Pursuant to Governor Gina M. Raimondo’s Executive Order 20-25 (April 15, 2020),

extended by Executive Orders 20-53 (July 10, 2020) and 20-63 (August 7, 2020),

Minutes

 

Council President Rivera called the meeting to order at 6:04pm

 

I.       Roll Call Video Icon

Sonia Grace, City Clerk, conducted the roll call. Present were Council President Maria Rivera, Councilman Jonathon Acosta, Councilman Robert Ferri, Councilman Hugo Figueroa, Councilman Franklin Solano, Councilman Gus Silva, and Councilwoman Jessica Vega. Quorum was present.

A.     August 17, 2020

Motion to approve the meeting minutes was made by Councilman Ferri, seconded by Councilman Acosta. Motion carried unanimously.

 

B.     September 14, 2020

Motion to approve the minutes was made by Councilman Ferri, seconded by Councilwoman Vega. Motion carried unanimously.

Motion to approve the petition for license was made by Councilwoman Vega, Councilman Solano, and Councilman Silva, seconded by Councilman Acosta and Councilman Ferri. Motion carried unanimously.

 

                                    ii.      Advertised hearing and consideration of petition for transfer of Alcoholic Beverage Class B (Victualling) license from Donat Pitche D/B/A Sam’s CC, 636 Lonsdale Ave., Central Falls, RI to El Caballo Mayor, Inc. D/B/A El Caballo Mayor

Eufrosina Pacheco spoke on behalf of the applicants, Sonny Polanco and Pedro Figueroa, also present.

Motion to approve the petition for license was made by Councilman Solano and Councilman Silva, seconded by Councilman Acosta. Motion carried unanimously.

 

B.     Hearing and/or Consideration of Claims

                                      i.      Executive Session pursuant to R.I.G.L § 42-46-5 (a)(2), pertaining to litigation or work sessions pertaining to litigation

 

                                    ii.      Claim by Luis O. Algarin of 108 Bagley St., Central Falls for alleged damages to personal property sustained on August 4, 2020 (pothole claim).

Matthew Jerzyk, City Solicitor, explained that the incident happened on property owned by the State of RI and the claim should be referred to the state claims office.

Motion to deny the claim was made by Councilman Ferri, seconded by Councilman Solano. Motion carried unanimously.

 

                                  iii.      Claim by Jaston Robinson, of 81 Central Ave. Central Falls, for alleged damages to personal property sustained on September 11, 2020

                        Mr. Jaston was present and answered questions from the Council.

Mr. Jerzyk spoke about the work of the city’s Department of Public Works and the location of the pothole.

Motion to table the consideration of the claim until October 26, 2020 to allow Mr. Jaston to file a police report was made by Councilman Acosta, seconded by Councilman Ferri. Motion carried unanimously.

E.     Ordinance Creating the Racial Justice & Equity in Central Falls Ordinance by amending Chapter 2 “Administration,” and Chapter 22 “Law Enforcement”- Second Reading (Rivera, Acosta, Solano, Vega)

Attorney Jerzyk reviewed the amendments proposed as a Sub-A.

Motion to approve the Sub-A was made by Councilman Silva, seconded by Councilman Solano.

Motion to amend the Sub-A to change the deadline to the report from 3 months to 6 months was made by Councilman Acosta, seconded by Councilman Ferri, Councilman Solano and Councilman Silva. Roll call vote: Councilman Acosta: yes; Councilman Ferri: yes; Councilman Figueroa: yes; Councilman Silva: yes; Councilman Solano: yes; Councilwoman Vega: yes; Council President Rivera: yes. Motion carried unanimously.

Motion to approve the ordinance as amended as made by Councilman Acosta, seconded by Councilman Silva. Roll call vote: Councilman Acosta: yes; Councilman Ferri: yes; Councilman Figueroa: yes; Councilman Silva: yes; Councilman Solano: yes; Councilwoman Vega: yes; Council President Rivera: yes. Motion carried unanimously.

 

F.      Ordinance amending Appendix A, Zoning of the Code of Ordinance Article X, Definitions by (a) deleting the numbering of the definitions and arranging in alphabetical order and (b) adding the definition for Formula Business; Article IX , Administration, Enforcement and Relief by adding subsection: Special use permit for a Formula Business; Amending Section 304, Table 1, Use Regulations by adding to 5.0 Trade Use Number 59 – Formula Business (Rivera)- Second Reading

Motion to approve the ordinance was made by Councilman Silva, seconded by Councilman Ferri and Councilman Solano. Roll call vote: Councilman Acosta: yes; Councilman Ferri: yes; Councilman Figueroa: yes; Councilman Silva: yes; Councilman Solano: yes; Councilwoman Vega: yes; Council President Rivera: yes. Motion carried unanimously.
