At 6:30 p.m.

 

A meeting of the Central Falls Claims Committee was held on the above date in the City Hall Council Chambers at 7:26 p.m.

Quorum present.

 

Chairman Robichaud presided.

 

Correspondence

 

Peter Granieri, Director of Public Works re: Felizzola claim.

Motion to accept and place on file was made by Councilman Noury and seconded by Councilwoman Canavan.  All Agreed. So Voted.

 

Discussion

 

James P. Marusak, Esq. Lazieh claim

Councilman Lazieh recused himself.

 

Attorney Marusak stated that there is no obligation to pay this claim. He stated that there was a finding of a violation. He related that the City has no indemnity ordinance and he commented on the City Code.

 

Discussion took place between Mr. Noury and Mr. Marusak.

 

Mr. Marusak stated what he would not advise whether there should be a reimbursement.

 

Mr. Noury commented.

 

Mr. Marusak advised that the Council seek an advisory opinion from the ethic commission before paying claims.

 

Councilwoman Canavan commented that the Ethics commission did find Mr. Lazieh in violation.

 

Councilman Lazieh asked that the Committee not act on this until he has time to seek legal opinion on this opinion.

 

Councilman Noury commented.

 

Councilman Lazieh commented on Mr. Tajra’s case.

 

Councilwoman Canavan stated that she has the original Ethics Complaint.

 

Councilman Leger stated this is not the appropriate place for this.

 

Councilman Noury commented on Mr. Maruzak’s opinion. He said he didn’t have a problem with tabling this.

 

Councilwoman Canavan stated that Councilman Lazieh’s attorney already spoke to the previous council on this matter and that she personally did not feel the need for another attorney to come before the Council. She stated that she is comfortable in making a motion to deny payment of the claim.  Seconded by Councilman Leger.

 

Councilman Leger commented.

 

Councilman Robichaud stated that he is also ready to make a decision.

 

Councilman Noury stated he feels Councilman Lazieh needs an opportunity to review.

 

Councilman Noury motioned to table, no second.

Michelle Felizzola Claim:

 

Mr. Oliverio commented and recommended not to pay.

 

Motion to deny was made by Councilman Noury and seconded by Councilman Leger.  All Agreed. So Voted.

 

Motion to adjourn was made by Councilman Noury and seconded by Councilwoman Canavan.  All Agreed. So Voted.    Time 8:20 p.m.
