A Regular Meeting of the Central Falls City Council was held on the above date in the City Hall Council Chambers at 7:16 P.M.

Council President Robert Canavan presided.
Council President Canavan led the assembly in the Pledge of Allegiance.

Zoning Ordinance
William Siemers, Director of Planning reviewed minutes of last two meetings he noted 4 proposed changes that are not acceptable to the Zoning or Planning Plans of the City.
Councilman Matthews commented.
William Siemers commented that page 16 is a printing error.
Council President Canavan commented.
Councilwoman Moreau remarked on the M-2 zone for Liberty Street and stipulated that she wanted this area zoned M-2. She also commented on a letter she received from the Community Counseling Center.
Councilman Matthews stated that he wanted the end of Walnut St. to be zoned M-2.
Council President Canavan opened the meeting to the public.
Maurice Dauray commented on his property on Walnut St. and stated that he wanted this to be zoned M-2.
City Clerk Issa read a correspondence from City Solicitor George Muksian regarding the siting of the Resource Recovery Facility in the City of Central Falls.
William Siemers responded to the zone change requests.
Motion was made by Councilman Matthews to withdraw and act on sections 601-601.11 from Ordinance to later in the meeting. This section is related to Historic District Zoning. Motion seconded by Councilman Ferri and Councilwoman Moreau.

Motion to amend section 514.2 page 39 entitled Home Occupation was made by Councilman Matthews and seconded by Councilwoman Moreau to read as follows:
A) It is conducted entirely within a dwelling;
B) Such use is situated in the same dwelling as the primary residence of the occupant;
C) The residential character of such dwelling is not changed;
D) There shall be not more than one worker in addition to the dwelling unit occupant;
E) No more than 50% of the gross floor area of the dwelling unit or 800 sq. ft. whichever is less, shall be used for the home occupation;
F) There shall be no storage or sale of good or merchandise on the premises.

Councilman Matthews commented on Historic District Zoning.
Council President Canavan commented on Historic District Zoning as printed, with Council reviewing it after one year. He stated that the Council could pass it at this meeting and if problems arise the residents affected could contact the Council members or Housing Director.
Motion to amend Historic District Zoning to read subject to Council Review after one year was made by Councilwoman Moreau and seconded by Councilman Paquette.

Mr. Motyka related to the Council that he does little walk in orders and that his business is primarily mail order.
Councilman Matthews questioned the City Solicitor George Muksian on the need for this business to have a general merchandise license.
City Clerk Issa commented to the Council and City Solicitor.
Council President Canavan commented to the applicant.
City Solicitor Muksian stated that for the type of business the applicant is doing he feels that there is no need for this license.
The City Council decided that this applicant did not need this license.

Enrique Baptista d/b/a Rincon Dominicano
Mr. Batista addressed the City Council through an interpreter regarding the revocation of his restaurant license.
Council President Canavan questioned Mr. Batista. He asked if Mr. Baptista sold the business to another person.
Mr. Batista responded that he did not sell the business.
Council President Canavan asked Mr. Baptista how often he was at the business.
Mr. Baptista responded that he was at the business from 8:00 a.m to 11:00 p.m. daily.
Council President Canavan related previous testimony shows that Mr. Baptista was on the premises of the business for a period of 5 to 10 minutes once or twice a week.
Councilman Paquette questioned Mr. Baptista relative to a conversation with Police Chief Sasso.
Councilwoman Moreau asked Mr. Baptista if he knows why the license was revoked.
Mr. Baptista stated that he did know.
City Council Members questioned Mr. Baptista further.
Councilman Ferri commented that the license no longer exists and that Mr. Baptista should seek legal advise. He stated that in his opinion the case has been disposed of and that Mr. Baptista can apply for a new license.
Council discussion ensued.
For the record the interpreter for Mr. Baptista was Arno Penete of 48 Fairview Ave., Pawt. R.I.
Councilwoman Moreau reported on a meeting with the Hispanic Community and the problems with interpreter for the Police Department is being worked out.
Council President Canvan commented.
Councilman Ferri stated to the Council that an Introduction of an Ordinance related to House Numbers was done at the last meeting and that it should be before the Council for first passage at this meeting. He then read his draft of this Ordinance and asked for first passage.
Motion was made by Councilman Ferri and seconded by Councilwoman Moreau to approve for first passage.

Councilman Ferri commented that a Crime Card Ordinance was introduced at the last meeting and that he may have the Ordinance ready for first passage at the next meeting.
Councilman Matthews asked the City Clerk how long it would be before the Zoning Ordinance is presented to the Mayor for his signature.
Daniel J. Issa, City Clerk related the present work status and conference schedules of the Office for the coming week and stated that it may be a week before the Ordinance reaches the Mayor's desk.
