A Meeting of the Central Falls Board of License Commissioners (Liquor Board) was held on the above date in the City Hall Council Chambers at 7:00 P.M.

Chairman Robert Ferri presided.
Meeting October 25, 1999
Motion to accept and place on file was made by Councilman Canavan and seconded by Councilman Weber. All Agreed. So Voted.

4. Petition to Revoke and Rescind Class Bv License Transfer
Huckleberry's Pub Inc.

Continued from October 25, 1999 Meeting
Robert Brennan, Esq. Attorney representing Michael Melucci
R. Kevin Horan, Esq. Attorney representing Huckleberry's Pub Inc.
Attorney Brennan gave opening remarks and stated that it is important for the Board to understand the History and the standing of Melucci's and the application to transfer the license. He commented on the issues of standing and asked the Board to take no action and commented on the ability to rescind.
Attorney Horan representing Huckleberry's Pub commented on the mistake in the newspaper relative to who is representing Melucci's and Huckleberry's. He stated
that his brother represented the transfer in April of 1999 from Huckleberry's to Melucci. Michael Horan no longer has any involvement in either Melucci or in
Huckleberry Petitions. He then explained that there is a joint ownership in the Huckleberry Corporation and that on July 3, 1999 Mr. Sherry passed away leaving
Evelyn Sherry the remaining owner in Corporation.
Councilman Noury stated that he is satisfied with Mr. Horan's representation of The Corporation relative to Huckleberry's and asked that a copy of the Corporation papers be filed with the Clerk.
Councilman Canavan stated that he remembers that Mr. Sherry was the owner of Huckleberry's.
Mr. Brennan commented on the City Clerk's files relative to the and commented on 3-5-19 of the State Law he requested that a motion be made to allow Melucci's Cafe Inc. to be given a period of time to meet the requirements.
Councilman Noury questioned Assistant City Solicitor Matthew Oliverio.
Mr. Oliverio stated that there are two issues:
The question of due process.
That the Board granted the License transfer conditionally.
He said that both are compelling arguments. The question is what is the point of conditions if they are not carried out. He stated that the Board acted properly and consistently in granting the license transfer subject to the conditions of both State and Local requirements. Ie: Certificate of Good Standing, Payment of any outstanding bills to Liquor Dealers is required by the State; Payment of any unpaid City taxes, and a Certificate of Occupancy etc.
Councilman Canavan motioned to clarify that Huckleberry's is the License holder of a Class Bv License located at 500-502 Roosevelt Avenue, Central Falls, Rhode Island. Motion seconded by Councilman Weber.

Motion carried 4 yes 0 no 1 absent.
Motion to summons before the Board the Establishments named in a correspondence from the Police Department for serving underage persons was made by Councilman Weber and seconded by Councilman Canavan. All Agreed. So Voted. To be summoned at the next regular scheduled Liquor Board Meeting.
