A meeting of the City Council of the City of Belding, Michigan was convened in open and public session at 7:00 p.m. on Tuesday, May 7, 2019.

 

Mayor Miller delivered the invocation.

 

The Mayor led the audience in the Pledge of Allegiance.

 

The City Clerk took the roll call:

 

Members Present:        Council Members Mike Scheid, Jorel Davis, Bruce Meyers,  Douglas Feehan and Brad Miller

 

Members Absent:        None

 

Approval of Agenda

 

Council Member Scheid made a motion to approve the agenda as presented, supported by Council Member Feehan.

 

Mayor Miller added Item G to the Business agenda – Set public hearing on an application for Industrial Facilities Exemption Certificate for Granco Clark, Inc.

Council Member Scheid made a motion to approve the consent agenda, supported by Council Member Feehan.

Reports by Council Liaisons

 

Council Member Scheid did not have a report.

 

Council Member Davis stated there was not a meeting. 

 

Council Member Meyers stated the Housing Commission met on April 18 and heard vacancy, delinquency and maintenance reports.  There was a work session on the transfer of ownership of the property.  The city attorney is finalizing the language.  Approval is needed from the DEQ.  The Belding Housing Commission and Greenville Housing Commission formed a committee to discuss a model for future staffing and organizational structure.  The next meeting will be held on May 16.  The Rec Board will meet on May 13.  He spoke with Mr. LaClear tonight.  John is stepping down from the Rec Board.  He was a dedicated member and cared about the City of Belding.  At times, he was frustrated by the slow pace of the board.  He loves the City of Belding.  He served 4-5 years on the Rec Board.  He remains passionate, but will watch from a distance.  He appreciates what he has done.

 

Council Member Feehan stated the Museum Board talked about refinishing the floors in the big room.  Summer hours at the BEL Children’s Museum start in June, on Wednesdays from 9 a.m. to noon and 1 – 4 p.m.  On April 29, they did a major cleaning of the building.   

 

Mayor Miller stated the April Planning Commission meeting was cancelled. He could not attend the library meeting.

New Business

 

A.    Park Use Agreement – BASC Soccer

 

Council Member Scheid moved the passage of the resolution and the motion was supported by Council Member Feehan.

 

RESOLUTION NO. 2019-05-18

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPROVING A PUBLIC PARK USE AGREEMENT WITH BASC SOCCER.

 

WHEREAS,               the City of Belding wishes to enter into a Public Park Use Agreement with BASC Soccer for the use of Central Riverside Park facilities; and

                                               

WHEREAS,               the term of the Agreement shall begin on March 18, 2019 and end on October 30, 2019.  

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that a Public Park Use Agreement with BASC Soccer is hereby approved.

B.     Park Use Agreement – Belding Youth Baseball League (BYBL)

 

RESOLUTION NO. 2019-05-19

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPROVING A PUBLIC PARK USE AGREEMENT WITH BELDING YOUTH BASEBALL LEAGUE (BYBL).

 

WHEREAS,               the City of Belding wishes to enter into a Public Park Use Agreement with the Belding Youth Baseball League (BYBL); and

                                               

WHEREAS,               the term of the Agreement shall begin on April 1, 2019 and end on July 15, 2019. 

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that a Public Park Use Agreement with Belding Youth Baseball League (BYBL) is hereby approved.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPROVING A PUBLIC PARK USE AGREEMENT WITH CHURCH LEAGUE SOFTBALL.

 

WHEREAS,               the City of Belding wishes to enter into a Public Park Use Agreement with Church League Softball for the use of Demorest Field facilities; and

                                               

WHEREAS,               the term of the Agreement shall begin on May 1, 2019 and end on August 30, 2019.         

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that a Public Park Use Agreement with Church League Softball is hereby approved.

D.    Park Use Agreement – Michigan Disc Golf Empire (MDGE)

 

RESOLUTION NO. 2019-05-21

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPROVING A PUBLIC PARK USE AGREEMENT WITH THE MICHIGAN DISC GOLF EMPIRE (MDGE).

 

WHEREAS,               the City of Belding wishes to enter into a Public Park Use Agreement with the Michigan Disc Golf Empire (MDGE)for the use of Lightning Bend Park facilities; and

                                               

WHEREAS,               the term of the Agreement shall begin on April 1, 2019 and end on March 31, 2020.         

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that a Public Park Use Agreement with the Michigan Disc Golf Empire (MDGE) is hereby approved.

E.     Belding Gardeneers – Request to place banner on Breimayer lot

 

RESOLUTION NO. 2019-05-22

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN GRANTING PERMISSION TO THE BELDING GARDENEERS FOR PLACEMENT OF A BANNER ON THE BREIMAYER LOT.

 

WHEREAS,               the Belding Gardeneers will hold their annual Garden Walk on Saturday, June 29, 2019; and

 

WHEREAS,               the Belding Gardeneers have requested the placement of a 3’ x 10’ banner on the Breimayer lot to advertise the event for approximately two weeks prior to the event.

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that approval is hereby given for the Belding Gardeneers to place an advertising banner  on the Breimayer lot for approximately two weeks prior to their annual Garden Walk on June 29, 2019.

F.     Award bid to reconstruct basketball courts at Central Riverside Park

 

RESOLUTION NO. 2019-05-23

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AWARDING THE BID TO RECONSTRUCT THE BASKETBALL COURTS AT CENTRAL RIVERSIDE PARK TO CL TRUCKING AND EXCAVATING

 

WHEREAS,               the city solicited bids for the replacement of two basketball courts in Central Riverside Park; and                 

 

WHEREAS,               CL Trucking & Excavating was the lowest responsive and responsible bidder in the amount of $85,000.         

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding,  Michigan that the bid is awarded to CL Trucking & Excavating to reconstruct the basketball courts at Central Riverside Park in the amount of $85,000.

G.    Set Public Hearing for Industrial Facilities Exemption Certificate Application – Granco Clark, Inc.

 

RESOLUTION NO. 2018-05-24

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN SETTING A PUBLIC HEARING ON AN APPLICATION FOR INDUSTRIAL FACILITIES EXEMPTION CERTIFICATE FOR GRANCO CLARK, INC.

 

WHEREAS,               pursuant to Act 198 of the Public Acts of 1974, as amended (“Act 198”), Granco Clark, Inc. (the “Company”) requested that the City of Belding establish an Industrial Development District in connection with property located at 7298 Storey Road;  

 

WHEREAS,               the company submitted an application for an industrial facilities exemption certificate for machinery and equipment purchases in accordance with the provisions of Act 198; and    

 

WHEREAS,               it is necessary to hold a public hearing on the Company’s application for an industrial facilities exemption certificate.

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding,

                                    Michigan that:

 

1.      That a public hearing on the Company’s application for an industrial facilities exemption certificate shall be held at the Pere Marquette Depot, 100 Depot Street, Belding, Michigan, at 7:00 p.m. on May 21, 2019.

           

2.   That the City Clerk shall give written notice by certified mail to the   owners of all real property within the industrial development district.

 

3.      That the City Clerk shall provide written notice of the hearing to the City Assessor and the legislative body of each taxing unit that levies ad valorem property taxes in the area in which the facility is located.

 

4.      That the City Clerk shall publish a notice of the hearing in the Daily News, a newspaper of general circulation in the City.

 

5.      All resolutions and parts of resolutions insofar as they conflict with the provisions of this resolution be, and the same hereby are, rescinded.

Public Comments

 

Jeff Hunter, 6302 Zahm Rd, asked, with all the rec stuff, can council look into the rule of no drinking at Demorest for softball leagues?  Last he knew, they were done with it and they go to Greenville now.  Could council change the rule so the people will come back here to play?  They drink at disc golf a lot.  He doesn’t recall a problem at Demorest Field when adults had a few beers.  He asked if they could look into to it and bring the league back to town?

 

City Manager Comments

 

City Manager Niemela stated the email he intended to send last Thursday was sent today, as he forgot to send it.  DNR gave approval on the specifications for the trail and look out for the Gathering Place.  That got done earlier than expected.  The kayak launch is still waiting for approval.  He talked to the engineers and they are scheduling the bid opening for May 23.  The first meeting in June will be the bid approval.  It will connect from Main Street to the Meijer Trail. There will be a look out station with a pathway to it.  There will be several park benches and tree plantings.  Electrolux has agreed to what was submitted in the plan, including a pavilion, trees and pathways.  They will close on Ranney Village this Thursday. They are anxious to get started soon and it may be by the end of the month.  He has been working with the Library Board for some time on the 3-party agreement between the City of Belding, Library Board and Building Authority.  The library could not do it on their own.  The agreement explains the organization and funding, and how they pay off debt services.  Some pieces are challenging to the Library.  He has proposed what can be done and the attorney is redrafting the agreement now.  That will get approved by the Library Board, City Council and Building Authority.  It will be more specific on how the rent will be paid by the library, and the rent will generally be equivalent to the debt service.  Originally, there was a fixed amount and then the City could take their profits at the end of the year to apply against the loan.  Over the last couple of years, the RDA has changed their policy on loans.  Reductions now come at the end.  The debt service is a known quantity.  The new agreement will set the rent as the amount of the debt service.  It will solidify the library budget.  Now they can set funds aside for capital and building improvements. It will stabilize their funding process.  He will be out of town next week, and will be back for the council meeting on May 21.   

 

Council Comments

 

Council Member Davis thanked everyone for coming and thanked Mr. Rousseau for all he has done for the City of Belding.  He has heard so many tremendous things and he gave opportunities to his church, students and the City of Belding.  He will be missed. 

 

Council Member Meyers had no comments.

 

Council Member Feehan thanked Ernie and the crew for all their hard work.  They do a good job. 

Council Member Scheid stated they had a lot of work to do this spring.  He thanked everyone for coming and asked that they enjoy the good weather they will have soon. 

 

Mayor Miller expressed thanks for coming out tonight.  They are good on the finalized budget.  He stated it was nice to see all the use in the parks.  It is exciting to see.
