones such as laundries and dry cleaners. The initial inspections are done prior to the original license only not the renewals.
The Fire Chief is called to the podium and explains that they cannot review every business every year there are just too many and not enough staff but that if they receive a complaint or concern they will go out to the establish and conduct an inspection.
A motion to approve the annual renewal of Alcoholic Beverage Licenses is made by Assistant Mayor Rose, seconded by Councilman Cunha and on a roll call vote it is unanimous.

The Director of Finance is authorized to borrow during the fiscal year ending October 31, 2014 such sums of money in anticipation of the property taxes of the year as may be permitted by law for the purpose of meeting the current liabilities and expenses of the City and that the Director of Finance is authorized to issue the note or notes of the City therefore and to refund such note or notes and any tax anticipation notes of a prior year to the extent permitted by law.
SECTION II. This ordinance shall take effect upon its second passage and all ordinances and parts of ordinances inconsistent herewith are hereby repealed.

A. FY 2013-2014 Budget
ORDINANCE OF THE COUNCIL OF THE CITY OF EAST PROVIDENCE APPROPRIATING $166,842,842 FOR THE SUPPORT OF THE CITY GOVERNMENT FOR THE FISCAL YEAR ENDING OCTOBER 31, 2014
THE COUNCIL OF THE CITY OF EAST PROVIDENCE HEREBY ORDAINS:
SECTION I. The general fund receipts for the fiscal year ending October 31, 2014 have been established to amount to $166,842,843 made up as follows:
SECTION II. To defray the expenses of the City of East Providence for the fiscal year commencing November 1, 2013 and ending October 31, 2014, the sum of money, or so much thereof as are authorized by law indicated in the accompanying schedule, are hereby appropriated for the objects and purposes, and in the amounts expressed therein, provided that payments thereunder shall be subject to the provisions of the City Charter of the City of East Providence and also subject to the provisions of said City Charter relative to the manner and form of expenditures of money set forth in said Charter from the City Treasury.
SECTION III. All monies appropriated are to be expended by the various departments in the manner and form approved by the Director of Finance.
SECTION IV. The payment to the School Fund of the following estimated receipts, included in the appropriation of $72,858,000 for the support of the public schools for the City of East Providence fiscal year 2013-2014, shall be increased or decreased to conform with the actual amounts received from such sources during the fiscal year 2013-2014 except the appropriation of property tax.
SECTION V. The purpose of this ordinance is to adopt the Budget for the fiscal year 2013-2014 which begins November 1, 2013 and ends October 31, 2014 as prepared and submitted by the City Manager, and to implement the recommendations as set forth in the City Manager's Budget Message by the approval of said recommendations as contained herein, or by other ordinances or resolutions of the Council of the City of East Providence; all in accordance with the provisions of said Article.
SECTION VI. This ordinance shall take effect upon its passage and all ordinances and parts of ordinances inconsistent herewith are hereby repealed.

1. Candy Seel, 1340 South Broadway (02914) - in opposition to dismantling the Parks and Recreation Department.
The City Manager speaks on the issue of the split between parks and recreation with regard to the retirement of the recreation director and another recreation employee. Adding that the Budget Commission had looked at the operation and in 2013 did approve the split of recreation from parks as it functional belonged in public works. There are very different skill sets with these two departments. This was worked on with the steelworker union members who now report to the director of public works. In the interim, the recreation department has been listed under the City Manager. After looking at where things function best after review he has determined that is the Senior Center. Recreation programs are similar in many aspects to the Senior Programs. This is not an elimination of any service or employee(s) and not an increase to the tax payer. It is the only way to do this under the 5 year plan which was left to balance with the revenue side. Council has been provided this analysis. There are a lot of good programs and services but if we need to meet this revenue goal then people couldn't afford to utilize them. To keep employees and programs and to keep it affordable, with to the retirements already stated, adding these duties to the Senior Citizens Coordinator is a reduced cost. There is misinformation on the proposal. This is not an issue in the Charter which states one manager for two departments is ok.
Councilwoman Rossi explained that she volunteers regularly at the Recreation Center and in this consolidation the Recreation Center is not going to lose anything. There will not be any cuts to programs and it will still be the same. Not one person will lose their job and it will not affect services and she supports this as a savings to the City. She also thanked the current and past staff and the volunteers.
2. Alba Curti, 84 Meril Street (02914) and Former Director of Parks and Recreation disagrees with the consolidation at this time. Every city has a Parks and Recreation Department. It is running fine with the current staff without an active director and responding instead to the City Manager. There is no need to make this decision right now. Recreation is three times as big as senior services and the needs someone who understands park management and programming for recreation.
Some discussion ensues regarding the title of the possible consolidated department.
The City Manager thanked Alba Curti adding that there is a management system in the City and a middle management union and the City can't just save money by giving the existing person all this extra work without that union eventually requesting fair pay for the work. They do need a director level position. We need people in functionally similar areas to make these decisions every day with qualified people under them just like we did with all the other consolidations.
Mayor Briden asked what was being described here is to just leave it alone and not fill the director position at this time. Not to consolidate. What would be the downside of this idea?
The City Manager states that he doesn’t think the City can sustain this. It was an interim position and it needs a director to look at that level of detail a director deals with otherwise it will not run well.
Mayor Briden stated that the impression he is getting is that it is running well now.
Assistant Mayor Rose stated that there is no permanent person taking care of the department there is no one dedicated to the daily activities.
3. Julie Silva 257 North Brow Street (02914) speaks against the consolidation of the two departments.
4. Onna Moniz-John speaks against the consolidation, Recreation needs to stand on its own and is desperately needed in the community.
5. Freddie Rybka, 9 Cozzens Avenue (02915) with a few questions regarding line items in the budget.
6. Tony Fereirra, 44 Brightridge Avenue (02914) with questions regarding the savings with the consolidation of the recreation department and the senior center and also the name of the consolidated department reflecting more of recreation.
Councilwoman Capobianco makes a motion that due to the fact that EBAYcap is an asset to community she is requesting that the Council reconsider eliminating the $30,000 line item and reinstate $15,000.
This motion is seconded by Councilman Cunha.
Under discussion Councilwoman Rossi states that every dollar which is taken has to come from somewhere. Are you proposing we reduce the surplus a little more as part of the budget?
Council considers instead to an add an additional $5,000 to make the motion $20,000 and have it taken out of the surplus. The maker and seconder of the motion agree.
On a roll call vote the motion passes 4-1 with Councilwoman Rossi voting Nay.
Mayor Briden states that one way of paying for what the Council just approved is to use the proposed $11,000 increase to the Director of the Senior Center for the consolidation of the Senior Center and the Recreation Department and instead to leave the Recreation Department alone right now and use the $11,000 to pay for some of the EBAYcap funding.
Councilman Cunha makes a motion to leave the Recreation Department as it is right now and not consolidate it with the Senior Center, Councilwoman Capobianco seconds the motion and on a roll call vote the motion passes 4-1 with Councilwoman Rossi voting Nay.
A motion is made for a ¾% property tax increase by Assistant Mayor Rose, seconded by Councilwoman Capobianco and on a roll call vote it is unanimous.
A motion to place the position of legal secretary back in the Law Department budget is made by Assistant Mayor Rose, seconded by Councilman Cunha and on a roll call vote the motion passes 4-1 with Councilwoman Rossi voting Nay.
A motion to approve a position in the Highway Division of the Department of Public Works is made by Assistant Mayor Rose, seconded by Councilwoman Capobianco and on a roll call vote the motion passes 4-1 with Mayor Briden voting Nay.
A motion to approve a part time position in the Buildings Division of the Department of Public Works is made by Assistant Mayor Rose, seconded by Councilwoman Rossi and on a roll call vote it is unanimous.
A motion to approve a plumbing position to avoid the outside service costs in the Facilities Division of the Department of Public Works is made by Assistant Mayor Rose, seconded by Councilwoman Rossi and on a roll call vote the motion passes 3-2 with Councilman Cunha and Mayor Briden voting Nay.
A motion to increase salaries of non union employees with a 2% cost of living adjustment mirroring the union employees and in line with Mr. Luba’s suggestion is made by Assistant Mayor Rose, seconded by Councilwoman Rossi and on a roll call vote the motion passes 3-2 with Councilman Cunha and Mayor Briden voting Nay.
A motion to freeze the decrease in the Homestead discount is made by Assistant Mayor Rose, seconded by Councilwoman Capobianco and on a roll call it is unanimous.
A motion to freeze the decline of the early pay discount for property tax payments at 1.5% is made by Assistant Mayor Rose, seconded by Councilwoman Rossi and on a roll call vote it is unanimous.
A motion to approve in the aggregate all the suggested cuts to the budget amounting to roughly just under $900,000 is made by Assistant Mayor Rose, seconded by Councilwoman Capobianco and on a roll call vote it is unanimous.
A motion to extend the meeting by 15 minutes past the curfew is made by Assistant Mayor Rose, seconded by Councilwoman Capobianco and on a roll call vote it is unanimous.

D. Introduction of Ordinances
1.ORDINANCE OF THE COUNCIL OF THE CITY OF EAST PROVIDENCE ORDERING THE ASSESSMENT AND COLLECTION OF PROPERTY TAX ON THE RATABLE REAL ESTATE, TANGIBLE PERSONAL PROPERTY, AND AN EXCISE TAX ON REGISTERED MOTER VEHICLES AND TRAILERS.
THE COUNCIL OF THE CITY OF EAST PROVIDENCE HEREBY ORDAINS:
SECTION I. That the Council of the City of the City of East Providence hereby orders the assessment and collection of a tax on ratable real estate, tangible personal property and an excise tax on registered motor vehicles and trailers in a sum not more than One Hundred Five Million Eight Hundred Seven Thousand Nine Hundred and Seventy One ($105,807,971) dollars nor less than One Hundred One Million Seven Hundred Thirty Eight Thousand Four Hundred and Thirty Four ($101,738,434) dollars. Said tax is for ordinary expenses, for the payment of interest and indebtedness, in whole or in part, of said city, and for other purposes authorized by law.
The Tax Assessor shall assess and apportion said tax on the inhabitants and ratable property of said city as of the 31st day of December, 2013 at twelve o'clock Eastern Standard Time, according to law, and shall on completion of said assessment, date and sign same and shall make out and certify to the City Treasurer of the City of East Providence, who is charged with the duties for the collection of taxes, on or before the 15th day of June, 2014 a complete list of the names of the persons taxed and of the total value of all the real estate and personal property assessed against each person, and also the amount of registered motor vehicles and trailers assessed against each person, and also the total amount assessed against each person on said real estate, personal estate and registered motor vehicles and trailers, opposite the name of the person or persons assessed. Upon receipt of the certified tax list by the City Treasurer, he shall proceed and collect said tax on the persons and estates liable thereof; said tax shall be due and payable on and between the 1st day of June 2014 and the 1st day of July, 2014 and provided further that if said tangible personal property, motor vehicle, and real estate taxes are paid in full on or before the 1st day of July, 2014, a discount of one and a half per centum (1.5%) of the total taxes on said tangible personal property, motor vehicles, and real estate shall be granted, and all taxes remaining unpaid on the 1st day of July, 2014 shall carry until collected a penalty at the rate of twelve per centum (12%) per annum from the 1st day of June, 2014 upon said unpaid tax, however, said taxes may be paid in four installments; the first installment of twenty-five per centum (25%) on or before the 1st day of July, 2014, the second installment of twenty-five per centum (25%) on or before the 1st day of September, 2014, the third installment of twenty-five per centum (25%) on or before the 1st day of December, 2014 and the fourth installment of twenty-five per centum (25%) on or before the 1st day of March, 2015.
Each installment of taxes if paid on or before the last day of each installment period successively in order shall be free from any charge of interest.
If the first installment or any succeeding installment of taxes is not paid by the last date of the respective unpaid balance period or periods as they occur, then the whole tax or remaining unpaid balance of the taxes as the case may be shall immediately become due and payable and carry until collected a penalty at the rate of twelve per centum, (12%) per annum.
The City Treasurer shall, by advertisement in the public newspaper having circulation in the City of East Providence, notify all persons assessed to pay their respective taxes at his office on and between the said 1st day of June, and the 1st day of July, 2014 both days inclusive; said City Treasurer setting forth the hours during which his office shall remain open to receive said taxes.
SECTION ll. That any of said taxes not paid on or before the 1st day of March, 2015 shall forthwith be collected by levy upon the sale of real estate upon which it is assessed and by that or other due process of law in case of assessment upon personal property.
SECTION III. This ordinance shall take effect upon its second passage and all ordinances and parts of ordinances inconsistent herewith are hereby repealed.

E. Communications
1. Fire Chief Oscar Elmasian requesting to address the Council regarding the Annual Freaky 5K on October 20, 2013 and the road closure from Newman Avenue to Pawtucket Avenue.
The Fire Chief reports that the annual race will take place on Sunday an additional closure from Roger Williams Avenue to Pawtucket Avenue is also needed. The race proceeds benefit non-profit children’s organizations.
A motion to approve the road closures is made by Councilwoman Capobianco, seconded by Councilman Cunha and on a roll call vote it is unanimous.
A motion to adjourn is made by Councilwoman Rossi, seconded by Councilwoman Capobianco and on a roll call vote it is unanimous.
