Regular meeting of the City Council was called held on Monday, January 24, 2022 via ZOOM Webinar.

 

The meeting was called to order at 7:00 P.M. by the Council President.

 

Roll call showed the following members present:  Councilwomen Marino, Renzulli, Vargas, Germain, Councilmen Donegan, Campopiano Reilly, Council Vice-President Ferri and Council President Paplauskas -9.

 

Also Present:  Anthony Moretti, Chief of Staff; Christopher Millea, City Solicitor; John Verdecchia, Assistant City Solicitor; Robert Strom, Finance Director; Daniel Parrillo, Director of Personnel; Stephen Angell, City Council Legal Counsel; David Dimaio, City Council Budget Analyst; Tom Lima, host of meeting.

 

On motion by Councilman Reilly, seconded by Council Vice-President Ferri, it was voted to dispense with the reading of the minutes of the November 22, 2021 and December 20, 2021 meetings and they stand approved as recorded.  Motion passed on a vote of 9-0.  The following being recorded as voting “aye”:   Councilwomen Marino, Renzulli, Vargas, Germain, Councilmen Donegan, Campopiano, Reilly, Council Vice-President Ferri and Council President Paplauskas -9.

 

 

I.          PUBLIC ACKNOWLEDGEMENTS AND COMMENDATIONS

II.        PUBLIC HEARINGS & PUBLIC COMMENT 

 

            Annette Bourne, 51 Community Dr., appeared to speak regarding proposed Ordinances 9-21-01 and 9-21-02 and asked City Council what their vision is for Cranston.  Is it a vision that is equitable across all our neighborhoods?  As a Cranston resident for over seventeen years who has been an active parent and engaged in our local efforts to bring improvements to our City’s housing, she is deeply concerned and saddened that we would toss out the efforts put in by our Planning Department and the public remarks that form the Comprehensive Plan and its vision.  She urged the City Council to vote “no” on these Ordinances and maintain the vision of our Comprehensive Plan.

 

            Grace Swinski, 30 Sumner Ave., appeared to speak regarding proposed Ordinances 9-21-01 and 9-21-02 and asked that the Council vote no on these Ordinances.  She stated that in walking the neighborhood, many of the residents are worried about additional traffic.  All the residents she spoke to are in favor of development, but not what the plan is now.  This parcel is the gateway into the City of Cranston and is an area that could be a showcase to the State and show how Cranston took the lead to create affordable housing.  A “no” vote would give the City an opportunity to engage in creative and financial benefit dialogue and to use the best of this land.

 

Kristina Brown, 217 Armington St., appeared to oppose to proposed Ordinances 9-21-01 and 9-21-02 and stated that, as the City Planner stated on page eight of the staff memo, the City is in need of housing and is running out of potential sites to achieve its housing goals.  She believes that this parcel would be better left alone then degrade it further by car-eccentric uses.

 

            John Mancini, Esq., appeared to represent applicant for proposed Ordinances 9-21-01 and 9-21-02.  Council President Paplauskas asked Attorney Mancini to wait and speak when it is appropriate and let the public comment continue.

           

            On motion by Council Vice-President Ferri, seconded by Councilman Reilly, it was voted to take the docket out of order and take Ordinances 9-21-01 and 9-21-02.  Motion passed on a vote of 9-0.  The following being recorded as voting “aye”:   Councilwomen Marino, Renzulli, Vargas, Germain, Councilmen Donegan, Campopiano, Reilly, Council Vice-President Ferri and Council President Paplauskas -9.

 

ORDINANCE COMMITTEE

9-21-01            ORDINANCE IN AMENDMENT OF THE 2010 COMPREHENSIVE PLAN FOR THE CITY OF CRANSTON, AS AMENDED 2012 (777 Cranston St.)

 

            On motion by Councilman Reilly, seconded by Councilwoman Renzulli, it was voted to adopt the above Ordinance.

 

Under Discussion:

 

            John Macini, Esq., appeared to represent applicant for proposed Ordinances 9-21-01 and 9-21-02 and stated that this is one of the steps the applicant has to take in order to obtain major land development.  He stated that the Planning Commission approved the project at its last meeting.  The reason for request to change the Zoning from M-2 to C-5 is because it is more conducive to be conducive with respect to the heavy commercial uses already and exist on Cranston Street, such as gas stations, proposed restaurant, proposed bank and other similar uses that come with C-5 Zone.  He also stated that he understands that affordable housing is very important and there is need for it and, as a counsel for a developer, they do a lot of residential development where it makes sense and unfortunately, this is not a location which makes sense for housing.  This is a parcel that has been dormant for decades and not producing tax revenues and not producing employment.  What is being proposed is revitalize this parcel and revitalize areas around it.  It would provide revenues and jobs.  The traffic report shows that there would be no impact with respect to the traffic on this site. 

 

            Councilman Donegan stated that he feels strongly for the need for economic development in Eastern Cranston, but development should address the needs of our community and he does not believe this project will accomplish that.  It offers opportunity for us to address the housing crisis.  We need more housing in our City. 

 

            Councilman Reilly stated that this lot has sat vacant for decades.  The opportunity has been there for decades and now we have someone that wants to invest money in our City and provide jobs.  He does not see any other proposals or has not seen any other proposals for decades.  It is the gateway to Cranston.  We do not want to see dilapidated lots as people enter the City.  If someone wants to come in and take a chance on Cranston, he says go for it.

 

            Councilwoman Marino stated that there is no question that there is a housing crisis.  It is Statewide and, as a City, we need to do more.  She is just not convinced that this location is the right fit for that.  It is a commercial area.  She is looking at this proposal as it being an improvement to the area and bringing more revenue into the City and she would like to see us take advantage of that.

 

Roll call was taken on motion to adopt the above Ordinance and motion passed on a vote of 8-1.  The following being recorded as voting “aye”: Councilwomen Marino, Renzulli, Vargas, Germain, Councilmen Campopiano, Reilly, Council Vice-President Ferri and Council President Paplauskas -8.  The following being recorded as voting “nay”:  Councilman Donegan -1.

 

9-21-02            ORDINANCE IN AMENDMENT OF CHAPTER 17 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED ‘ZONING’ (Change of Zone – 777 Cranston St.)

 

On motion by Council Vice-President Ferri, seconded by Councilman Reilly, the above Ordinance was adopted on a vote of 8-1.  The following being recorded as voting “aye”: Councilwomen Marino, Renzulli, Vargas, Germain, Councilmen Campopiano, Reilly, Council Vice-President Ferri and Council President Paplauskas -8.  The following being recorded as voting “nay”:  Councilman Donegan -1.

 

12-21-01          ORDINANCE IN AMENDMENT OF CHAPTER 10.12.270 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED ‘MOTOR VEHICLES AND TRAFFIC – ONE-WAY TRAFFIC ON CERTAIN STREETS BETWEEN CERTAIN HOURS’ (Eden Park Dr. northerly from Aqueduct Rd.)

 

            On motion by Councilwoman Renzulli, seconded by Council Vice-President Ferri, the above Ordinance was adopted on a vote of 9-0.  The following being recorded as voting “aye”:   Councilwomen Marino, Renzulli, Vargas, Germain, Councilmen Donegan, Campopiano, Reilly, Council Vice-President Ferri and Council President Paplauskas -9.

 

12-21-02          ORDINANCE IN AMENDMENT OF TITLE 10 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED ‘MOTOR VEHICLES AND TRAFFIC’ (Tabor St.)

 

            Council President Paplauskas asked that this Ordinance be continued for Traffic Report.

 

            On motion by Councilwoman Renzulli, seconded by Councilwoman Vargas, the above Ordinance was continued to next month’s meeting.  Motion passed on a vote of 9-0.  The following being recorded as voting “aye”:   Councilwomen Marino, Renzulli, Vargas, Germain, Councilmen Donegan, Campopiano, Reilly, Council Vice-President Ferri and Council President Paplauskas -9.

 

 

III.       RESOLUTIONS

             

RESOLUTION ‘AMERICAN RESCUE PLAN ACT FUNDS – ENGAGEMENT OF POLLING COMPANY TO SOLICIT AND GAUGE INPUT BY CRANSTON CITIZENS’

 

On motion by Councilman Campopiano, seconded by Councilwoman Renzulli, it was voted to adopt the above Resolution.

 

Under Discussion:

           

Director Moretti stated that this Resolution is a follow-up requesting approval for the use of some of the ARPA funds.  The Mayor is in full support of the Council soliciting as much input as possible from the citizenry.  At a past meeting, it was mentioned that another good way of soliciting input would be a statistical poll to contract a polling agency.  The overall objective to this is to gain timely input from the residents into the ARPA process.

 

Council Vice-President Ferri questioned how we will decide which company will be chosen to do this poll.  Director Moretti stated that this will be done in the form of an RFP to be solicited to the industry.  Council Vice-President Ferri asked how we would chose the questions that would be asked and what would be the means of distribution to the questions. Director Moretti stated that he would hope that we would have the polling agency do that.  Council Vice-President Ferri asked how the questions will be distributed.  Would it be done by telephone or e-mail?  Director Moretti stated that from past interactions with polling organizations, most polling for this is done via landline or cell phone, but he would be happy to leave that to the polling firm.  Council Vice-President Ferri asked what demographic data would be taken to ensure accurate results.  Director Moretti stated that we are looking for an independent firm, knowledgeable and proficient.

 

Council Vice-President Ferri stated that he feels that $25,000 is a little higher than we had anticipated it would be.  He would like to see it lower.  Director Moretti stated that he does not know what the number is going to be.  We do not know what the number is that it is going to come in at.  It may be much less then that.  Director Strom stated that we are doing an RFP and the due date is February 1^st.  Right now, we have six polling companies that we have submitted RFP to.  It has been advertised and it may be a little more.  ARPA funds allow you to use 10% of administrative expenses.  Obviously, that is not something we would consider at 10% for anything.  The $25,000 was just a nominal figure so we would have a dollar figure for the cost for this poll.  It could be $5,000, it could be $10,000 or it could be $15,000.

 

Councilwoman Renzulli stated that she appreciates the Administration bringing this forward and thinks the meetings along with the surveys are great ideas.  She asked to be added as co-sponsor.

 

Councilman Donegan suggested amending the Resolution and changing “citizens” to “residents” in the body of the Resolution.

 

On motion by Councilman Donegan, seconded by Councilwoman Renzulli, it was voted to amend the Resolution to change “citizens” to “residents” in the body of the Resolution.

 

Under Discussion:

 

Councilman Donegan indicated that there are people that stand to benefit from these funds that are not citizens of Cranston by legal definition.

 

Councilwoman Vargas asked if the polling would be done in multiple languages and is that part of the RFP.  Director Moretti stated that we leave that to the Purchasing professionals.  With respect to the polling in multiple languages, we will make sure that it is bi-lingually available to the recipients of the poll.

 

Councilwoman Germain asked Solicitor or Legal Counsel whether this should be done by Ordinance because there is money involved and a Resolution is non-binding.  Attorney Angell stated that it is appropriate in this instance to be followed later by an Ordinance.

 

Councilman Donegan questioned why this is not going to Finance Committee.  Council President Paplauskas stated that after speaking to legal counsel and due to the time limitation, it is being voted on this evening.

 

Motion passed on a vote of 9-0.  The following being recorded as voting “aye”:   Councilwomen Marino, Renzulli, Vargas, Germain, Councilmen Donegan, Campopiano, Reilly, Council Vice-President Ferri and Council President Paplauskas -9.

            Discussion and votes on the above Ordinances were taken at the beginning of the meeting.

 

 

V.        PUBLIC COMMENT FOR UN-DOCKETED ITEMS

 

            Pauline DeRosa, 97 Cypress Dr., appeared to speak and stated that she would like to address the issue of the ARPA Funds.  Council President Paplauskas stated that the Council is holding a workshop meeting regarding this and if she would like to speak this evening, that would be fine, or she can speak at those workshop sessions.  Ms. DeRosa stated that she would like to speak this evening and asked the following questions:

·         What will be the criteria for receiving money from ARPA funding?

·         Who will make the decisions as to what request gets highest priority on the list?

·         Will the City Council be the only public body to oversee the spending of ARPA funds?

·         To avoid improprieties, will there be monitoring in place after the funds have been allotted?

·         Are there parameters on the amount of time in which this money is to be spent?

·         After these public meetings are over and the public polling has been completed, will there be a comprehensive list of those who are slated to receive funds and are the amount of those funds be revealed?

 

She stated that there must be transparent and fair and equitable distribution of the ARPA funds.  Projects must be included to address the homelessness issue and concerns of the elderly population and affordable housing.

ARTS COMMISSION:

VII.     REPORT OF CITY OFFICERS

VIII.    EXECUTIVE COMMUNICATIONS

             

LEGAL EXPENSE ANALYSIS FOR 7/1/2021 – 12/20/2021.

 

            Councilwoman Marino asked if we are caught up for 2021 or are there more bills for 2021 year.  Solicitor Millea stated that there may be two or three very small invoices that are outstanding.

 

            Councilwoman Marino asked when we are anticipating a bill from Yardworks.  Solicitor Millea stated that he can reach out to the attorney on this matter.  Solicitor Verdecchia stated that he has been working on this case and he has not submitted any bills.  He usually waits to the end of a case to submit bills.

 

            Director Strom stated that when we did our Audit, we closed out FY 2021 with all legal expenses and at this point, we are all up to date.

 

REQUEST TO BE PLACED ON PENSION DEPUTY CHIEF LAWRENCE CARON, JR., CRANSTON FIRE DEPARTMENT.

 

            Director Moretti appeared to speak.

IX.       COUNCIL PRESIDENT COMMUNICATIONS  

 

• ARPA CITY COUNCIL WORKSHOP TO BE HELD ON JANUARY 27^th AND FEBRUARY 10^th AT 6 PM.  PUBLIC COMMENT IS WELCOMED AND ENCOURAGED

 

Council President Paplauskas announced that there are two workshop sessions scheduled:  January 27^th, which is still on Zoom and February 10^th will depend on the Governor’s Executive Order.

 

• UPDATE FROM ADMINISTRATION OR LEGAL DEPARTMENT ON OPIOID LITIGATION SETTLEMENT

 

Solicitor Verdecchia stated that he had a discussion with Solicitor Millea about this and there is going to be an announcement tomorrow from the Attorney General’s Office.  He would prefer deferring until tomorrow to see what the Attorney General will announce.

 

Council President Paplauskas asked that the Solicitor keep the Council apprised on this.

 

Councilwoman Marino stated that since there will be a press conference tomorrow regarding this, she asked that this item be added to the Finance Agenda for its next meeting for an update at that time.

 

• UPDATE FROM DIRECTOR STROM REGARDING THE CRANSTON ICE RINK AND ARPA FUNDS

 

Director Strom stated that when we did the budget last year, we put aside $415,000 for the loss of revenue for the Ice Rink with use of ARPA funds and that was approved.  At this time, since March 2020 and going forward, with the Ice Rink shut down, we lost quite a bit of money in revenue and rentals and concession stand.  What he wants to do now is draw from the ARPA Funds from March of 2020 to date in the amount of $214,445.

 

 

X.        COUNCIL MEMBER COMMUNICATIONS

 

COUNCILMAN DONEGAN:

• Proposed Partnership with “Providence Warwick Convention and Visitors Bureau”

 

Director Moretti stated that because we do not have the money budgeted, maybe we can include this to utilize the ARPA Funds.  The Administration does support this and we all would like to see that happen.

 

Councilman Donegan stated that we do not need any funding for this year.  Based on their presentation, the first year would be free and the second year would be $10,000.

 

Director Moretti questioned if we can proceed to draft, review and execute a document like that or do we need City Council approval first.  Solicitor Verdecchia stated that it depends how we draft the document.

 

COUNCILWOMAN GERMAIN:

• Update on the Diversity Commission

 

Director Parrillo stated that the Ordinance was passed April 26, 2021, the Mayor vetoed it May 7, 2021 and the City Council overrode the Mayor’s Veto on May 24, 2021.  First member was not appointed until August 23, 2021 and another appointment was made on September 27^th and last appointment was October 25^th.  There were no members to meet prior to that.  He is waiting for an appointment of a member from OneCranston and hoping to meet in February.

 

COUNCILWOMAN VARGAS:

• West Bay Land Trust – City Tree Program

 

Councilwoman Vargas stated that the West Bay Land Trust wants to promote their Spring campaign on the free trees.  She asked if we can place that on the City Website of the information regarding this to help promote this program.

 

• Friendly Park Update             

 

Councilwoman Vargas stated that she has been receiving phone calls from residents of the Friendly Park Community area on the status of the park.  She indicated to them that we are working on a grant for this.  She asked if Administration has any status update on this.

 

Director Moretti stated that, per Director Tessaglia, everything requested by the Council Grant Writer has been submitted to her.

CLAIMS REFERRED TO CLAIMS COMMITTEE – THURSDAY, FEBRUARY 17, 2022.

• PROPERTY DAMAGE CLAIM:
• STEPHEN QUARTINO FROM ALLEGED INCIDENT ON DECEMBER 17, 2020.
• REBECCA PERENTIN FROM ALLEGED INCIDENT ON NOVEMBER 20, 2021.

 

Council President Paplauskas indicated that the claim for Stephen Quartino was addressed at the beginning of 2021 and is listed on the docket in error.

 

            On motion by Councilwoman Marino, seconded by Councilwoman Germain, it was voted to refer the above new business to the respective Committees.  Motion passed on a vote of 8-0.  The following being recorded as voting “aye”:   Councilwomen Marino, Renzulli, Vargas, Germain, Councilmen Donegan, Campopiano, Council Vice-President Ferri and Council President Paplauskas -8.  Councilman Reilly was not present for roll call vote.
