SPECIAL CITY COUNCIL MEETING

A special City Council meeting was held on the above date in the City Hall Council Chambers at 7:00pm.

Council President Noury presided in leading the Pledge of Allegiance.
Two Resolutions were read with unanimous consent
A. Resolution extending Condolences of the Central Falls City Council to the Family of the late Louis S. Hathaway (At the request of Councilman Lazieh)
B. Resolution extending Condolences of the Central Falls City Council to the Family of the late Veronica Rose Dyl (At the request of Councilman Lazieh)
1. An Ordinance Amending the Budget Ordinance 1999-2000, Establishing the Classes of Positions, the Maximum Number of Employees and the Number of Employees in Certain classes in the City Departments, as amended, Section 13 (Introduced by Councilman Robichaud)
So introduced.
2. An Ordinance requiring all contracts or awards of bids for the privatization of any public or municipal service for the duration of more than eleven months and in an amount in excess of five thousand ($5000) dollars, to be presented to the Central falls Finance Committee for review and then considered by the Central Falls City Council within thirty (30) days for a vote of confirmation and financial authorization of funds. (Authored and introduced by Councilman Lazieh)
Motion to approve by Councilman Lazieh, seconded by Councilman Leger. All agreed. So voted.
Councilman Noury questioned the city solicitor about a concern he had about the properness of the assistant city solicitor giving legal advice to Councilman Robichaud while he is representing the administration on the issue of privatization. He also asked the legal department to find any and all ways to stop the movement of privatization and to report back to the council the following Monday.
Councilman Lazieh said the it was his understanding that because the privatization contract was in excess of five thousand ($5000) dollars it should be presented before the Review Commission and as of that time it had not been. Also, it is inappropriate for the mayor to enter into a contract that is longer than this fiscal year unless it goes before the City Council because the City Council has to appropriate funds for the next year. He asked the City Solicitor to speak to the Mayor to ask him not to take any formal action that could result in having legal consequences for the City. He requested that the Public Works Director be asked to attend the next council meeting because of the effects that privatization would have on that department.
Mr. Briden asked Councilman Lazieh to clarify his request of him.
Council president Noury requested that the legal department find any and all ways to stop the movement of privatization.
Councilman Robichaud asked if it was legal for them to pass that ordinance tonight and go against what the judge said.
Mr. Briden said that he would have to look at the Order from the judge.
Councilman Lazieh wished the City Clerk a speedy recovery from her operation and also wished former Councilwoman Moreau the best in health as she was home recuperating.
Councilman Noury reminded everyone to vote in the Democratic Primary the following day.
Motion to adjourn by Councilman Lazieh, seconded by Councilman Leger. All agreed. So voted. Time 7:40.
