City Manager Memo

 

A meeting of the City Council of the City of Belding, Michigan was convened in open and public session via a virtual meeting at 7:00 p.m. on Tuesday, September 15, 2020. 

 

Mayor Brad Miller called the meeting to order at 7:00 p.m. 

 

The City Clerk, Janae Cooper, took the roll call:

 

Members present: Bruce Meyers, Doug Feehan, Mike Scheid, Jorel Davis and Brad Miller

 

Approval of Agenda

Moved by Scheid, supported by Feehan to approve the Agenda as presented.  Motion carried by the following roll call vote: yes – all.

 

Guest

Amber Rood, member of the Belding Labor Day Committee, updated the City Council members on the scaled-down Labor Day festivities.  Events included a road rally, a porch parade, a virtual 5K and 1 mile fun run and the Daily News Food Truck rally.  Overall everything went smoothly.

 

Consent Agenda

Moved by Scheid, supported by Feehan to approve the Consent Calendar as presented. 

A.      Approve Independent Bank checks 74858 to 74883 in the amount of $31,889.10.

Reports by Council Liaisons

Meyers stated that the Rec Board was cancelled due to lack of a quorum.  The Housing Commission meets tomorrow.

 

New Business

A.   Moved by Davis supported by Meyers to adopt Ordinance No. 555, amending Medical Marihuana Ordinance No. 550.

The following ordinance was offered by Member Davis and supported by Member Meyers:     

 

ORDINANCE NO. 555

 

AN ORDINANCE TO AMEND CHAPTER 58, ARTICLE IX, SECTION

58-179(c) OF THE CITY OF BELDING CODE OF ORDINANCES TO

ALLOW ONE ADULT-USE MARIHUANA GROWER

OPERATION IN THE CITY OF BELDING

 

THE CITY OF BELDING ORDAINS:

          Section 1.  Amendment of Section 58-179(c). 

     Chapter 58, Article IX, Section 58‑179 (c) of the Code of Ordinances is hereby amended.  Such section shall read as follows:

c.  Sections 58-179(a) and (b) above notwithstanding, two marihuana grower operations for not more than 1,500 plants each and one adult-use marihuana grower operation for not more than 2000 plants shall be permitted, upon payment of an annual fee of $5,000 for each grower operation, at the location described as follows:

Land situated in the City of Belding, County of Ionia, State of Michigan, commencing at the Northwest corner of Section 15, Town 8 North, Range 8 West, thence East 1,294 feet to the Point of Beginning; thence South 367 feet; thence West 238 feet; thence South 1,275 feet; thence

East 519 feet; thence North 1,275 feet; thence West 130 feet; thence North 367 feet; thence West 164 feet to the Point of Beginning and the North 367 feet of the aforedescribed parcel.

The marijuana grower has offered, and the City hereby accepts, that when a new facility is constructed and is being used for a grower operation, the grower operation at the temporarily rezoned property in the now existing building will be discontinued and the licensee for up to 1,500 plants at that location will be surrendered.

                   Section 2.  Effective Date.         

This ordinance shall become effective 10 days after publication in a newspaper of general circulation in the City of Belding.

B.    Moved by Davis, supported by Meyers to adopt Ordinance No. 452-A25, amending Ordinance No. 452-A20.  The Resolution is as follows:

ORDINANCE NO. 452-A25

 

AN ORDINANCE TO AMEND ORDINANCE NO. 452-A20,

AS AMENDED,  TO PERMIT AN ADULT-USE MARIHUANA

GROWER OPERATION AND TO INCREASE THE PERMISSIBLE

NUMBER OF MARIHUANA PLANTS

AT AN EXISTING GROWER LOCATION

 

 

THE CITY OF BELDING ORDAINS:

 

 

          Section 1.    

 

Ordinance No. 425-A20, as amended, is further amended as follows:

 

a.      The preamble of Section 2 is amended to read:  The property described may be used for two medical marihuana grower operations, each with not more than 1,500 plants, and one adult-use marihuana grower operation with not more than 2000 plants, provided there is compliance with the following conditions:

 

b.      Section 2.b. is amended to read:  Only two medical marihuana grower operations and one adult-use marihuana grower operation may be established and operated by a Licensee in the City, subject to compliance with Act 281, the Rules, and this ordinance.

 

c.      Section 2.l. is amended to read:  Two medical marihuana grower operations, each with not more than 1,500 plants and one adult-use marihuana grower operation with not more than 2000 plants are permitted by this Ordinance.  The marihuana grower has offered, and the City hereby accepts, that when a new marihuana grower facility is constructed and is being used for a grower operation, one medical marihuana grower operation at the temporarily rezoned property in the now existing building will be discontinued and the licensee for up to 1,500 plants at that location will be surrendered. 

 

          Section 2.

         

This ordinance shall become effective 10 days after publication in a newspaper of general circulation in the City of Belding.

City Manager Comments

John Niemela, City Manager attended a webinar last week regarding the CARES Act.  The funding comes in three parts; an auto-payment made by the State of Michigan with federal dollars.  This eliminated the August Revenue Sharing payment, however we received 50% more than what we would have gotten.  The funds were used to cover the wages of the fire and police departments.  The second part of the CARES Act funding is an additional payment to the police and fire department personnel, in which each qualifying employee should receive $1,000.  This is still being reviewed, but we should get what we applied for.  The third part is to reimburse the wages paid to first responders (fire and police) for April and May.  Niemela anticipates receiving 50-60% of what he applied for.  This should be wrapped up by the end of the month.

 

Niemela further reported that it is a struggle to get the trees trimmed on the observation deck.  The first estimate was almost $8,000, which was rejected.  The second estimate was $6,000.  Niemela is asking for more detail from the bidder.  Some trees need to stay for erosion control.     

  

Council Comments

Scheid commented on Labor Day.

 

Davis commented on Labor Day and Botanical Biologics, LLC.  Davis thanked Niemela for his work on recouping money for the City of Belding.

 

Meyers commented on the backhoe and front-end loader repairs, continuing road improvements, citizen concerns regarding the Rite Aid extension, thanked the Labor Day Committee and Botanical Biologics, LLC.  Meyers noted that the sidewalk across from the Gathering Place looks abandoned.

 

Mayor Miller commented on road paving, the Labor Day activities and Botanical Biologics, LLC.
