Immediately following the City Council Meeting

 

1. Roll Call

Quorum present.

 

Councilman Robichaud chaired the meeting.

 

2. Claims for damages under $2500.00

 

Menise Kucukkaya for damages to her window by the plowing.

 

Councilman Noury stated that he asked for at least estimates to be filed and to ask that Mrs. Kucukkaya be present at the next meeting.

 

Motion to table was made by Councilman Noury and seconded  by Councilwoman Canavan.  All   Agreed. So Voted.

 

3. Claims for Damages over $2500.00 not sent to inter-local.

 

a) International Association of firefighters allegedly due as a result of Arbitrator's Award for  98/99.

 

Councilman Leger stated that he said at the previous meeting that according to the Charter or according to the Ordinance that the City should pay the $138,000 + based on that law as long as the City Solicitor certified it. He also said at the time that he didn't feel it was prudent to take money out of the surplus or that Council didn't have the authority to do so at the time and that he would be in favor of doing it as long as it was proposed in the next budget.  He stated that this did not happen in the new budget. He said he does not appreciate someone saying he said something that he did not say.  He said that the $1387,00 does not belong in front of the claims committee.

 

Councilman Noury stated that he is going to move a question.  Motion was made by Councilman Noury to pay 1485 IAFF in the amount of $138,738.19 and that the Acting Deputy Finance director pay this claim immediately and to pay it out of the current operating budget 2000/2001.

Seconded by Councilman Lazieh.

 

Councilman Noury, directing his comments to Councilman Leger stated that his intentions are right and honorable but if the Mayor is not going to take the course of action and we ordered this payment out of the budget for this year it would then get to the Mayor as was originally intended..He also stated that he doesn't think that the Mayor going out for a note that should pay what is current operating expense should be done. He said that he agrees with Councilman Leger that this is the time to take the money out of the surplus to pay for those fiscal years and make them current. He said that since the Mayor is trying to around that this would carry through the  councilmanic request that was originally proposed.

 

Councilman Leger stated that he is totally100% in favor of the firefighters getting paid, but, he is a Councilman and not the Mayor and will not do what the Mayor should be doing. He said the Mayor is the one responsible, he negotiates the contracts, he decided to appeal it and he needs to deal with it not the Council. This has nothing to do with us the Council is not responsible for negotiating contracts.  He said that he cannot approve a claim that is not the Council's responsibility. Councilman Noury stated that his only concern is that the Mayor is now suggesting going out on a note.
