THE COUNCIL OF THE CITY OF EAST PROVIDENCE HEREBY ORDAINS:
SECTION I. Section 18-310 entitled “Same--30 minutes” of Article X entitled “Stopping, Standing and Parking” of Chapter 18 entitled “Vehicles and Traffic” is amended by adding thereto the following:
Waterman Avenue (south side) from a point 23 feet east of North Hull Street for a distance of 90 feet, except Sundays

The Mayor requests to remove Horton's Seafood from the list and the Mayor submits a recusal form to the City Clerk.
There is a motion to remove three licenses, Deck 42, Two Jerks Pub and Grille and Tropical Ilias and separate them from the others, as there are objection letters received. The motion is made by Councilwoman Kleyla, seconded by Councilman Conley and on a roll call vote it is unanimous.
A motion is made to remove Horton's Seafood and to vote on it separately by Assistant Mayor Rose, seconded by Councilwoman Kleyla and on a roll call vote it is unanimous with one recusal from Mayor Rogers.
A motion is made to approve all other licenses listed, by Councilwoman Kleyla, seconded by Councilman Conley and it is unanimous.
A motion is made to approve Tropical Ilias, Deck 42 and Two Jerks Pub and Grille pending their settlement with their debtors by Assistant Mayor Rose, seconded by Councilwoman Kleyla and it is unanimous. The City Clerk will notify them and they will submit something to the Clerk prior to their license being released.
A motion is made to approve Horton's Seafood by Councilwoman Kleyla, seconded by Assistant Mayor Rose and on a roll call vote it is unanimous with one recusal from Mayor Rogers.

An Ordinance in Amendment of Chapter 16 of The Revised Ordinances of the City of East Providence, Rhode Island, 1998, as Amended, Entitled “Taxation”
THE COUNCIL OF THE CITY OF EAST PROVIDENCE HEREBY ORDAINS:
SECTION I. Chapter 16 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as amended, entitled “Taxation.” is amended by adding thereto the following:
ARTICLE IX. FINANCIAL REPORTING REQUIREMENTS
Sec. 16-95. Financial Reporting Requirements for the Finance Directors of the School Department and the City.
(a) The purpose of this ordinance is to improve the City’s ability to efficiently and effectively monitor its budget revenues and expenditures.
(b) The Finance Director for the City of East Providence School Department shall provide a monthly financial report to the Finance Director of the City of East Providence. Said monthly financial report shall at a minimum show budget to actual cumulative expenditures for each month.
(1) Such report shall list each budget line item by account number and title and shall identify the appropriations, encumbrances, expenditures and account balance for the current fiscal year.
(c) The budget to actual expenditure report provided to the City Finance Director by the school Finance Director shall also be provided to the City Council and the School Committee.
(d) This budget to actual report shall be provided by the School Department Finance Director to the City Finance Director no later than fourteen days after the close of the previous month.
(e) The Finance Director for the School Department shall also provide the Finance Director for the City of East Providence a quarterly report which at a minimum shall contain the revenue and expense estimates for all categories in the School Department budget as provided for in section (b) (1) of this ordinance. In each instance where there is a deviation from the budget for any expenditure the report shall contain an explanation for the deviation and a corrective plan of action to reconcile the expenditure with the budget as soon as practicable.
SECTION II. This ordinance shall take effect upon second passage and all ordinances and parts of ordinances inconsistent herewith are hereby repealed.

THE COUNCIL OF THE CITY OF EAST PROVIDENCE HEREBY ORDAINS:
SECTION I. Article IV Entitled “Property Tax on Ratable Real Estate and Tangible Personal Property and Excise Tax on Registered Motor Vehicles and Trailers” of Chapter 16 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as Amended, Entitled “Taxation.” is Amended by Adding Thereto the Following:
Sec. 16-54. Waiver of the maximum levy.
(a) The purpose of this ordinance is to ensure that the City Council follows the highest standards of transparency regarding taxation when adopting its annual budget.
(b) The State of Rhode Island has established a maximum levy for taxation by municipalities pursuant to R.I.G.L. § 44-5 et seq. Pursuant to R.I.G.L. § 44-5-2 (d)(e), a municipality may request a waiver from the maximum tax levy and impose a tax greater than the maximum levy but the State Law requires an affirmative vote of at least four-fifths (4/5) of the full membership of the governing body of the City.
(c) The City Council may not request a waiver to the maximum tax levy pursuant to R.I.G.L. § 44-5-2 (d) (e) unless the request for the waiver is approved by a Resolution passed by a four-fifths (4/5) vote of the City of East Providence City Council. Further, the City of East Providence City Council may not exceed the maximum levy provided for in R.I.G.L. § 44-5 et seq. unless it is approved by Resolution passed by a four-fifths (4/5) vote of the City Council. Said Resolutions must specify the reasons the City Council is seeking the waiver of the maximum tax levy and contain the specific amount by which the City Council exceeds the maximum tax levy.
(d) Said Resolutions provided for in subsection (c) of this ordinance must be passed at a public hearing of the City Council.

This annual event is taking place this Sunday, 10/23 at 10:00am at Station 3 at the corner of Greenwood Avenue in Rumford. Many participants dress in costume for the event.

1. Budget Freeze - The City Manager reported there would be a budget freeze for all purchases and that he would approve all purchases over $100.
2. Department Head Meetings – The City Manager announced he would be starting bi-weekly Department Head Meetings.
3. 100 Day Action Plan - The City Manager unveiled his 100 Day Action Plan and submitted such for the record.

THE COUNCIL OF THE CITY OF EAST PROVIDENCE HEREBY ORDAINS:
SECTION I. Subsection (b) of Section 8-5 entitled “Closing hours for businesses.” of Article I entitled “In General” of Chapter 8 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as amended, entitled “Licenses and Business Regulations” is amended as follows:
(b) Victualing houses and bowling alleys; permit required for extension of closing hours. No licensed victualing house or bowling alley shall be kept open between 1:00 a.m. and 4:00 a.m. during the last six days of the week without first obtaining a special permit from the city council extending the closing hour beyond 1:00 a.m. Such special permit may be granted for a probationary period or with such conditions and terms as the city council may provide. The fee for such permit shall be $100.00 125.00.

(c) The fee for each holiday license shall be $100.00 125.00 paid to the city clerk upon obtaining the license.
SECTION VII Section 8-32 entitled “Taverns and victualing houses.” of Article II entitled “Miscellaneous Business and Occupational Licenses and Permits” of Chapter 8 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as amended, entitled “Licenses and Business Regulations” is amended as follows:
Sec. 8-32. Taverns and victualing houses.
The license fee for serving of food at diners, restaurants, taverns and other food dispensing establishments is hereby fixed according to classification. There shall be three classes of victualing licenses, and the fee for each class license shall be based upon the capacity of the licensed premises to accommodate the serving of food at any one sitting and the establishment of a minimum fee for those premises where seating is not available. Such classes and the fees for classes are hereby fixed as follows:
(1) First class, capacity to serve 51 persons or over . . . . . $150.00 175.00

SECTION VIII. Subsection (b) of Section 8-69 entitled “Dancing and entertainment in establishment selling alcoholic beverages.” of Article IV entitled “Amusements” of Chapter 8 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as amended, entitled “Licenses and Business Regulations” is amended as follows:

(b) Whenever the city council shall grant an annual license permitting dancing or any other type of entertainment, the fee for such license shall be $150.00 175.00.
SECTION IX. Section 8-371 entitled “Fee.” of Article XIII entitled “Private Detective’s License” of Chapter 8 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as amended, entitled “Licenses and Business Regulations” is amended as follows:
Sec. 8-371. Fee.
No license under this article shall be issued until the applicant pays to the city clerk a license fee of $150.00 160.00 per annum on December 1 of each year. The city council may authorize proration of the license fee in a proportionate amount when the initial application is granted during the course of the year, in no event shall the fee be less than $25.00.
SECTION X. Subsection (c) of Section 8-523 entitled “Procedure for licensing.” of Article XIX entitled “Wrecker and Towing Services” of Chapter 8 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as amended, entitled “Licenses and Business Regulations” is amended as follows:
Sec. 8-523. Procedure for licensing
(c) Whenever an application is filed with the city clerk, the applicant shall pay at the time of filing of such application a license fee of $25.00 50.00.
SECTION XI. This ordinance shall take effect upon its second passage and all ordinances or parts of ordinances inconsistent herewith are hereby repealed.

2. An Ordinance in Amendment of Chapter 3 of The Revised Ordinances of the City of East Providence, Rhode Island, 1998, as Amended, Entitled “Animals.”
THE COUNCIL OF THE CITY OF EAST PROVIDENCE HEREBY ORDAINS:
SECTION I. Subsection (a) of Section 3-35 entitled Dog License; fees; penalty; senior citizen discount.” of Chapter 3 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as amended, entitled “Animals” in amended to read as follows:
(a) Every owner or keeper of a dog shall annually in the month of April cause that dog to be licensed from the ensuing May 1 in the office of the city clerk; and shall pay the city clerk for the license, so issued, $10.00. Additionally, there shall be a $1.00 surcharge for each dog license issued by the municipality which shall be deposited in the city's spay/neuter account to fund low-cost spay/neuter programs. In addition, the municipality shall charge an additional fee of $2.00 per license, that fee to be used exclusively by the city for the enforcement of laws pertaining to animals; for a total of $13.00 per dog license {R.I.G.L. 4-13.1-9(d)}; with the exception of a person who shows proof of a disability and senior citizens who shall, upon proof that they have attained the age of 65 years, pay the sum of $5.00 for said license. All licenses issued shall be valid in every city or town during the then current year; provided that any person, who shall become the owner or keeper of a dog, shall cause such dog to be licensed as aforesaid within 30 days after the person becomes the owner or keeper; provided further, that the city clerk shall not issue any license under this section unless the dog has been inoculated against rabies for the period during which such license would be valid, and has provided proof that the dog has been spayed or neutered, or has a written report from a licensed veterinarian stating that the life of the dog would be jeopardized by the spay/neuter surgery and that this health condition is likely to be permanent.
SECTION II. This ordinance shall take effect upon its second passage and all ordinances and parts of ordinances inconsistent herewith are hereby repealed.
