Minutes

 

City Council President Ferri called the meeting to order 5:35pm.

 

I.       Roll Call

Sonia Grace, City Clerk, conducted the roll call. Present were Councilman Robert Ferri, Councilman Jonathon Acosta, Councilman Hugo Figueroa, Councilwoman Maria Rivera, and Councilman Franklin Solano. Councilwoman Carlene Fonseca and Councilman Thomas Lazieh were absent.

 

II.     Pledge of Allegiance

Council President Ferri led he reciting of the pledge of allegiance.

 

III.    City Council Sitting as Board of License Commissioners

 

a.   Hearing, Consideration and Possible Action regarding the following license and license holders

Lt. Christopher Reed of the Central Falls Police Department was sworn-in by City Solicitor Matthew Jerzyk.

Lt. Reed provided testimony to the events that occurred on October 12, 2017, events in past dates and provided 4 exhibits that were entered into the record:

Exhibit 1: arrest report from 10/12/2017; Exhibit 2: incident report of the Central Falls Police Department (CFPD) provided to the Nuisance Task Force; Exhibit 3: Central Falls Fire Department rescue run report; Exhibit 4: redacted arrest records of Mr. & Mrs. Lopez/

Councilors asked questions of Lt. Reed related to his sworn testimony

Attorney Robert Craven, entered his appearance as legal counsel to Mrs. Katelyn Gibeault-Lopez.

Mrs. Gibeault-Lopez was sworn-in by City Solicitor Matthew Jerzyk.

Mr. Craven asked questions of Mrs. Gibeault-Lopez related to the testimony and evidence provided by Lt. Reed. Mrs. Gibeault-Lopez also answered questions from the Council.

Mr. Jerzyk reviewed the Council’s authority and answered questions about possible action.

 

Councilwoman Rivera left the meeting at 6:28pm and returned at 6:32pm.

 

Councilwoman Rivera moved that 1) the City Council refer and recommend that the RI Department of Health investigate Sister’s Salon for operating without required license and not having the presence of a required licensee  on at least four occasions; 2) that Chapter 4 of the Central Falls Code of Ordinances be administered  and enforced by the director of public safety in regards to the serving and/or selling of alcohol with the presence of a license in regards to the execution of a search warrant for controlled substances and in regards to the three rescue runs and 3) invite Jean Realty, LLC located at 184 Atlantic Ave, Providence, RI and Ms. Katelyn Gibeault-Lopez to be served noticed that they are in violation of the Chronic Nuisance Ordinance, thereafter having 30 days to reach a corrective action agreement with the director of public safety and/or be fined $500 per day, each day that they are in violation of not reaching a corrective action plan; and 4) pursuant to section F of the Chronic Nuisance Ordinance, the Council requests that the public safety director issue a one-time of $500 for violating Chapter 4 of the Central Falls code or ordinances. Motion was seconded by Councilman Solano.

 

Roll call vote: Councilman Ferri: yes; Councilman Acosta: yes; Councilman Figueroa: yes; Councilwoman Rivera: yes; Councilman Solano: yes. Motion carried unanimously.

 

IV.    Adjournment

Motion to adjourn was made by Councilwoman Rivera, seconded by Councilman Acosta. Meeting adjourned at 6:42pm.
