CITY COUNCIL MEETING
SPECIAL MEETING
KELLY & PICERNE PROPERTY
Meeting is called to order at 7:40 p.m.
Mr. Conley states that Kelly & Picerne vs. City of East Providence is a case in which Kelly & Picerne is suing the City of East Providence, alleging that they were wrongfully denied the issuance of a building permit in 1989, regarding the Seaview II development. He says the case is pending on the Superior Court trial calendar. He says he advised the Council at the last Claims Committee meeting that extensive negotiations are going on regarding the case and the discussions revolved around the issue of the development of the remaining parcel of the consent judgement.
Also, because of the complexity of the settlement discussions and the amount of issues involved, the Claims Committee directed him to get a special meeting scheduled when this would be the only matter before the Council. Mr. Conley requests a motion under the Open Meetings Law that allows the Council to go into Closed Session to discussion litigation so that he may outline to the Council in detail the settlement proposals that have been made to the City at this time by Kelly & Picerne.
The motion is made by Mr. Sullivan, seconded by Mr. Larisa. Mr. Larisa says he supports the motion to keep the meeting closed, but once the Council is fully apprised by the offer made by Kelly & Picerne, it will be time to have a full public hearing regarding the settlement proposal. He says that after this meeting, he would expect a full public hearing will occur.
