Motion to accept and place on file made by Councilman Weber and seconded by Councilman Benson.  All Agreed.  So Voted. 4-0.

 

3.  Claims For Damages not covered by The Trust

 

a)  Kelkat Holdings Inc. for alleged damages incurred at the property owned by him at 42-44 Parker St. due to an alleged misinformation from the Zoning Department- Tax relief.

 

Motion to refer this matter to the Legal Department was made by Councilman Weber and seconded by Councilman Benson. All Agreed. So Voted. 4-0.

 

b)  Arlene Rivera of 704 Pine St. Central Falls for alleged damages to her vehicle by a Police vehicle on 3/20/05.

 

Motion to approve claim for the amount of $ 1,118.75,made by Councilman Benson, seconded by Councilman Patino. All Agreed. So voted. 4-0.

 

c)  Aida Martinez of 6 Park St. for alleged damages to her house by hitting a wire hanging from her house by a Trash vehicle which then tore off siding.

 

Mr. Martinez was present and was questioned by the Council as to him attaining a building permit for the siding job done by him.  Mr. Martinez stated that he did not move the wires to do the siding. He also stated that 3 weeks prior to this incident a rubbish truck hit the pole causing the wires to be lowered a new pole recently replaced the one hit by the truck.  Councilman Weber asked Councilman Silva if he was aware of the incident with the pole.  Councilman Leger stated that if a permit wasn’t pulled prior to the work then the issue should be tabled till next month pending a report.

                       

Motion to table made by Councilman Weber and seconded by Councilman Patino. All Agreed. So Voted.

 

d)  Stephen Clarke of Diamond Hill Rd. Cumberland for alleged damages to his truck parked unattended by Fire Department on 2/4/05.

 

Motion to approve claim for the amount of $ 2566.46, made by Councilman Benson, seconded by Councilman Patino. All Agreed. So voted. 4-0.      

 

e)  Susan Courcy of 27 Holly Dr., Seekonk, MA for alleged damages to her vehicle after hitting a pothole on Hunt St. on 9/29/04 (cont. after getting more estimates)

 

Motion to approve claim for the amount of $ 226.03, made by Councilman Benson, seconded by Councilman Weber. All Agreed. So voted. 4-0.      

 

f)  Francisco Isep of 87 Fuller Ave. for alleged damages to his vehicle after collision with recycling truck on Sumner Ave. on 3/8/05.

 

Motion to deny claim made by Councilman Weber, seconded by Councilman Silva, all agreed. So voted.4-0

 Motion to adjourn at 7:03pm made by Councilman Weber, seconded by Councilman Leger, all agreed. So voted.
