City of Central Falls Claims Committee Meeting

A Meeting of the Central Falls Claims Committee was held on the above date in the City Hall Council Chambers at 6:50 p.m.

Councilman Noury chaired the meeting.

Thomas Lazieh for expenses incurred as a result of Ethics investigation.
Matthew Oliverio, Assistant City Solicitor stated that an adjuster is looking at this claim, our rights need to be protected.
Councilman Noury questioned the Solicitor on this procedure.
Councilman Ferri questioned fees.
Councilman Canavan commented on this claim in excess of $30,000. They commented on any claim that has a potential of being major.
Motion to refer to Rhode Island Interlocal and the legal department was made by Councilman Weber and seconded by Councilman Ferri.
All agreed. So voted.
1998 Inc for expenses incurred because of an abatement rescission.
Motion to table was made by Councilwoman Moreau and seconded by Councilman Weber. All Agreed. So Voted.
Robert Levine for damages that occurred while on duty for the Police department.
Matthew Oliverio, assistant Solicitor explained that injured personnel on duty statue, while on the payroll of the City has no claims against the City, exclusive remedy is barred under Rhode Island General Law as the injured is receiving full salary & benefits. He recommended that the Committee deny the claim.
Motion to deny was made by Councilman Canavan and seconded by Councilman Ferri. All Agreed. So Voted.

Richard Lussier continued from previous claims meeting for expenses incurred for appeals to Historic District.
Councilman Canavan stated that he disagreed with the Historic District issue but that Mr. Lussier may be incorrect with the issue of Attorney fees.
Mr. Oliverio stated that there is no provision under the statute for recovery for Attorney fees with the exception of Civil Rights issues. He stated that this is a Public Policy Issue.
Councilman Noury stated that the Board should table this until Mr. Lussier has had time to evaluate and find the laws that he was in reference to about this issue.
Councilman Ferri stated that the City deserves to put this issue to rest.
Motion to table was made by Councilman Canavan and seconded by Councilwoman Moreau.
