The City Council meets in the Council Chambers on Friday, July 21, 2006 and Assistant Mayor Valerie A. Perry calls the meeting to order at 11:00 a.m.

I.    CITY COUNCIL SITTING AS LICENSING COMMISSIONERS

LICENSES NOT REQUIRING PUBLIC HEARING

 

1)  Vict/Not Over 25  Steven Gelsomino, M & J Produce Company, 198 Willett Avenue

Subject to approvals from the Chief of Police, Building Inspector, Health Inspector and Fire Marshall.

Steven Gelsomino, 65 Governor Bradford Drive, Barrington, RI is present and sworn in by the City Solicitor.

 

On motion of Councilman Midgley, seconded by Councilman Silva, it is unanimously voted to approve.  It is noted for the record that Councilman Caine and Mayor Larisa are absent.

 

2)  Holiday/Sales  Steven Gelsomino, M & J Produce Company, 198 Willett Avenue

Subject to approvals from the Chief of Police, Building Inspector, Health Inspector and Fire Marshall.

 

On motion of Councilman Midgley, seconded by Councilman Silva, it is unanimously voted to approve.  It is noted for the record that Councilman Caine and Mayor Larisa are absent.

 

LICENSING COMMISSIONERS RESUME SITTING AS CITY COUNCIL PUBLIC HEARING

 

II.   PUBLIC HEARINGS

ORDINANCES - FINAL PASSAGE (Given First Passage July 11, 2006. Advertised-Providence Journal-July 13, 2006)               

 

The following is an ordinance amendment regarding removal from employment list

 

SECTION I.  Subsection (d) of Sec. 11-65 entitled “Eligible or promotional list.” of Article III entitled “Personnel Plan” of Chapter 11 of the Revised Ordinances of the City of East Providence, Rhode Island 1998, as amended, entitled “Personnel” is amended to read as follows:

 

(d)  Removal from employment list.  The name of any person appearing on an employment list may be removed by the board if the eligible person requests in writing that his name be removed or if he cannot be located by postal authorities or other means of ordinary communication or does not respond within five days following the date of notification or does not report for scheduled interviews, exams, etc.  The name of any eligible person may also be removed if the eligible person has waived appointment once in the same class or position. The name of any eligible person may also be removed if the name has been certified for appointment once, has not been appointed and has been recommended in writing for removal by the appointing authority (City Manager), the prospective department head, the Human Resources Director and the Affirmative Action Officer.  The names of qualified candidates not recommended for removal would remain on the list for future consideration. Any cause specified in this division for the rejection of applications may likewise be cause for removal of the name of an eligible person from the list on which it appears. (Requested by:Acting City Manager and Director of Human Resources)

 

On motion of Councilman Midgley, seconded by Councilman Silva, it is unanimously voted to dispense with the reading of the ordinance.

 

On motion of Councilman Midgley, seconded by Councilman Silva, and on a roll-call vote, it is unanimously voted to approve for Final Passage.  It is noted for the record that Councilman Caine and Mayor Larisa are absent.
