Presentation to East Providence Police Department

Re: Memorandum from Chief Carl Winquist, requesting removal of Minerva Pizza, 1022 So. Broadway, from the Docket for automatic renewal of their beer and wine license.
Chief Winquist asks the Council to remove Minerva Pizza from the renewal list and requests a SHOW CAUSE HEARING on the license. He says his department has evidence that will subsequently persuade the Council to revoke the liquor license. He says it stems from a incident that began at the establishment and ended up in a shooting, and steps could have been taken to prevent the problem.
Motion is made by Mr. Miranda, seconded by Mr. Lynch, to instruct the City Clerk to send a SHOW CAUSE HEARING letter to Minerva Pizza. Motion passes unanimously on a roll-call vote.
There is no one from the public who wishes to speak on the licenses. Motion is made by Mr. Lynch, seconded by Mr. Miranda, to approve the licenses as amended. Motion passes unanimously on a roll-call vote.
Motion is made by Mr. Sullivan, seconded by Mr. Larisa, to change the order of business after the licenses are heard, and move the docketed item under Council Business regarding Crescent Park Property to the next docketed item.
Motion passes 5-0.

Mr. Sullivan speaks on a tentative agreement for an out of Court settlement reached between Kelly & Picerne and the City in reference to land at Crescent Park. He says Kelly & Picerne has offered the City 2/3 of the land at Bay Side Park and in turn will build fifty eight single family homes on the cove side and four single family homes on Bullocks Point Avenue. The remaining land will be turned over to the City, which includes the beachfront from Beach Road to the Terrace. Mr. Larisa says the agreement meets the goal of the Council to keep the beach front property.
The issue is opened to the public.
Harold L. Gerstein, Rhodes Avenue, congratulates the Council on working together to resolve this issue.
Edna Snow, 128 Allerton Avenue, congratulates the Council on the issue.
David Kelleher, 36 Riverside Drive, congratulates the Council and speaks of his concern about the trees located behind his house on the Cove side.
Mr. Conley states that CRMC approval is required for the Cove side.
Mr. Larisa speaks of forming a Riverside Beach Commission, which will determine what to do with the remaining land.
Rose Larisa, 77 Argyle Avenue, is present and sworn . She thanks Mr. Sullivan, Mr. Larisa, and Mr. Conley and the other members of the Council for the agreement.
Jobelle Tracy, 10 Avenue A, thanks Mr. Larisa and Mr. Sullivan and asks about the Beach Commission and says she is interested in serving.
Gail Durfee, 26 Stoneham Drive, requests the Council to defer action until the plaintiffs Attorney Arlene Violet can review the agreement.
After further discussion, motion is made by Mr. Sullivan, seconded by Mr. Larisa, to accept the offer by Kelly & Picerne and direct the City Solicitor to draw up a Consent Agreement. Motion passes unanimously on a roll-call vote.
The meeting recesses at 9:15 P.M. and reconvenes at 9:25 P.M.
The meeting returns to the regular order of business on a motion by Mr. Larisa,

ORDINANCES - FINAL PASSAGE (Given First Passage October 3, 1995)

AN ORDINANCE IN AMENDMENT OF CHAPTER 11 OF THE REVISED ORDINANCES OF THE CITY OF EAST PROVIDENCE, RHODE ISLAND, 1987, AS AMENDED, ENTITLED "PERSONNEL, PENSIONS AND RETIREMENT.", which amends Article III. entitled "Personnel Plan .", adding thereto the following:
Section 11-75. Ratification of collective bargaining agreements.

CHAPTER NO. 382

The above-entitled ordinance, referred to this time and place for a public hearing and consideration of final passage, is called for hearing.
Mayor Grant says this ordinance gives the Council final say on collective bargaining agreements for the School Department. He says the purpose of the ordinance is to give the Council the ability to maintain tighter fiscal control.
Attorney Robert Silva, Legal Counsel for the School Department, presents the position of the School Department and urges the City Council not to adopt the ordinance. He says the present law establishes a system of City Councils and School Committees and both elected bodies have different and sometimes contradictory services. He says the School Committee must remain accountable to the voters. He says the School Department wishes to go on record as being opposed to the ordinances and the ordinance would have no binding affect. He says the General Assembly would
have to approve the change and a Charter amendment would be required.
Harold Gerstein, 12 Rhodes Avenue, addresses the Council on the issue and speaks in favor of the ordinance.
Lisa Procter, 1836 Pawtucket Avenue, speaks in favor.
Walter Langlois, Mauran Avenue, speaks in favor
Timothy Duffy, Lloyd Avenue, Providence, Rhode Island, Executive Director of the Rhode Island School Committees, speaks against the ordinance.
Cheryl Gomes, 4 Euclid Avenue, speaks against the ordinance.
Mr. Conley concludes that legislative approval is not needed for the ordinance to take affect.
After further discussion, motion is made by Mr. Larisa, seconded by Mr. Miranda, to adopt the ordinance as written.
Mr. Lynch says he will not go along with this tonight because he feels the Charter draws the line on the functions of the Council and the School Committee.
Mr. Miranda says he does not think it is the function of the City Council to ratify contracts, and speaks on consolidation.
Mr. Sullivan proposes the Council defer the ordinance and hold it pending the outcome of the Rhode Island Supreme Court decision regarding the Providence School Committee.
Mr. Larisa withdraws his motion and seconds the motion by Mr. Sullivan to defer indefinitely the Final Passage until the Supreme Court decision is made.
Mr. Miranda asks the School Committee to drop the law suit against the City regarding the 1994-1995 budget allocation.
Maria Pinheiro, Chairman of the School Committee, addresses the Council and says that has to be the decision of the entire School Committee.

Planning Department

Bruce Beauchamp, Narragansett Improvement Company, addresses the Council on the proposed highway abandonment.
Mayor Grant says he will not vote on the abandonment until the neighbors have a chance to sit down with the petitioners.
Mr. Larisa asks Jeanne Boyle why the City is not considering selling the property to abutting property owners and says he cannot vote on this matter tonight until the Council has up-to-date information. Ms Boyle states that State Law requires abandoned property be deeded over to abutting property owners.
Unanimously voted to defer to the next meeting on a roll-call vote, with all Council members present and voting, on motion by Mr. Larisa, seconded by Mr. Miranda.
Meeting recesses at 11:20 P.M. and reconvenes at 11:30 P.M. with all Council members present.
Hayward Place Sanitary Sewers
(Deferred from October 17, 1995)
Mr. Lemont reports on a proposed system that will alleviate the sewerage problem in the area. He recommends a pump system at a cost no to exceed $65,000. Motion is made by Mr. Larisa, seconded by Mr. Miranda, to authorize an amount not to exceed $65,000. to come from the sale of Surplus Property Account. Motion passes unanimously on a roll-call vote.
Request for Executive Session - Negotiations
Motion is made by Mr. Larisa, seconded by Mr. Sullivan, and voted 5-0 to go into Executive Session at the end of the open meeting to discuss negotiations.
Law Department

RE: Storage of Granite Blocks on State Property
Mr. Conley reports that the State has planted shrubs around the property where the granite blocks have been stored, and says the State wants the City to issue a standard release. He says the City is not prepared to sign releases for the planting of the Austrian pines. Mr. Sullivan suggests the City write another letter to the State requesting the City be given some of the blocks for use in various City projects.

Article III Boards, Committees, Commissions, Division 7 Planning Board, Section 2-166 Created; composition; appointment of members generally; qualifications and compensation of members; Section 2-168 Appointment of first members; term of office; vacancies; removal from office; Section 2-172 Powers and duties of board; Section 2-174 Master plan - Purpose; Section 2-175 Same- preparation; Section 2-176 Same- Adoption; Section 2-177 Same-Construction, etc., of streets, parks, etc., after adoption of plan.
The above-entitled ordinance is introduced and on motion of Mr. Larisa, seconded by Mr. Lynch to approve Sections 2-172,2-174,2-175,2-176, 2-177, and defer Sections 2-166,2-168. Motion passes unanimously on a roll-call vote.
Mr. Conley will have a redraft of the ordinance for first passage at the next Council meeting.

Mr. Schein is not present. Letter will be sent to Mr. Schein advising him the Council has given one more deferral to his request.
Motion is made to go into Executive Session to discuss negotiations by Mr. Larisa, seconded by Mr. Lynch. Motion passes 5-0 on a roll-call vote.
The Open meeting recesses at 11:45 P.M. and goes into Closed Session.
The meeting reconvenes in Open Session at 11:55 P.M. and adjourns at 11:55 P.M.
