1.  Roll Call

A meeting of the Central Falls Liquor Board was held on the above date in the City Hall Council Chambers at 8:56 p.m.

Councilman Silva

Councilman Leger

Councilman Patino

Councilman Benson

Councilman Weber

Mayor Moreau was not present.

Quorum present.

Councilman Patino chaired the meeting.

2.  Correspondence

RIGL 3-5-21 "Revocation or suspension of licenses-Fines for violating condition of license. Section (b) fines for first offense $1,000 subsequent offense $2,000. (see revision)

Motion to accept collectively and place on file was made by Councilman Leger and seconded by Councilman Benson.  All Agreed. So Voted.

3.  Hearing

A)        Hacker's Pub

435 Pine St.

Central Falls, R.I. 02863

(open after hours & disorderly house)

Jack Gannon,Esq. was present from the Law Department, and gave details of the summons. After discussion with Mr.  Robert Ameen,esq. and his Attorney, the Law Department recommends $1000.00 fine for being open after hours and for the disorderly house to be filed for one year without a fine with the stipulation that the fine must be paid within 7 days and it can be resurrected if this establishment finds itself in violation in the future assuming the applicant is going to plead guilty being open  after hours if they don’t do that  he suggested that they set a date for trial. 

Robert Ameen, Esq. was present to represent Hackers Pub, Jose Fuentes the principle shareholder was present and plead guilty to the open after hours and a not guilty charge on the disorderly house to be filed for one year.

Motion made by Councilman Weber to accept the plea and $1000.00 which must be paid in 7 days and put the charge of disorderly on file for one year.

Councilman Patino reaffirmed that when a police officer comes to the door they must open the door immediately.  I could put people in danger if they do not do this.

B)        LaTaberna Night Club Inc.

695 Lonsdale Ave.

Central Falls, R.I. 02863

Jack Gannon, Esq. was present, representing the City and explained the charges of operating after hours providing the applicant pleads guilty he was recommending a $1000.00 fine to be consistent with the last one consistent with new state statue. 

Motion by Councilman Leger and Councilman Benson that the fine would be $1000.00 to be paid in seven days to the Clerks office.

All agreed. Motion carries.

C)        Knights of Columbus Sullivan Council 2700

d/b/a Casey Club

20 Claremont St.

Central Falls, RI 02863

(Disorderly house)

Jack Gannon,Esq. stated he would allow the Knights of Columbus to speak on this matter then he would make a recommendation.

Leo Larivee was present and is the President of the Knights of 20 Claremont St.  He apologized to the Council for incident.  When the hall was rented it was supposed to be a going away party.

He did not find out until the night that it was going to be hip hop dance. He was concerned about canceling it because they may file a lawsuit.  First he called the Police to ask for help.  They could not advise him. He chose to close the bar immediately.  The last thing he talked to the officer.  There were over 200 kids.  He would not permit any more kids in.  He did not know of the consequences at the end of the night.  Councilman Weber commended him for shutting down the bar.  He said they did not want this kind of activity in the City.   Next time they should allow the police to close them down.  The girl they rented it to had a brother who was the DJ.  They also said it was a fund raiser for Katrina.  Mr. Larivee stated he now knows what to do.

Police Chief Moran was present and described the events that took place in the City, as a result of the above event in the city.  This caused a deep caused a deep issue and concern for the officers that night. Fighting occurred on Kendall and Moore Streets Pine and Park and Lonsdale Ave, at Burger King, Cumberland came to assist.    Seven people were arrested.  They had to deploy the riot capstun.  They went through 5, also the pepper gun was used.  For an hour and fifteen minutes the city was up in arms.  Some families received some spray.  We have zero tolerance for this kind of issue. 

Patricia Marapese from Moore St. was present and took the stand.  She presented her complaints during this incident.  She complained of the music that is going on until 1:00am.

Constant chaos. 

More discussion took place with the Police Chief.  Chief Moran recommended a larger deposit.

Council President recommended strongly that the Knights shut the music down at 12:00am.

More discussion took place.

He requests that they modify their contracts no hip hop and close at 12:00.  If they don’t agree to this, then the Council will do it.

More discussion on changing hours.    Mr. Larivee agreed to take care of that.

Mr. Gannon, Esq. reviewed the recent events that took place at K of C.

On 6/26/2005 there was a similar situation.  On this event some police were injured.  All should be considerer.  They did take steps to reduce the situation.    The City recommends a $500.00 fine at this time. 

Councilman Leger stated that we were at serious risk; someone needs to be held accountable.  It put the community at risk.

Councilman Weber stated he was in favor of the fine being half of the $500.00.  $250 dollar fine.

Councilman Weber made a motion to impose a $250.00 fine for disorderly house and case to be filed for three years.

Motion carries.

Councilman Patino restated how important it is to keep control of their establishment.

He wants the message to get out.
