City Hall Council Chambers    

Wednesday, August 16, 2000 at 6:00 P.M.    

Meeting Started at 6:12 pm    

 

1. Roll Call

Members present were; Councilman Jason Leger, Councilwoman Rosemarie Canavan, Councilman Ronald Robichaud     

 

The Chairman was Ronald  Robichaud .

 

Matthew  Oliverio from Legal Department was present.    

 

2. Minutes

 

A. Claims Committee Meeting March 13, 2000

 

Motion to accept and place on file was made by Councilman Leger, seconded by Councilwoman Canavan. So voted.    

 

3. Claims & Pending suits filed with RI Interlocal

 

 

A) Nereida Esquilin, by her attorneys Sinapi, Formisano & Coleman, LTD for personal injuries sustained due to a fall on a common area walkway situated on property owned by he City of Central Falls located at 9 Chestnut St., Central Falls

 

B) Maria Gomes, by her attorney Domenic Carcieri for injuries sustain while operating a motor vehicle which was struck by a vehicle operated by Richard Nievera.

 

C) Frederick Boday, by his Attorney Thomas Chester for injuries sustained in a fall on sidewalk on Cross St.

 

D) Jacqueline Reyes, by her Attorney Christopher E. Fay for injuries in a fall on sidewalk on Summer St.

 

All of the above claims were read aloud.

 

Motion made to refer items A through D to our insurer The Trust, made by Councilman Leger, seconded by Councilwoman Canavan.

4. Claims for Damages under $2500.00

 

A) Madeleine Chaput by her insurance carrier for damages to her vehicle when in an accident with a Fire Truck on Illinois St. $1,193.36.

 

Discussion took place on the claim.    

 

Matt Oliverio, gave the Claims committee information.    

 

Motion to deny claim made by Councilman Leger, seconded by Councilwoman Canavan,

Motion carries claim denied. Legal department instructed to notify party who filed claim.    

 

B. Francisco S. Faria for damage to front wheel from pothole on Hunt St. $582.93

 

Discussion took place on the claim.

 

Matt Oliverio, gave the Claims committee information.

 

Motion to deny claim made by Councilman Leger, seconded by Councilwoman Canavan,

Motion made by Councilman Leger to convene to executive Session re: Exemption #2 of the Open Meetings Law, “Pending Litigation” Seconded by Councilwoman Canavan

Motion made by Councilman Leger to seal the executive session minutes, seconded by Councilwoman Canavan
