AN ORDINANCE AMENDING THE ANNUAL OPERATING BUDGET ORDINANCE - GENERAL FUND FOR FISCAL YEAR 1999-2000.

An Ordinance requiring all unanticipated or unbudgeted revenues received by the City in its fiscal year must be reported to the City Council and used solely for debt, bond or note reduction or must be credited to the unencumbered fund account balance. At the introduction of Councilman Lazieh.

Discussion took place on the Ordinance of unanticipated revenues.
Councilman Lazieh explained his ordinance.
James Briden questioned Councilman Lazieh on how he must do the research.
Councilman Robichaud asked about the unencumbered fund account balance.
Councilman Lazieh spoke about the audit. The audit was suppose to be done on December 31.
Councilman Noury spoke on Capital Improvement.
b) An Ordinance requiring all funds not encumbered by June 30th, in the fiscal year appropriated from the municipal budget must be returned to the general fund unless reappropriated by the City Council. At the introduction of Councilman Lazieh,

DIRECTING THE MAYOR NOT TO IMPLEMENT ANY CONTRACT OR ALLOW THE AUTHORIZATION OF ANY FUND FOR THE PAYMENT TO N.E.E.D.
Councilman Lazieh read his Resolution on not signing the N.E.E.D. contract.
Councilman Lazieh spoke on 4-902 of the Charter. Also, sections 4-400 and 4-405.
Motion made by Councilman Lazieh and seconded by Councilwoman Canavan to amend.
James Briden spoke on section 4-405 of the Charter. (Division of Collection and Disbursements.)
Councilman Lazieh said to see if they are in support of this action.
Councilman Robichaud said he did not feel that they should be in support.
Councilman Lazieh stated that he is not convinced that it is cost effective.
Councilman Noury agreed that there is no savings involved.
Councilman Robichaud said he is not in favor of the Resolution.
Councilwoman Canavan said that the Mayor has approval from court and she asked to amend the Resolution by deleting the last sentence of the Resolution.
Councilman Robichaud does not agree.
Approved as amended by a 4-1 vote.

It was agreed that the whole council must sign Resolutions.

Councilman Lazieh said that he could not vote on this without the following information:
Doctor's opinion, Medical Reports, Recommendation of Chief, Copy of letter, Letter from the Officer.
Councilman Robichaud said that he spoke with the retirees.
Councilwoman Canavan asked if there would be a vote taken on this.
Councilman Lazieh said that he did not have a problem with the retirement, but with the process.
Councilman Lazieh stated that the salary of the physician has not been replaced.
Councilman Robichaud said that the back specialist knows best.
Councilman Lazieh was not happy that the disability papers were not submitted from the administration. The Council is requesting a recommendation letter from the Mayor, Personnel, and the Police Chief/Fire Chief. He also requested a letter be sent to the Personnel Department stating this fact for the future. It was stated that Patrolman Thomas Levine would be retiring on the 66 2/3 pension for disability.
Motion to approve disability pension for Mr. Levine by Councilman Robichaud and seconded by Councilwoman Canavan.

This was not an Executive Session.
It was discussed that the state now has given the authority to appoint the Tree Warden to the Mayor.
The Council requested to send a notice to the Mayor's office on this issue.
Motion to re-appoint a city physician by Councilman Lazieh and seconded by Councilman Leger.
All Agreed, So Voted.
Issues on concern of KB Motors, on Hunt St., were discussed. James Briden will research and notify owner to appear.
Meeting was adjourned at 10:10 p.m. So Voted, All Agreed.
