An Ordinance Related to Residential Safety
An Ordinance Certification of Occupancy Introduced by Council President Laroche.
Council President Laroche questioned if the Ordinance related to Certification of Occupancy should be first passage.
City Clerk Daniel Issa clarified that in his recollection on this matter the original Ordinance was withdrawn. He also stated that the time lapse relative to the time of introduction was over nine months and that it was prudent to place this as an introduction.
Council President Laroche asked if the minutes actually reflected the motion to withdraw.
City Clerk Issa responded that it was upon his recollection.
Council President Laroche asked for a motion to place this Ordinance later on this agenda, until the City Solicitor arrived.
Motion to place later in agenda was made by Councilman Brousseau and seconded by Councilman Charbonneau.

An Ordinance Amending Article I Section 14-1 "Schedule of Licenses & Permits" Reinspection Charges" Read by City Clerk Issa.
Councilman Brousseau commented on his position relative to these Ordinances.
Councilman Vaudreuil questioned Councilman Brousseau on the fees.
Councilman Charbonneau commented that he thought the fees were high.
Motion to approve was made by Councilman Vaudreuil and seconded by Councilwoman Moreau.
Council President Laroche commented that the City of Pawtucket has this Ordinance and are very strict with this.

An Ordinance Amending Chapter 12 entitled "Housing" as amended.
Read by City Clerk Issa.
Motion was made by Councilman Brousseau that the word certified be changed to certifiable he explained the reason for this change.
Council President Laroche commented.
Motion seconded by Councilman Charbonneau.
Councilwoman Moreau questioned the amendment relative to this being a union position.
Councilman Brousseau explained that this would be similar to the position of the Deputy City Clerk.

Meeting opened to public hearing.
Mr. Arcisz questioned the need for this position.
Councilman Brousseau explained the need for this position when the Department was without the Department Head.
Deputy Clerk Crowley stated the difference in wages between the Clerk III position and the Deputy's wages.
Further discussion ensued.
Richard Muggle questioned the number of clerks in the Office.
Council President Laroche stated that there is a minimum/maximum Ordinance in effect.
Councilman Brousseau explained that this is to upgrade the present position not to create a new position in that Office. He also stated that this would be a union position and subject to union rules.
City Clerk Issa questioned a Union person being a supervisor over non union personnel.
Council President Laroche commented.
Public Hearing closed.
Councilwoman Moreau asked if this Ordinance should state that this would be a union position.
Councilman Brousseau stated that the ordinance states that this position shall be appointed in the same manner as the Deputy City Clerk and Deputy Finance Director who are both union personnel. He further stated that it would be up to the union to follow through on this.

Councilman Charbonneau asked what the condition of the building is and commented that he was under the impression that the building had been trashed.
Elizabeth Crowley explained that the building was not destroyed in any physical sense. She commented that cleaning was required and that the Marshall's service was responsible for any repairs that may be required.

Council President Laroche commented on the Anti Drug Grant and stated that Councilwoman Moreau, who is working on this project should look into this grant program.
Council President questioned City Solicitor George Muksian on the status of this Ordinance.
City Solicitor Muksian explained that to his recollection this Ordinance was withdrawn. If that's the case this should be introduction.
Councilwoman Moreau questioned if this was the Ordinance that Mr. Muggle worked on with Mr. Briden.
Mr. Muggle explained that this is a different Ordinance.
Discussion ensued between the City Solicitor and the Council.
Mr. Muggle stated that this Ordinance was introduced in December of 1990.
Council President Laroche stated that the Ordinance should be up for first passage.
Councilman Charbonneau asked to table until next meeting.
Councilwoman Moreau commented.
City Clerk Issa commented on the length of time between introduction and first passage.
Councilwoman Moreau commented that the Council has an obligation to the originator of this Ordinance.
City Clerk Issa warned that if the procedure on this Ordinance isn't properly followed that it could be challenged in the future.
City Solicitor Muksian commented.
City Council President read from the official minutes dated December 10, 1990 which related that Introduction on this Ordinance took place at that time.
City Solicitor Muksian showed the Council the notes from which this Ordinance was written about a week ago.
City Solicitor Muksian stated that more than ten months has elapsed since the introduction. He then asked the Council where do we draw the line from Introduction to final passage.

Councilwoman Moreau commented that the lady who is making application for the store on Dexter Street shouldn't have to wait until after the Liquor Board.

Councilman Charbonneau asked that the City Sergeant be reimbursed for gas consumption.
George Muksian stated that this was a managerial decision.
City Clerk Issa suggested that the City Sergeant submit a mileage sheet to him for reimbursement from the City Property gasoline allowance account.
