LICENSING COMMISSIONERS RESUME SITTING AS CITY COUNCIL
ORDINANCES - FINAL PASSAGE (Given first passage April 4, 2000

1. The following ordinance requires the registration of vicious dogs and requires proof of liability insurance for such dogs in the amount of $100,000. It imposes a fine of not less than $100.00 nor more than $500.00 for each offense and/or 30 days in prison.
AN ORDINANCE IN AMENDMENT OF CHAPTER 3 OF THE REVISED ORDINANCES OF THE CITY OF EAST PROVIDENCE, RHODE ISLAND, 1998, AS AMENDED, ENTITLED "ANIMALS." which amends SEC I. Sec. 3-1 entitled "Definitions" by adding thereto the following:
Enclosure means a fence or structure of at least six (6) feet in height, forming or causing and enclosure suitable to prevent the entry of young children and suitable to confine a vicious dog in conjunction with other measures which may be taken by the owner or keeper, such as tethering of the vicious dog. Such enclosure shall be securely enclosed and locked and designed with secure sides, top and bottom and shall be designed to prevent animal from escaping from the enclosure.
Vicious dog means any dog that, when unprovoked, inflicts bites or attacks a human being or other animal either on public or private property, or in a vicious or terrorizing manner approaches any person in apparent attitude of attack upon the streets, sidewalks or any public grounds or places; any dog with a known propensity, tendency or disposition to attack unprovoked, to cause injury or to otherwise endanger the safety of human beings or domestic animals; any dog which attacks a human being or domestic animal without provocation; any dog owned or harbored primarily or in part for the purpose of dog fighting or any dog trained for dog fighting and/or any dog not licensed according to city ordinance.
SECTION II. Article II entitled "Dogs" of Chapter 3 of the Revised Ordinances of the City of East Providence, Rhode Island, 1998, as amended, entitled "Animals" is amended by adding thereto the following:
Sec. 3-36. Registration of certain breeds of dogs required.
Any person having custody, ownership or control of any American Pit Bull dog, Pit Bull Terrier dog or Pit Bull mixes ("Pit Bulls") must register said dog before the age of three (3) months with the City on a form provided by the City. Said form shall require the following information: name, address and telephone number of the dog's owner; the address where said dog is harbored, if different from the owner's address; dog's sex, color, rabies certificate and tag number and other distinguishing characteristics of the dog, as well as proof of liability insurance of not less than one hundred thousand ($100,000) for such registration.
Sec. 3-37 Registration of vicious dogs.
No dog determined to be a "vicious dog" as defined under Rhode Island General Law shall be licensed for any licensing period commencing after May 1, 2000, unless the owner or keeper of such vicious dog shall meet the following requirements:
(1) The owner or keeper shall present to the City Clerk proof that the owner or keeper has procured liability insurance in the amount of at least one hundred thousand dollars ($100,000.) covering any damage or injury which may be caused by such vicious dog during the twelve-month period for which licensing is sought, which policy shall contain a provision requiring the City be named as additional insured for the sole purpose of the City Clerk to be notified by the insurance company of any cancellation, termination or expiration of the liability insurance policy.
(2) The owner or keeper shall have the licensing number assigned to such vicious dog, or such other identification number as the City Clerk shall determine, tattooed upon such vicious dog by a licensed veterinarian or other state or city agency on the upper inner lip of the vicious dog. Said number shall be noted on the city licensing files for such vicious dog if it is different from the licensing number of such vicious dog. For the purpose of this section, "tattoo" shall be defined as any permanent numbering of a vicious dog by means of indelible or permanent ink with the number designated by the licensing authority or any other permanent, acceptable method of tattooing. The City Clerk shall affix a two (2) letter prefix to the identification number in order to identify the city in which the dog was originally licensed.
(3) The owner or keeper shall display a sign on his or her premises warning that there is a vicious dog on the premises. Said sign shall be visible and capable of being read from the public highway.
(4) The owner or keeper shall sign a statement attesting that the owner or keeper shall maintain and not voluntarily cancel the liability insurance required by this section during the twelve-month period for which licensing is sought, unless the owner or keeper shall cease to own or keep the vicious dog prior to the expiration of such license; and
The owner or keeper shall, on or prior to the effective date of such license for which application is being made, have a fenced and locked enclosure for the vicious dog on the property where the vicious dog will be kept or maintained; and
The owner or keeper shall notify the licensing authority within twenty-four (24) hours if a vicious dog is on the loose, is unconfined, has attacked another animal or has attacked a human or has died or has been sold or given away. If the vicious dog has been sold or given away, the owner or keeper shall also provide the licensing authority with the name, address and telephone number of the new owner or keeper.
The owner or keeper shall not allow any vicious dog to be outside of the dwelling of the owner or keeper or outside of the enclosure unless it is necessary for the owner or keeper to obtain veterinary care for the vicious dog or to sell or give away the vicious dog or to comply with the commands of the Animal Control Officer with respect to the vicious dog. In such event, the vicious dog shall be securely muzzled and restrained with a chain having a tensile strength of three hundred (300) pounds and not exceeding three (3) feet in length and shall be under the direct control and supervision of the owner or keeper.
Sec. 3-38. Acquisition or training of dangerous dogs prohibited.
No person shall own, train or harbor any dog for the purpose of dog fighting, or train, torment, badger, bait or use any dog for the purpose of causing or encouraging said dog to attack human beings or domestic animals when not provoked.
Sec. 3-39. Action for damages Destruction of offending vicious dog.
(a) If any dog declared vicious, when unprovoked, kills or wounds, or assists in killing or wounding, any domestic animal, belonging to or in the possession of any person, or, when unprovoked, attacks, assaults, bites, or otherwise injures any human being, or assists in attacking, assaulting, biting or otherwise injuring any human being while out or within the enclosure of the owner or keeper of the vicious dog, or while otherwise on or off the property of the owner or keeper whether or not the vicious dog was on a leash and securely muzzled or whether the vicious dog escaped without fault of the owner or keeper, the owner or keeper of the dog may be liable to the person aggrieved for all damage sustained, to be recovered in a civil action, with costs of suit. It is rebuttably presumed as a matter of law that the owning, keeping, or harboring of a vicious dog in violation of this chapter is a nuisance. It shall not be necessary, in order to sustain any action, to prove that the owner or keeper of the vicious dog knew that the vicious dog possessed the propensity to cause this damage or that the vicious dog had a vicious nature.
(b) Upon the attack or assault, the Animal Control Officer is empowered to confiscate the vicious dog, and, if the conduct of the vicious dog or its owner or keeper constituted a violation of the provisions of this chapter, the attack or assault may be punishable by the destruction of the animal.
Sec. 3-40. Vicious dog penalties; compliance.
Any person found in violation of Secs. 3-36, 3-37, 3-38 and 3-39 this Chapter shall be fined not less than $100.00 nor more than $500.00 for each offense and/or sentenced to a maximum of thirty (30) days in prison.
The Animal Control Officer is hereby empowered to make whatever inquiry is deemed necessary to ensure compliance with the provisions of this Chapter, and said Animal Control Officer is hereby empowered to seize and impound any vicious dog whose owner or keeper fails to comply with the provisions of this Chapter.
On motion of Mr. Grant, seconded by Mr. Rogers, it is unanimously VOTED to dispense with the reading of the ordinance.
Chief Dias asks that the ordinance be deferred until further research is done on the ordinance.

Following the speakers, the Council engage in a discussion about the need to enforce the existing laws. Chief Dias says he does not feel the state law does enough. It is decided that a mechanism is needed to confiscate and hold vicious dogs until the owner has demonstrated compliance with the law.
Mr. Rogers states that he believes there are categories of dogs that are dangerous and thinks they should be banned from the City. He says it is a matter of public safety.
Mayor Larisa says that if there is such a thing as a responsible Pit Bull owner, then there can be no ban. There are two things needed for this ordinance: 1) The City needs a way to arrest and hold the dog; 2) Need to enforce the leash laws.
On motion of Mr. Midgley, seconded by Mr. Grant, and on a roll call vote, it is unanimously VOTED to defer the ordinance.
2. The following ordinance provides for a stop sign on Grosvenor Avenue at Appian Way due to neighborhood concerns about speed and traffic volume.
AN ORDINANCE IN AMENDMENT OF CHAPTER 18 OF THE REVISED ORDINANCES OF THE CITY OF EAST PROVIDENCE, RHODE ISLAND, 1998, AS AMENDED, ENTITLED "VEHICLES AND TRAFFIC", which amends Sec. 18-269 entitled "Stop and yield intersections designated; when stops required." by adding thereto the following:
GROSVENOR AVENUE (eastbound and westbound traffic) at Appian Way.

On motion of Mr. Grant, seconded by Mr. Miranda, it is unanimously VOTED to change the order of business.
William J. Robinson, 21Cumberland St., East Providence, Rhode Island addresses the Council and submits a petition regarding concerns of residents in the Boyden Heights neighborhood. One of the issues Mr. Robinson refers to is for a traffic light on Pawtucket Avenue for automobiles leaving the neighborhood. The second issue deals with property known as "Dighton Place," which Mr. Robinson says was taken by the City many years ago. He asks that the neighbors be given access to the Bike Path through this property.
Mr. Conley states that the property in question was the subject of litigation in the early 1960's and the courts ruled that the area was the City of East Providence public park.
Francis Bergin addresses the Council. He states that the property belonged to his grandfather and says he believes the property is still his.
Mr. Conley speaks about a decree entered by Justice Perkins in 1965 which specifically dedicates that area as a public park. Mr. Bergin says he never knew of any dedication of the property by anyone.
Jack Oliver, 50 Astral Avenue, East Providence, Rhode Island, addresses the Council. He says he has a copy of the decree and does not see anything about the park being dedicated to the City. Mr. Oliver says he brought action because of vehicles being stored on the property, which blocked his access through the park. Justice Perkins ruled that the property owners could not store or repair vehicles on the property.
Mayor Larisa suggests that both parties sit down with the Solicitor within the next couple of weeks to work out the problems, and asks Mr. Conley to report back to the Council.
Victor Pavao, 1 Astral Avenue, East Providence, Rhode Island addresses the Council. Mr. Pavao says that access to the Bike Path has never been blocked in that area.
Renee Ziobrowski, 14 Waterview Avenue, East Providence, Rhode Island disagrees with Mr. Pavao and says it is impossible to ride to the bike path through that area, that there is no access. She says the neighbors should have easy access to the bike path. She also speaks about a traffic light at Pawtucket Avenue and Waterview Avenue. She says that the new development will increase the traffic and will cause a safety concern and asks that the Council address these concerns.
Mayor Larisa says the City Solicitor will research the question of who owns the property and will advise the Council.
On motion of Mr. Grant, seconded by Mr. Miranda, it is unanimously VOTED to endorse a resolution that the Department of Transportation consider moving the light at Bayview in light of the new subdivision and traffic concerns raised by the neighbors.
Mayor Larisa asks the Public Works Department to provide a report at the next Council meeting regarding the width of the road.
On motion of Mr. Miranda, seconded by Mr. Rogers, it is unanimously VOTED to return to the regular order of business.
1. Requesting Pre-qualification approval for Senior Center Annex Renovations
Mr. Lemont recommends the approval of five contractors for pre-qualification. On motion of Mr. Rogers, seconded by Mr. Miranda, it is unanimously VOTED to approve.
2. Consultant Pre-Qualification - Geographical Information System (GIS) for the City's sanitary sewer system.
Steve Coutu, Deputy Public Works Director, explains to the Council how the final three firms were chosen. He recommends that contracts for the GIS storm drain system and the GIS sewer system be combined.
On motion of Mr. Grant, seconded by Mr. Miranda, it is unanimously VOTED to approve.
3. ADDENDUM
$150,000 Loan Request of Nulco Manufacturing Corp. & Subsidiaries
Mr. Lemont reports that the Economic Development Commission voted unanimously to grant a loan to Nulco Manufacturing, who will be consolidating their operation and moving into East Providence. He says it is his recommendation and the recommendation of the Economic Development Commission to approve the loan.
Kenneth Nulman, President of Nulco Manufacturing, 263 Benefit Street, Providence, Rhode Island is present and answers questions from the Council regarding his operation.
On motion of Mr. Grant, seconded by Mr. Miranda, and on a roll call vote, it is unanimously VOTED to approve.
4. City Manager's Report
Mr. Lemont mentions the display in the City Hall Lobby, prepared by the City's Parks Department. Steve Mutter, Recycling Coordinator, publicly thanks the Home Depot people in Seekonk for letting the City take the materials on consignment and also the Rumford Pet Center for donating the goldfish for the pond. He commends the members of the Parks Division for their work in the project.
He also mentions the past weekend's Earth Day Clean-up and thanks those that were involved. He thanks Senator Damiani and Representative Sullivan for their input in getting the sidewalks on Pawtucket Avenue swept by the State.
Unanimous Consent - Mr. Midgley
Mr. Midgley receives Unanimous Consent to announce the opening of the Compost Site on Forbes Street for yard waste. It will be open on the last Saturday in April, April 29th and on the 6th and 13th of May from 10 am to 2 pm for leaves, grass, and other organic material.
Mr. Lemont mentions that a new lithograph is available for sale in the Carousel Office for $50. John Conley reports that the Carousel will open on Easter Sunday. It is decided that if it rains on Sunday, the Annual Egg Hunt will be on the following Sunday at noon.

a. Required Action to Address Problems at Corner of Roger Williams Avenue & No. Broadway (Best Gas)
Mr. Rogers speaks on the disrepair of the subject property. Mr. Conley reports that there is a court hearing scheduled for May 23, 2000. Mr. Conley will inspect the property tomorrow.
b. Enforcement of New Ordinance re: All Terrain Vehicles
Mr. Rogers mentions that an ordinance was approved by the Council prohibiting the use of all terrain vehicles on certain designated public parks and ways, including the railroad path which runs from the Turner Reservoir, all the way beyond the Red Bridge. He asks the City Manager to check with the Public Works Department to see if the proper signs have been posted. He also asks about the enforcement of the prohibition. Mr. Rogers asks the Chief to report back to the Council within the next couple of meetings of what has been done and who has been cited.
3. Safe Summer 2000 - Mr. Rogers defers this to the next meeting.

Discussion of Lyon Avenue
Mr. Miranda speaks about property on Lyon Avenue which he has received numerous complaints about. He states that he has been trying to have this situation taken care of for the past year, but nothing seems to be getting done. He says the neighbors are very disturbed and do not understand how this property can be left the way it is. Mr. Miranda asks Mr. Conley what can be done to get the property cleaned. Mr. Conley responds that the City has the authority to clean the property and place a lien on it. Mr. Miranda says he wants the property cleaned up, and if it is not cleaned by the next Council meeting, he will put it back on the docket.

Mayor Larisa mentions the Broadway underpass project and says that any day now, the construction will begin and will last until Thanksgiving.

The following ordinance addresses the impact of the sight distance of vehicles attempting to exit Short Street onto Wheldon Avenue.

WHELDON AVENUE (south side) from Short Street westerly 20 feet.

The following ordinance addresses the problem of excessive speed of vehicles traveling southerly on Massasoit Avenue at the curve onto Waterman Avenue.
3. AN ORDINANCE IN AMENDMENT OF CHAPTER 18 OF THE REVISED ORDINANCES OF THE CITY OF EAST PROVIDENCE, RHODE ISLAND, 1998, AS AMENDED, ENTITLED "VEHICLES AND TRAFFIC", which amends SECTION I. . Sec. 18-203 entitled "Decrease of state maximum speed." by adding thereto the following:
MASSASOIT AVENUE from Central Avenue to Waterman Avenue - 20 miles per hour.
SECTION II. Sec. 18-202 entitled "Increasing state speed limits in certain zones." is amended by deleting therefrom the following:
MASSASOIT AVENUE from Waterman Avenue to Dexter Road - 30 miles per hour.
SEC. III. Sec. 18-202 entitled "Increasing state speed limits in certain zones." is amended by adding thereto the following:
MASSASOIT AVENUE from Central Avenue to Dexter Road - 30 miles per hour.

The following ordinance provides stop signs at the intersections of Argyle Avenue with Daisy Drive and Lorcum Lane to discourage increased speed with the cut-through" traffic in the neighborhood.

DAISY DRIVE (southbound traffic), at Argyle Avenue.
ARGYLE AVENUE (eastbound and westbound traffic), at Lorcum Lane.

The following ordinance addresses safety concerns by establishing no parking restrictions on Bristol Avenue.

AN ORDINANCE IN AMENDMENT OF CHAPTER 18 OF THE REVISED ORDINANCES OF THE CITY OF EAST PROVIDENCE, RHODE ISLAND, 1998, AS AMENDED, ENTITLED "VEHICLES AND TRAFFIC.", which amends Article X entitled "Stopping, Standing and Parking." Subsection 18-307 entitled "Parking prohibited at all times." by adding thereto the following:
BRISTOL AVENUE (both sides), from Viola Avenue easterly for 25 feet.

Motion to approve is made by Mr. Miranda, seconded by Mr. Grant. Mr. Midgley asks for discussion. He states that there is an ordinance that says parking is prohibited within 20 feet of any intersection. He says this ordinance is unnecessary.
After further discussion, motion is withdrawn by Mr. Miranda and Mr. Grant.
On motion of Mr. Grant, seconded by Mr. Miranda, it is unanimously VOTED to defer.
The following ordinance provides a parking space for a handicapped resident of Anthony Street.

AN ORDINANCE IN AMENDMENT OF CHAPTER 18 OF THE REVISED ORDINANCES OF THE CITY OF EAST PROVIDENCE, RHODE ISLAND, 1998, AS AMENDED, ENTITLED "VEHICLES AND TRAFFIC.", which amends Article X entitled "Stopping, Standing and Parking." Subsection 18-315 entitled "Reserved parking designated--Handicapped parking." by adding thereto the following:
ANTHONY STREET, (east side) in front of house number 57/59, from a point 555 feet north of the Taunton Avenue intersection, northerly for a distance of 20 feet..
