Roland Beauregard, 11 Wingate Road, Lincoln, Rhode Island is present and sworn. He testifies that the Bowling Center was opened for 11 nights before he realized he needed a special license. He says he hired 2 police officers and as far as he knew, he had the Police Chief's approval on both licenses.
Mr. Conley states that the City ordinance does not allow to extend hours on Sundays between the hours of 1:00 A.M. and 12:00 P.M. Mr. Beauregard responds by saying that he doesn't know when the laws were written, but bowling alleys have been opened on Sunday mornings for many years.
Mr. Rogers questions the applicant. He asks Mr. Beauregard if he is aware of the so called "Rave Parties" and the problems that result from these parties. He reads a recommendation by the Police Chief that the licenses be denied because of information received from other Police Departments who have dealt with similar operations.
On motion of Mr. Miranda, seconded by Mr. Grant, it is unanimously VOTED to make the report part of the record. It is noted that Mayor Larisa is absent for the vote.

1. AN ORDINANCE IN AMENDMENT OF CHAPTER 17 OF THE REVISED ORDINANCES OF THE CITY OF EAST PROVIDENCE, RHODE ISLAND, 1998, AS AMENDED, ENTITLED "UTILITIES.", which amends Subsection (c) of Sec. 17-183 entitled "Charges to be based upon water consumption; rate" to read as follows:
(c) The water consumption portion of the sewer charge shall be at a rate of $1.90 per hundred cubic feet of water used based upon the actual quarterly or monthly meter reading of water consumption less an annual exemption of 3500 cubic feet. Such exemption shall be prorated quarterly or monthly for users of city water who are billed on a quarterly or monthly basis.

Ordinance amends the water consumption portion of the sewer use charge from $1.06 to $1.90 per hundred cubic ft of water used in conformance with the 1999-2000 FY budget.

2. City Manager's Report
Mr. Lemont comments about the lack of progress at the Soccer Field near Martin Junior High School. He says the City is awaiting approval from D.E.M., and will be meeting with them next week to try and resolve all issues

2. Cathodic Protection for the Providence Water 48-inch steel water main
Mr. Conley states that the Providence Water Supply Board is requesting changes to a contract that was previously approved by the City Council. The changes include: 1) changing the installation of a meter from inside to outside (there are no objections from the Public Works Director); 2) payments to be made on an annual basis rather than on a monthly basis (no objection from the Administration on that matter); 3) payment of Attorney's fees be omitted from the indemnity agreement (it is our policy to require that parties indemnifying us pay our attorney's fees). Mr. Conley says it is his recommendation to approve the first two and not to approve the third.
On motion of Mr. Grant, seconded by Mr. Rogers, it is unanimously VOTED to approve as stated by Mr. Conley. It is noted that Mayor Larisa is absent for the vote.

City Manager Review
On motion of Mr. Miranda, seconded by Mr. Grant, it is unanimously VOTED to go into Closed Session at the end of the meeting to discuss City Manager Job Performance Review.

1. Dumpsters
Mr. Midgley speaks about dumpsters being parked on city streets and public ways. He says he is not trying to harass people, but they are a hazard to navigation, and he says he would like ordinances to deal with them. Julia Forgue, Director of Public Works, reports that on how some other communities deal with the issue, i.e., varying degrees of permit processes, charging of fees, time limits, etc. She speaks about a recommendation that the City develop a permit process, with the Council deciding on whether or not to charge a fee for the permit. A time limit would be placed on the permit along with a time limit for emptying after it is filled.
Mr. Midgley says it would not have anything to do with dumpsters on private property, but would deal with them on city streets. He requests that an ordinance be drafted.
2. Trash Trucks
Mr. Midgley speaks about leaking trash trucks. He asks Director Forgue if the trucks are required to have containments so that they don't leak, and she answers in the affirmative. Mr. Midgley asks Director Forgue to speak to the company to resolve the problem.
It is noted that Mayor Larisa is now present - 8:20 p.m.
3. Let's Not Make Scents
Mr. Midgley speaks about the odor coming from the Wastewater Treatment Plant.
Mayor Larisa asks Director Forgue what the problem is and what can be done about it. She speaks about the possible remedies, and says they are being looked into.
4. Handicapped Parking
Mr. Midgley speaks about a program in Connecticut that uses handicapped people armed with Polaroid cameras taking pictures of cars illegally parked in handicapped parking spaces. The information about the time and place is written on the back of the pictures, which are then turned over to the Police Department for the issuance of a summons.
Major Wayne Gallagher says he has heard about a similar program and says his main concern would be the cost of the program, as well as the laws and enforceability.
Mr. Conley states that the City already has ordinances which address handicapped parking violations, and suggests that an administrative mechanism to enforcement be put into place.
After further discussion, it is agreed that the City Solicitor will draft a Resolution with the parameters of the program.

New Multi-purpose Recreation Facility
Councilman Rogers asks Recreation Director Joseph Crook to give the Council a report which would address: 1) what are the inadequacies of the present Recreation Center? 2) what is needed? 3) where will it be located? 4) what size is needed? 5) what will it cost? 6) what will it be used for?
Director Crook addresses the Council. He states that the Recreation Center building at Bullocks Point Avenue is approximately 80 years old, which was built as a school and rehabilitated in 1978 to be used as a Recreation facility. He says the facility provides minimum recreational activity. Mr. Crook will prepare a full report for the Council.
Unanimous Consent - Mayor Larisa
Mayor Larisa speaks about the Ruth/Williams Memorial ceremony held on the previous Sunday at Pierce Memorial Field. He mentions the dedication of former Senator William Castro, who Chaired the Committee. It is suggested that a Proclamation be presented to Senator Castro at the next Council meeting.
Unanimous Consent - Councilman Midgley
Mr. Midgley informs residents that the Landfill is open Saturday mornings from 10:00 A.M. to 2:00 P.M. for the deposit of leaves and yard waste.
RESOLUTION OF THE CITY OF EAST PROVIDENCE CITY COUNCIL AUTHORIZING AND ENDORSING THE APPLICATION FOR ENTERPRISE ZONE DESIGNATION UNDER THE RHODE ISLAND ENTERPRISE ZONE PROGRAM.
