Minutes
I. Roll Call
Sonia Grace, City Clerk, conducted the roll call. Present were Councilman Robert Ferri, Councilman Jonathon Acosta, Councilman Hugo Figueroa, Councilwoman Maria Rivera. Councilwoman Carlene Fonseca, Councilman Thomas Lazieh and Councilman Franklin Solano were absent. Quorum was present.
II. Pledge of Allegiance
Council President lead the reciting of the pledge of allegiance.
Councilman Lazieh entered the meeting at 6:03pm
III. Public Comment
Jonathon Acosta, 535 Roosevelt Ave.- spoke about the ordinance being introduced at tonight’s meeting regarding the budget development process. Mr. Acosta explained the purpose of the ordinance.
Lorraine Savard, 78 Emmett St.- proposed that the city place the large recycling bins in the park to increase the recycling rates in the city;
Thomas Lazieh- objected to the last two council meetings.
IV. Approval of Records-Meeting minutes
Motion to table consideration of the meeting minutes was made by Councilman Lazieh. Motion was not seconded. Motion died.
Motion to amend the minutes of April 9, 2018 to reflect the correct vote count on page 2 was made by Councilman Acosta, seconded by Councilman Figueroa. Motion carried 4-1.

Motion to amend the meeting minutes of May 21, 2018 to correctly mark Councilman Figueroa as present was made by Councilwoman Rivera, seconded by Councilman Acosta. Motion carried 4-1.

A. Ordinance Amending Chapter 14, “Courts,” Article II “Municipal Court,” Division I “Generally”- First Reading (Ferri)
Public Hearing: no one spoke at public hearing
Matthew Jerzyk, explained the ordinance and the proposed revisions.
Motion to approve the ordinance was made by Councilwoman Rivera, seconded by Councilman Figueroa. Roll call vote: Councilman Ferri: yes; Councilman Acosta: yes; Councilman Figueroa: yes; Councilman Lazieh: yes; Councilwoman Rivera: yes. Motion carried 5-0.
B. Ordinance Amending Chapter 8, “Animals,” Article V “Dogs,” Division I “Generally”-First Reading (Rivera)

City Solicitor Jerzyk answered questions from the Council to explain the changes to the ordinance.
Motion to approve the ordinance was made by Councilman Figueroa, seconded by Councilwoman Rivera. Roll call vote: Councilman Ferri: yes; Councilman Acosta: yes; Councilman Figueroa: yes; Councilman Lazieh: yes; Councilwoman Rivera: yes. Motion carried 5-0.
C. Ordinance Creating the Central Falls Participatory Budgeting Committee- Introduction (Acosta)

D. Resolution supporting H8242 (Messier) and H8245 (Messier) and their Senate counterparts, acts relating to the Re-opening of Memorial Hospital’s Emergency Room (Ferri)
Motion t0 approve the resolution was made by Councilman Acosta, seconded by Councilwoman Rivera. Motion carried 5-0.
E. Resolution Supporting H8177 (Maldonado), S2854 (Crowley), H8019 (Maldonado) and S2369 (Crowley)- acts relating to taxation (Ferri)
Mr. Bob Battey, Tax Assessor, spoke on behalf of the resolution and reviewed the proposed legislation.
City Solicitor Jerzyk answered questions regarding the ordinance.
Motion to approve the ordinance was made by Councilman Acosta, seconded by Councilman Figueroa. Roll call vote: Councilman Ferri: yes; Councilman Acosta: yes; Councilman Figueroa: yes; Councilman Lazieh: yes; Councilwoman Rivera: yes. Motion carried 5-0.

Motion to approve the resolution was made by Councilwoman Rivera, seconded by Councilman Acosta. Motion carried 5-0.

Major Daniel Barzykowski of the Central Falls Police Department spoke in support of the application. Motion to approve the application was made by Councilman Acosta and Councilwoman Rivera. Motion carried 5-0.
Councilman Ferri spoke on behalf of the Madeira Club and recused from voting. Motion to approve collectively the applications was made by Councilman Lazieh, seconded by Councilwoman Rivera. Roll call: Councilman Ferri: recused; Councilman Acosta: yes; Councilman Figueroa: yes; Councilman Lazieh: yes; Councilwoman Rivera: yes. Motion carried 4-0.

Mr. Edwin Villafana was present to speak on his behalf
Matthew Jerzyk, City Solicitor, read the police department, explained the charges being made against the business and the license holder and reviewed the ordinance pertaining to sale of tobacco products.
Motion to enter the police report was made by Councilwoman Rivera, seconded by Councilman Lazieh. Police report 18-437-OF was entered into the record.
Mr. Villafana answered questions from the council about the incidents described in the police report, the sales of cigarettes in this store, his application for license.
Major Dan Barzykowski spoke about the inspections of the police department.
Motion to fine the license holder was made by Councilwoman Rivera, seconded by Councilman Acosta.
Roll call vote: Councilman Ferri: yes; Councilman Acosta: yes; Councilman Figueroa: no; Councilman Lazieh: no; Councilwoman Rivera: yes. Motion carried 3-2.

Misty Adams, performance manager for Family Dollar, spoke on behalf of Family Dollar. Ms. Adams explained that the employees who were named on the police report were terminated as a result of this incident.
Councilman Acosta made a motion to impose a first-offense fine of $250. Motion was seconded by Councilman Figueroa. Roll call vote: Councilman Ferri: yes; Councilman Acosta: yes; Councilman Figueroa: yes; Councilman Lazieh: yes; Councilwoman Rivera: yes. Motion carried 5-0.

Motion to come out of executive session was made by Councilman Acosta, seconded by Councilman Figueroa and Councilman Lazieh. Motion carried 5-0.
ii. Frank Rodriguez, of 160 Illinois, Central Falls, for alleged damages to personal property sustained on April 16, 2018 (tabled May 14, 2018)
Motion to approve, pending the following condition that the city solicitor speak with Mr. Rodriguez and he agrees to submit the claim to his insurance company and that the city agrees to pay the deductible his insurance company forces him to pay, and if he does not agree to do that, the matter will be continued, was made by Councilwoman Rivera, seconded by Councilman Figueroa. Motion carried 5-0.
iii. Peter Blanding, of 80 Fisher Rd, Cumberland, RI for alleged damages to personal property on May 11, 2018
Motion to approve the claim subject to claimant filing a police report was made by Councilwoman Rivera, seconded by Councilman Acosta. Motion carried 5-0.
E. Presentation by Department of Planning and Economic Development and Department of Parks & Recreation and Community Service on efforts to improve the city’s fields
Motion to table the presentation was made by Councilman Lazieh, seconded by Councilman Acosta. Motion carried 5-0.
F. Hearing and consideration of renewal of lease agreement between City of Central Falls and Fuerza Laboral.
Motion to approve the agreement was made by Councilman Figueroa, seconded by Councilman Acosta. Motion carried 5-0.
VIII. Good & Welfare
Councilman Ferri: announced that the next council meetings will be on June 25, 2018 and July 23, 2018. The July 9, 2018 meeting will be cancelled.
Councilman Lazieh: objected to the budget meetings
