A Regular meeting of the Central Falls City Council was held on the above date in the City Hall Council Chambers at 7:12 p.m.

Council President Robert Canavan presided and led the assembly in the pledge of allegiance.

Mr. John Duffin was present to explain his correspondence to the Council and asked for their instruction to proceed.
Motion to refer abandonment to the Legal Department and the City Clerk's Office for further proceedings was made by Councilman Ferri and seconded by Councilwoman Moreau.

Retirements of Captain Joseph Costa, Sgt. Dennis Gillis and Patrolman Ronald Laflamme
Motion to approve collectively the recommendations of the Pension Board for the retirement of the above mentioned Officers was made by Councilwoman Moreau and Councilman Ferri.
Councilman Ferri congratulated the Officers for their 20 years of service to the City.
His comments were echoed by all members of the Council.

Blackstone Valley Tourism Council

Bed & Breakfast Canal Boat
The License was explained by the Community Development Director, Leo Leclerc who presented the City Council with activities by the Tourism Council to promote the City as well as the Blackstone Valley. He related the many way in which funds would be raised to pay for the cost of the riverboat and the many activities that would become part of the 2000 Celebration which is supported by the Tourism Council along with the City of Central Falls. He explained the ways in which the other Communities are sharing in a spirit of co-operation the many events of the City. He asked the Council to support and approve a Resolution in Support of the Jubilee 2000 Event in Jenks Park.
Without objection the Council acted on this Resolution.

Rick Aubin updated the general public about the cub scout events, a future camping trip and the success of the Car Wash. He also spoke on the condition of the Macomber Field, which he expressed as a dust bowl which was the general comments from some persons attending a game at the field and the fact that the score board does not work properly.
Councilman Ferri questioned the infield and stated that he plays on the field weekly and that a Mr. Frank Reilly volunteers many hours to keep the field in good shape.
Councilman Weber arrived at 8:20 p.m. apologized for being late and gave an update on the All Star Tournament and the Little League District Trials.
Emmanuel Zaharaky

The City Clerk read the summons as requested by the Council.
Mr. Zaharaky was present.
Council President Canavan spoke of the incident that took place at the Car Show last year, he told Mr. Zaharaky that in addition to this incident, he continually violates the law by parking in areas that are prohibited, parking alongside other vehicles and in yellow marked areas.
Mr. Zaharaky stated how hard it is to drive in the City and to do this type of business.
Discussion ensued between the Council President and Mr. Zaharaky.
Council President Canavan repeatedly told Mr. Zaharaky that he cannot continue to break the law. He asked Mr. Zaharaky that after he was told not to operate his business pending this hearing did he continue to do business.
Mr. Zaharaky stated that he did because he had to feed his family and pay the rent etc.
Council President Canavan stated that there is no excuse for continuing to violate the law. He stated that every year the City has had to call him in for some infraction. Council President Canavan related that the City has little or no problem with other ice cream vendors and that Mr. Zaharaky leave very little room to cut him some slack when he continues to violate the law.
Councilman Ferri suggested that Mr. Zaharaky be given a twelve day suspension for operating the twelve days without a license and that his license be given for a period of July 24th to Sept. 6th and if there are any problems at all in that time frame his license will be pulled.
Councilman Weber stated that Mr. Zaharaky has willfully disobeyed the law not only in the car show incident but also at other events in the past.
Mr. Zaharaky stated that he was ill and had to eat during the car show and that is why he could not move his truck.
Council President Canavan asked the Clerk to read the Police Report that was submitted by Mr. Zaharaky.
Councilman Ferri made his suggestion in the form of a motion. No second.
Councilman Weber motioned to deny.
Council President Canavan turned the chair to President Pro Temp Weber in order to second the motion.
Councilman Canavan stated that Mr. Zaharaky violates the law over and over again and that it is difficult to compromise any other situation that to deny the renewal of this license.
Councilwoman Moreau stated that the City Council has given Mr. Zaharaky a privilege in the issuance of this license but that this licensee has continually violated the rules that apply to this license. She stated that there will be other vendors who will abide the rules or they will also loose their privilege to operate in Central Falls.
Councilman Ferri stated that he agrees with all that is said but he again asked the Council to consider his suggestion.
President Pro Temp Weber asked Councilman Ferri if he was making a motion to amend the previous motion.
Councilman Ferri stated that he was.
President Pro Temp Weber asked if there is a second. No response. He asked a second time if there was a second. No response. For a third and final time he asked for a second. No response. Motion dies.

Motion to deny the renewal of Mr. Zaharaky's Peddler license carried 3 yes 1 no 1 absent.
Council President Canavan asked that this be place on the next meeting since there is no written documents clarifying what this is and the Mayor is not present to explain this Ordinance.
A Resolution In support of Jubilee 2000 at Jenks Park.
Acted upon earlier in the Meeting.
Mayor Matthews arrived at the Meeting and asked the Council President to address the Council.
The Mayor asked the Council to consider the retirement of Lt. Robert Peltier pending the approval of the Board of Pension and Retirement.
Councilman Weber was reluctant to anticipate the Board's approve.
The Mayor explained that this is a straight retirement and that Lt. Peltier is a Twenty Year Member of the Police Department. This retirement is qualified at twenty-years of service.
Council President Canavan stated that he had no problem considering this Correspondence relative to the Retirement.
Motion to approve the Retirement of Lt. Robert Peltier pending the decision of the Board of Pensions and Retirement was made by Councilman Ferri and seconded by Councilwoman Moreau.

The Mayor thanked the Council for their consideration to this Retirement.
Mayor Matthews asked the Council to reconsider the Introduction of the Ordinance enacting a Job Creation Incentive Program in the City of Central Falls.
The Mayor explained the this is in response to a Resolution passed by the Council supporting legislation for this program. He stated that this is over and above the Enterprise Zone. This incentive has to create new jobs.
Council President Canavan stated since the Mayor has explained the Ordinance he has no problem with the Introduction of this Ordinance. So Introduced.
Motion to adjourn was made by Councilman Weber and seconded by Councilwoman Moreau. All Agreed. So Voted. Time 9:19 p.m.
