REGULAR LIQUOR BOARD MEETING
MONDAY, AUGUST 26, 1991
A Regular Meeting of the Central Falls Liquor Board was held in the City Hall Council Chambers at 11:15 P.M.

Quorum Present.
Chairwoman Sandra Moreau presided.
Motion was made by Councilman Brousseau and seconded by Councilman Charbonneau to accept and place on file the minutes to the previous meetings.

McLaughlin & Moran re: Objection to transfer Hackers Pub for debt due them in the amount of $1,760.45.
Wayne Distributing Co. re: Objection to transfer Hackers Pub for debt due them in the amount of $645.15.

Motion to accept collectively and place on file was made by Councilman Charbonneau and seconded by Councilman Brouseesu.

Motion to defer was made by Councilman Laroche and seconded by Councilman Brousseau.

Hacker's Pub Inc. d/b/a Hackers Pub at 435 Pine St. Central Falls to Fubar Ltd. d/b/a Fubar at 435 Pine St. Central Falls.
The following Attornies introduced themselves to the Board.
John Gannon, Esq. Receiver & Petitioner of Hackers Pub.
Mary Theall, Esq. representing the minority stockholders, Jean Lavoie and Harry Miller.
Mark Kreiger, Esq. Co-Administrator for the Estate of Robert Lorette, the majority stockholder, deceased.
Gerald Laliberte, Esq. Attorney representing the estate of Robert Lorette.
Marty Marran, Esq. representing the transferees Fubar Inc.
Councilman Laroche asked City Solicitor Muksian to explain the purpose of receivership in terms of transferring this license.
City Solicitor explained.
Attorney Theall asked that the Board defer action on this transfer pending court request for a stay.
Attorney Laliberte objected to a delay stating that the minority stockholders have been before the courts three times asking for this stay and have been denied the stay all three times.
Attorney Laliberte submitted a certificate of order by the judge hearing this matter.
Attorney Theall stated that if the Liquor Board delayed their decision pending a hearing on Friday Aug. 30, 1991 no one will be hurt by their decision.
Attorney Marran stated that the judge has made several decisions in the matter and he felt there was no need for further delay for transfer of this license.
Councilman Laroche commented.
City Solicitor Muksian asked Attorney Theall what the basis for a delay in transfer. He further commented that the action of the minority stockholders was a private matter where the City is concerned.
Councilman Brousseau asked who was currently running the establishment.
Attorney Gannon replied that he as the receiver is running the establishment with employees who are currently the transferees.
Attorney Marran then introduced the transferees and stated that they are working hard to clean the image of the cafe and improve its physical appearance.
Councilman Laroche questioned the transferees on the fence around the property, the parking and of patrons leaving the premises.
Mr. Barzykowski of 57 Knight St. commented on patrons leaving the cafe and leaving empty beer bottles on his property, which is directly across the street from the cafe.
Attorney Marran lained the procedures that is clients were taking to rectify the problems in the past. He stated that the clients have an appointment with Chief Sasso and that bottle beer is not sold in the cafe.
Receiver Gannon asked for a list of creditors against the transfer and stated that in a receivership the creditors should not hold up the transfer and he as the receiver will take care of the outstanding debts as ordered by the court.
City Solicitor Muksian agreed with Attorney Gannon.
Councilman Laroche stated that he would not want the new owners to post signs with the Fubar name listed on it and suggested that they use another name.
Attorney Marran commented that Fubar is the corporate name but that his clients would be using Hackers Pub as their d/b/a.
Motion to allow the transfer was made by Councilman Laroche and seconded by Councilman Vaudreuil.

G.A.M. Corp. d/b/a The Sportsman 55 Sheridan St.
Councilwoman Moreau asked City Solicitor Muksian to commented on the status of the G.A.M. Corp.
City Solicitor Muksian commented and recommended that the Board summons the license holder for the next meeting pending the availability of witnesses.
Motion to summons G.A.M. Corp. for Sept. 9, 1991 was made by Councilman Laroche and seconded by Councilman Vaudreuil.
