Mr. Ed Manning was present to represent the buyer.
Councilman Noury asked when the applicant expected to open the business. Mr. Manning responded about the end of September.
Councilman Noury asked what if any prior experience the applicant has regarding this type of business.
Mr. Manning stated that there would be a Manager.
Motion to approve was made by Councilman Noury and seconded by Councilman Patino.

Susan Perkins, Esq. Present to represent the current owner of Acuarius Nightclub. She asked that the Board grant an extension regarding this license due to problems with the Contractor. She explained in detail the current condition of the building and the proposed renovations to meet the codes.
She stated that it is the intention of the owner to relocate to Rhode Island and to live on the top floor above the business. She stated that the building would be owner run and occupied.
Councilman Noury asked what the status was regarding the legal matter pending before the Superior Court.
Councilman Noury asked Ms. Perkins if the applicant would accept an agreement not to apply for and Entertainment License in the future.
Ms. Perkins responded that not knowing what the future holds for any business to say that the applicant would not apply for such a license somewhere in the future would be unfair.
Councilman Weber asked if the applicant would drop the Superior Court appeal if this extension is granted.
Ms. Perkins stated that this would be agreeable.
Councilman Noury commented that this neighborhood is residential and that there are parking issues.
Ms. Perkins stated that this would be a restaurant and neighborhood pub. She filed the proposed plans for the business with the Clerk.
Motion to approve the extension for this license under the conditions that it be a Restaurant and neighborhood pub and that the applicant drop the appeal in Superior Court. Further, that the $1,000 fee for the 2002/2003 license be paid in full within 30 days or the license will be suspended until paid. Motion made by Councilman Noury and seconded by Councilman Weber.
