A meeting of the City Council of the City of Belding, Michigan was convened in open and public session at 7:00 p.m. on Tuesday, June 19, 2018.
Council Member Scheid delivered the invocation.
The Mayor led the audience in the Pledge of Allegiance.

RESOLUTION NO. 2018-06-35
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN
APPOINTING JOHN NIEMELA TO THE BUILDING AUTHORITY.
WHEREAS, the city manager historically holds a position on the Building Authority; and
WHEREAS, John Niemela will serve in this capacity as city manager.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that John Niemela be appointed to the Building Authority with a term to
expire on June 30, 2020.
RESOLUTION NO. 2018-06-38
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPROVING BY-LAWS FOR THE ZONING BOARD OF APEALS.
WHEREAS, the Zoning Board of Appeals approved by-laws for the board at the
meeting on June 7, 2018; and,
WHEREAS, approval by the City Council is required for the by-laws to become
effective.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding,
Michigan that the Zoning Board of Appeals by-laws are hereby approved.
Reports:
Council Member Meyers stated that the Rec Board met last night. They went over a few items which will be covered by Manager Niemela when he gives his report. The Belding Housing Commission meets Thursday the twenty-first.

RESOLUTION NO. 2018-06-36
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AMENDING THE FISCAL YEAR 2017/18 BUDGET.
WHEREAS, on May 16, 2017, the Council of the City of Belding, Michigan adopted its 2017/18 Fiscal Year Budget for the administration of all funds and activities; and,
WHEREAS, unanticipated revenues and expenditures are projected which may exceed budget appropriations listed in said budget; and,
WHEREAS, the Fiscal Year 2017/18 Budget must be changed to reflect these adjustments;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that the Fiscal Year 2017/18 Budget be amended pursuant to the attached worksheet.
City Manager Niemela talked about the budget and how the amendments will keep the City budget in balance. There will be a surplus following the adjustments. He talked about the departments and the budget, and how some changes will help put adjustments where they should be. The Departments will more accurately tell where charges come from and make it easier to predict cost. He also talked about the 2019 brush pick-up and how there may be a drop-off site. That may eliminate or reduce the City needing to pick up, and thus change cost adjustments.

ORDINANCE NO. 452-A18
AN ORDINANCE TO AMEND THE CITY ZONING MAP OF THE CITY OF BELDING MICHIGAN, INCORPORATED IN THE ZONING ORDINANCE OF THE CITY OF BELDING (BELDING ORDINANCE NUMBER 452) BY SECTION 3.2, OF THE BELDING CITY CODE.

Manager Niemela said this request has gone to the Planning Commission and is now for the City Council to address.
Mike Luvian, the business partner of Mr. Sikkema, spoke about getting the rezoning done and then doing some external improvements to the building.

RESOLUTION NO. 2018-06-39
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AUTHORIZING THE USE OF CITY STREETS FOR THE ANNUAL LABOR DAY 5K AND ONE MILE FUN RUN/WALK.
WHEREAS, a request was received from the Belding Chamber of Commerce to use city streets on Labor Day to sponsor the annual Labor Day 5K and One Mile Fun Run/Walk on Monday, September 3, 2018 from 8 a.m. to 10 a.m.; and
WHEREAS, the route will include Hall, Ionia, Hanover, Main, Ashfield, Morton, Harrison, Gooding, Reed, Bridge and E. Center Streets; and
WHEREAS, the group will be escorted by the Police Department with a lead car and a chase car at the end, with volunteers at the intersections.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Belding,
Michigan that the designated city streets may be used for the Labor Day 5K and One Mile Fun Run/Walk on Monday, September 3, 2018 from 8 a.m. to 10 a.m.
Chief Nelson talked about the Lyons Club sponsoring a 5K run/fun walk in the past, but this year the Belding Chamber of Commerce is taking over this program. Again it will be Labor Day morning starting at 8am and will be completed by 10am or when the last runner comes off the course. The event starts and ends at the High School. They run a course that runs across the eastern part of the City, across Harrison Street, Gooding Street, through the Industrial Park, back down to Ashfield, to Bridge, downtown and down Bridge Street back to Center Street and the High School. There is exposure for the downtown for the run. They provide monitors throughout the course and the Police Department does an escort and rear guard to make sure everyone gets off the course safely.

RESOLUTION NO. 2018-06-40
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AUTHORIZING THE REQUEST TO TEMPORARILY CLOSE ISABELLE STREET, BETWEEN PEARL AND BROAS STREETS, FOR A NEIGHBORHOOD BLOCK PARTY, AND TO SUSPEND THE NOISE ORDINANCE FOR THE EVENT.
WHEREAS, a request was received from Daniel Clark, 321 Isabelle Street, to temporarily close Isabelle Street, between Pearl and Broas Streets , for a neighborhood block party from Saturday, July 14, 2018 at noon until midnight; and
WHEREAS, the closure will provide a safe area for the residents to enjoy the neighborhood event which will be held from noon until midnight.; and
WHEREAS, Belding Code of Ordinances, Section 24, Article IV Noise Control, Section 34-76 and 34-77 will be suspended for the event.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Belding,
Michigan that Isabelle, between Pearl and Broas Streets, be closed on July 14, 2018 at 12 noon until midnight for a neighborhood block party, and Belding Code of Ordinances, Section 24, Article IV Noise Control, Section 34-76 and 34-77 be suspended for the event.
Chief Nelson said this is the third year for this event. It’s a non-impacting event for the city. They are very orderly. They usually clean up by 10pm without any problems, and he does not have any opposition to this closure.

RESOLUTION NO. 2018-06-41
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AUTHORIZING THE USE OF CITY STREETS AND GRANTING A NOISE CONTROL SUSPENSION FOR A 5K RUN/WALK TO SUPPORT THE “B” FOUNDATION.
WHEREAS, a request was received to use city streets after a Belding High School football game for a 5K Run/Walk to support the “B” Foundation on October 12, 2018 from 9:45 to 11:45 p.m.; and
WHEREAS, the route will include Hall, E. Washington, Hanover, Congress, Broas, Depot, N. Bridge, W. Ellis to the Candlestone drive; and
WHEREAS, W. Ellis to Storey Rd. (M-91) will be closed during the race; and
WHEREAS, intersections along the route will be blocked by barricades and guarded by volunteers and Police Department full time and reserve officers; and
WHEREAS, the Belding Code of Ordinances Section 34, Article IV Noise Control, Section 34-76 and 34-77 will be suspended for the event.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Belding,
Michigan that the designated city streets may be used for a 5K Run/Walk on October 12, 2018 to benefit the “B” Foundation from 9:45 p.m. to 11:45 p.m.; and
BE IT FURTHER RESOLVED that Belding Code of Ordinances Section 34, Article IV
Noise Control, Section 34-76 and 34-77 is suspended for the event.
Chief Nelson talked about the organization, and the glow-race they sponsor is one of their biggest fund raisers. It follows the pink football game at the High School. The Police Department does provide an escort; front and rear guard. The Fire Department provides lighting on Depot Street on the portion that is dark. They then move north on Bridge Street. Ellis Avenue is totally closed off from M-91 to Bridge Street, and the runners progress west on Ellis Ave. to the Candlestone Inn where the race ends. They start at 10pm at the football field. Notifications go out so that the residents are aware it is happening. The B Foundation provides corner guards throughout the route. He said it is low impacting to residents and city. Police Department and Police Reserves guard the major intersections.
Council Member Meyers asked if Ellis Avenue has always been closed for that, and Chief Nelson said yes. Everything gets opened up as soon as the last runner/walker enters Candlestone. The B Foundation provides extra lighting on Ellis Avenue because there is some darkness there.

RESOLUTION NO. 2018-06-42
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPROVING THE USE OF CENTRAL RIVERSIDE PARK PAVILIONS FOR KIDS WORSHIP CAMP VACATION BIBLE SCHOOL, AND TO SUSPEND THE NOISE VARIANCE FOR THE EVENTS.
WHEREAS, a special event application for July 22 - 26, 2018 was submitted by Jennifer Schumaker, director of Kids Worship Camp Vacation Bible School of the United Methodist Church; and
WHEREAS, the event will be held at the Lions Pavilion on July 22, 2018 and other Central Riverside Park pavilions may be used throughout the week from 5 p.m. to 8:30 p.m.;
WHEREAS, Belding Code of Ordinances, Section 24, Article IV Noise Control, Section 34-76 and 34-77 will be suspended for the events.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding,
Michigan that permission is granted for the use of Central Riverside Park pavilions for the Kids Worship Camp Vacation Bible School from July 22-26, 2018, and Belding Code of Ordinances, Section 24, Article IV Noise Control, Section 34-76 and 34-77 will be suspended for the events.
Chief Nelson talked on this subject. The application was made to the City to do the vacation Bible School in the park. It has taken place over the last several years, and is well attended and they provide a dinner each evening. They do a good job reaching out to the Community. This year, because there is some construction down by the Lyons pavilion, we offered the suggestion of using the Gathering Place. They checked that out, but due to the lack of shade and trees and readily accessible source of water and electric, they chose to go back to Central Riverside regardless of the noise. They are used to that location, but asked if they could move should the noise from the generator is too much disturbance to their event. The east pavilions will be available to them also.

RESOLUTION NO. 2018-06-43
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN GRANTING PERMISSION TO GUS MACKER FOR THE USE OF CITY STREETS, BREIMAYER LOT, ELECTROLUX LOT, EAST MALL PARKING LOT, WEST CITY HALL PARKING LOT, AND A NOISE VARIANCE FOR A 3-ON-3 BASKETBALL TOURNAMENT.
WHEREAS, Gus Macker requests permission from the City of Belding for the use of the following streets, east mall parking lot, south mall parking lot, Breimayer lot and Electrolux lot to run a 3-on-3 basketball tournament on August 4 and 5, 2018, with closure on Friday, August 3, 2018 at noon:
· Central Riverside Park main pavilion on evening of August 3 for a community picnic
· Breimayer Lot for retail tent, charitable organizations, and police and fire parking
· Gathering Place for team registration and arts and craft vendors
· Bridge Street, from Depot Street to Congress Street
· Congress Street, from Bridge Street to Alderman Street
· Main Street, from Bridge Street to Alderman Street
· Alderman Street from Congress Street to Washington Street, if the tournament exceeds 500 teams
· East mall parking lot, between Depot Street and City Hall (north section to be closed at 12 noon on Thursday, August 2, 2018 to allow for assembly and staging of backboards)
· Small parking lot west of city hall, if the tournament exceeds 500 teams
WHEREAS, Gus Macker requests a noise variance until 11:30 p.m. on August 3, 4, and 5, 2018.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding,
Michigan that permission is hereby granted to Gus Macker for the use of the fore mentioned city streets and properties and a noise variance for the 3-on-3 basketball tournament on August 3, 4 and 5, 2018.
Chief Nelson said that Gus Macker basketball has been with the City of Belding since the late eighties. For the last four or five years they’ve had about 400 to 450 teams. In talking with Scott McNeal, Scott feels the 450 to 500 number might be doable this year because it is the 45th year. Again it will be located Bridge Street, Main Street, East Congress area. Because it is their 45th year, they are having some special programs at Candlestone Inn on Thursday night, and on Friday night at the main pavilion in Central Riverside Park they will be doing a community picnic. On Thursday afternoon the north section of the east Mall parking lot will be closed off so they can start to stage the baskets. On Friday morning they will have a short three on three game with staff to kick off the event. The Briemayer lot will be used for police and fire parking, and Macker will have a retail tent there. They will use the Gather Place for registration. Mr. McNeal is thinking about 500 teams but in the event it might exceed that, he asked about expansion beyond the original court area. We would allow him to close off Alderman between Congress and Washington. Also there are courts that go east on Main Street toward Ashfield, and last year they didn’t use the last ones. They talked about next year and expansion and the streets, all needing further discussion. Years past always barricaded Leppinks parking lot, if they require it. Then it will also come to Council for approval.
Council Member Feehan said in previous years they had parking problems near the Bel with spectators blocking the Museum. Chief Nelson said he might be able to work on that.

RESOLUTION NO. 2018-06-44
RESOLUTION OF ACCEPTANCE OF THE MICHIGAN NATURAL RESOURCES TRUST FUND GRANT AGREEMENT FOR THE SILK CITY NATURE TRAIL GATHERING PLACE CONNECTOR
WHEREAS, the City Council of the City of Belding submitted an application titled, “Silk City Nature Trail Gathering Place Connector” to the Michigan Natural Resources Trust Fund for development of a pathway and river overlook along the Flat River connecting between the Silk City Nature Trail and the Fred Meijer Flat River Valley Rail Trail at The Gathering Place park; and,
WHEREAS, the proposed application is supported by the Community’s 5-Year Approved Parks and Recreation Plan; and,
WHEREAS, the Michigan Department of Natural Resources approved the application for funding; and
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Belding hereby
accepts the terms of the Agreement as received from the Michigan Department of Natural Resources and that the City of Belding does hereby specifically agree, but not by way of limitation as follows:
1. To appropriate all funds necessary to complete the project during the project period and to provide $50,000 to match the grant authorized by the DEPARTMENT.
2. To maintain satisfactory financial accounts, documents, and records to make them available to the DEPARTMENT for auditing at reasonable times.
3. To construct the project and provide such funds, services, and materials as may be necessary to satisfy the terms of said Agreement.
4. To regulate the use of the facility constructed and reserved under this Agreement to assure the use thereof by the public on equal and reasonable terms.
5. To comply with any and all terms of said Agreement including all terms not specifically set forth in the foregoing portions of this Resolution.
BE IT FURTHER RESOLVED that the Mayor of the City of Belding, Michigan, is hereby
authorized to sign the Michigan Natural Resources Trust Fund Development Project Agreement.
Manager Niemela talked about having applied for a grant to improve the Gathering Place that includes seating of five benches, an overlook, and connection to the Fred Meijer Trail. We will be funded for that grant. The total grant amount comes to one hundred ninety-two thousand and three hundred dollars ($192,300.00) The State trust fund will provide up to one hundred forty-two thousand and three hundred ($142,300.00), and the City is responsible up to fifty thousand dollars ($50,000.00). This is the first step in getting some planning started. He talked with Ernie about doing it themselves. A big chunk will be the overlook on the river. The good news is that we received this.
Council Member Meyers thanked the Rec Board for their diligence in going through and writing up the Master Plan, and this is just the beginning of some of what is on their Master Plan for all the different parks we have. He said it was a great job by them, and a lot of good work.

Tom Albert, 3500 Drive, Lowell, Michigan. He offered his congratulations on the DNR Trust Fund grant. He said it will be great for the community. Legislature still has to appropriate the money, but he will probably vote yes. He gave an update on the State budget. Belding School District will receive some money as there was some extra. Some will be going to physical improvement of buildings. Some will be going to school counseling/mental health, and preparing students for jobs. There will be about one hundred fifty million dollars in extra revenue that will go to roads. He said about one hundred fifty million dollars went to the rainy day fund. He personally worked on a bill that became a law a couple weeks ago that changes how we pay our pension debt. He worked on a system to create economic incentives. They created a way to work on this to see what works, what could work better, etc. A very pressing issue in the State of Michigan is that our large carnivores at zoos are not breeding. It’s traumatic to ship old ones to other states. He encouraged City of Belding to contact him if assistance is needed.
Sharon Carlson, Executive Director for Belding Housing Commission. There are funding issues for public housing they are facing in the United States. They only receive Federal monies. It has been in gradual decline. The challenge is how to maintain viability for the future. In 2012 Congress introduced a Demonstration program that filters through HUD, and is called the Rental Assistance Demonstration. The program has had success. Congress has raised the cap a couple of years. In Michigan there are eight agencies on the waiting list. She said they started talking seriously about this, two years ago. A brief summary of the timeline started in January 2017. Looking at what our need is. In April of 2017 submitted a letter of interest to get on the wait list, and if they get approved, she will need staffing to do this. They met with consulting firms. We will not make the 180 day criteria because there are more things to do. They were granted an extension on the financial for September. There are immediate needs, “critical needs”. If we move forward then there will need to be some money established as “emergency” needs. The attorney of the housing commission has met with the City Manager and the Mayor outlining the relationship the Commission and City have. Her request is for City Council to review the handouts she provided, and maybe have a work session with the Council. If a decision is made that this isn’t the right thing, then they would like Council’s support in helping to figure out what would be the right thing.
Manager Niemela said he gave an update to the Rec Board on the Gathering Place project and development of the Kayak launch. Preliminary designs are done. It will be on the east of the current boat launch. They also talked about the use document for the ballfields. They need to get more information from the users; which fields, what they’re using them for, when, etc., and posting a sign at the park so people can view and maybe expand it to all parks for consistency. They are hoping to have some reps from BYBL, but they had conflicts and couldn’t make the meeting. The group is hoping that once their schedule is done maybe they can attend. We are getting close to completing the Front St. garage. Soon they will be putting a sidewalk to the south where the garage is located to dial-a-ride. He said he spent time with Ernie going around town and looking at streets, deciding/confirming where they need to do road improvements. They are trying to do as much as possible on the worst streets. It will come to City Council for approval once a list is made. They need to also look at water and sewer improvements which will also improve roads. He is also requesting vacation time for July 23, 24, 25 and 26.
Council Member Scheid made a motion to approve City Manager’s request for vacation time in July on the 23rd, 24th, 25th, and 26th, supported by Council Member Miller.

Council Member Meyers extended thanks to Sharon. He knows it’s a long process to do this and getting all the information for what they need. He said the Rec Board also discussed usage of City parks. He feels that use of a City Park by different groups and it not always being open to others to use and enjoy shouldn’t be. We need to continue to work on that to make sure it is the case because if it’s not the case, at least for himself to support, to have people put things on City property that is not open to everyone within the City to use and enjoy.
