A meeting of the City Council of the City of Belding, Michigan was convened in open and public session at 7:00 p.m. on Tuesday, August 1, 2017.

 

Council Member Scheid delivered the invocation.

 

The Mayor led the audience in the Pledge of Allegiance.

 

The City Clerk took the roll call:

 

Members Present:        Council Members Brad Miller, Bruce Meyers, Mike Scheid, Douglas Feehan and Ronald Gunderson

 

Members Absent:        None

 

Approval of Agenda

 

Council Member Scheid made a motion to approve the agenda as presented, supported by Council Member Miller.

 

The question on the motion was called and the result of the voting is as follows:

 

            Ayes:               Council Members Miller, Meyers, Scheid, Feehan and Gunderson

            Nays:               None

Consent Agenda

Council Member Scheid made a motion to approve the consent agenda, supported by Council Member Feehan.

C.        Library Board Appointment – term correction – Annette Visser

 

RESOLUTION NO.  2017-08-58

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN CORRECTING THE TERM EXPIRATION DATE FOR ANNETTE VISSER ON THE ALVAH N. BELDING MEMORIAL LIBRARY BOARD.

 

WHEREAS,   Annette Visser was appointed to the Alvah N. Belding Memorial Library Board on March 7, 2017, with a term expiration date of December 31, 2021; and

 

WHEREAS,   the term expiration should have been December 31, 2020.

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan, that the term expiration date for Annette Visser be corrected to December 31, 2020.

 

D.        Library Board Appointment – term correction – Kathleen Lehman

 

RESOLUTION NO.  2017-08-59

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN CORRECTING THE TERM EXPIRATION DATE FOR KATHLEEN LEHMAN ON THE ALVAH N. BELDING MEMORIAL LIBRARY BOARD.

 

WHEREAS,   Kathleen Lehman was appointed to the Alvah N. Belding Memorial Library Board on February 7, 2017, with a term expiration date of December 31, 2020; and

 

WHEREAS,   the term expiration should have been December 31, 2021.

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan, that the term expiration date for Kathleen Lehman be corrected to December 31, 2021.

 

E.        Ionia County Central Dispatch – support for legislative bills

 

RESOLUTION NO. 2017-08-60

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN, REQUESTING SUPPORT FOR MICHIGAN SENATE BILL 400 AND MICHIGAN HOUSE BILL 4651 AMENDING THE EMERGENCY TELEPHONE SERVICES ENABLING ACT.

 

WHEREAS,   Michigan House Bill 4651 and Senate Bill 400 have been introduced in the Michigan Legislature, which would amend Public Act 32 of 1986 entitled the “Emergency Telephone Services Enabling Act”; and

 

WHEREAS,   these bills would amend the funding system for 9-1-1 so that all communication devices that have access to 9-1-1, including prepaid wireless devices, contribute equally to the funding of 9-1-1 operations; and           

 

WHEREAS,   these bills provide a stable funding source for the counties to support their migration to Next Generation 9-1-1 and ongoing operational levels of service for 9-1-1 to its residents; and

 

WHEREAS,   these bills afford the State and Counties collecting 9-1-1 fees a mechanism for court action should any service providers fail to collect and remit the fees; and

 

WHEREAS,   these bills have a mechanism that provides the necessary checks and balances to ensure revenues generated are used for authorized expenditures for 9-1-1 services; and

 

WHEREAS,   these authorized expenditures are limited to those directly related to receiving and processing 9-1-1- calls and the subsequent dispatching of responders via a public safety radio; and

 

WHEREAS,   such limitation of expenditures has historically met the criteria established through the courts to define 9-1-1 surcharge as a fee for service directly related to telephone services; and

 

WHEREAS,   any attempt to amend House Bill 4651 and Senate Bill 400 for other State of Michigan general fund purposes not directly related to 9-1-1 may not meet the criteria of a fee for service and could be viewed as a tax increase for the residents of Ionia County.

 

NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Belding, Michigan does hereby offer our support of House Bill 4651 and Senate Bill 400 as introduced; and

 

BE IT FURTHER RESOLVED, that the City of Belding opposes amending House Bill 4651 and Senate Bill 400 to include any additional State of Michigan taxes on telephone service customers under the guise of 9-1-1 surcharge; and

 

BE IT FURTHER RESOLVED that copies of this resolution be transmitted to Governor Richard Snyder, and all Senators and Representatives serving Ionia County.

 

Reports by Council Liaisons

 

Council Member Miller stated the Planning Commission met on July 25.  They considered an application for a variance on the zoning ordinance on a sidewalk exemption on E. State.  They approved that.  There was a steep hill and a lot of work to get that accomplished.  Selena Moulter had an application for a special land permit for 715 Kiddville.  The building was a rec center and they want to turn it into a banquet facility, which was approved.  They postponed the adoption of the Major Street plan.  They considered a modification to the Sidewalk Exemption policy.  They started a discussion on signs in the public right of way for religious institutions.  They will talk about that.  Sam Mason is the chairman of the Planning Commission.  Jeff Ferman is the vice chairman. 

 

Council Member Meyers stated the Rec Board will meet on August 9.

 

Council Member Scheid stated the Housing Commission is working with NAHRO on building facilities which will take several months.  There are three vacancies.  There is a basement at Taft Court that needs some work. 

 

Council Member Feehan stated the Museum Board is working on “Here Lies Belding”, the cemetery walk scheduled for October.  For the Labor Day weekend, there will be a “Rock at the Bel” community art display.  They would pick up an old record to decorate at the library, or on Wednesday at the Museum from 1-4 p.m.  The records will be displayed on the lawn of the Bel during Labor Day.  They are working on a float.  The Labor Day Committee meeting was cancelled and has not been rescheduled. 

 

Mayor Gunderson stated the Library Board paid bills.  There are issues with the windows on the north wall that will be addressed.  They are working on policies.  The terms were out of whack, so those resolutions were done tonight.  The DDA meeting is tomorrow at 4 p.m.

  1. 2017 Belding Labor Day Celebration

 

The City Clerk read the preamble to the resolution.

 

Council Member Scheid moved the passage of the resolution and the motion was supported by Council Member Feehan.

 

RESOLUTION NO. 2017-08-61

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN GRANTING PERMISSION TO THE BELDING LABOR DAY CELEBRATION COMMITTEE FOR THE USE OF CITY STREETS, CITY PROPERTY AND TO APPROVE EVENTS, GRANT A NOISE VARIANCE AND  GRANT A WAIVER OF ORDINANCE #424.

 

WHEREAS,   the Belding Labor Day Celebration Committee requests permission from the City of Belding for the use of the south section of the East Mall Parking Lot for midway attractions beginning at 8 a.m. on Thursday, August 31, 2017  and the north section of the lot beginning at 5 p.m., on Thursday, August 31, 2017 through Monday, September 4, 2017 at midnight, and the vacant city lot on the SW corner of Bridge and Congress Streets to accommodate a tent and entertainment stage and emergency parking from Thursday, August 31, 2017 at 5 p.m. until Tuesday, September 5, 2017; and

 

WHEREAS,   permission is requested to use Congress Street, from Bridge to Pleasant Streets for Belding Fire and Police Department access from Thursday, August 31, 2017 through Monday, September 4, 2017; and

 

WHEREAS,   permission is requested to use Central Riverside Park for the Fireworks

Spectacular on Sunday, September 3, 2017, with a rain date of Monday, September 4, 2017; and

 

WHEREAS,   permission is requested to use Central Riverside Park restroom facilities and a portion of the Gibson Lot for carnival personnel storage and camping from Tuesday, August 29, 2017 to Wednesday, September 6, 2017; and

 

WHEREAS,   permission is requested to use Main Street, between Bridge Street and Hanover Street, from 7 a.m. to 6 p.m. on Saturday, September 2, 2017; and

 

WHEREAS,   permission is requested to close Bridge Street, from Depot to Washington  Streets from Saturday, September 2, 2017 at 7 a.m. through midnight on Sunday, September 3, 2017 at midnight, to provide for a car show on Saturday and craft booths and vendors on Saturday and Sunday, with temporary openings for parades on Friday, Saturday and Monday; and

 

WHEREAS,   permission is requested for the Twilight and Labor Day Parades to begin at Bridge and High Streets, continuing on Bridge St. to E. Ann Street; and

 

WHEREAS,   permission is requested to stage the Twilight Parade on High Street and the Labor Day Parade on High, Riverside, Morton, Gooding and Reed Streets; and 

 

WHEREAS,   permission is requested for the Saturday Kiddie Parade to use Bridge Street, from Depot Street to Washington Street, beginning at 10:00 a.m. on Saturday, September 2, 2017; and

 

WHEREAS,   permission is requested for a permit for a fireworks display for the Annual Labor Day Celebration, to be held on city owned property at Central Riverside Park; and,

 

WHEREAS,   permission is requested for a noise variance until 12:00 a.m. from September 1, 2017 through September 4, 2017; and,

 

WHEREAS,   permission is granted for a waiver of Ordinance #424 to vendors in the East Mall Parking Lot, West Mall Parking Lot, Bridge Street and the vacant lot on the SW corner of Bridge Street and Congress Street; and,

 

WHEREAS,   permission is requested to use city streets for a Spectrum Health 5K Run.

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that the preceding requests are hereby granted in their entirety.

City Manager Comments

 

The mayor read a statement from the city manager, who is currently on leave with medical issues. 

Council Comments

 

Council Member Scheid stated because of his work schedule, he will resign his post as council liaison to the Housing Commission.  He will try to get to the meetings as soon as he can. 

 

Council Member Meyers stated he would be the Housing Commission liaison.

 

Council Member Scheid made a motion that Bruce Meyers act as the Housing Commission liaison, supported by Council Member Feehan. 

 

The question on the motion was called and the result of the voting is as follows:

 

            Ayes:               Council Members Miller, Meyers, Scheid, Feehan and Gunderson

            Nays:               None

 

Council Member Meyers wished Bruce well, and stated their prayers are with him. 

 

Mayor Gunderson stated he would echo the same thing.

 

Adjournment

 

Council Member Scheid moved to adjourn the meeting, supported by Council Member Miller.
