A meeting of the City Council of the City of Belding, Michigan was convened in open and public session at 7:00 p.m. on Tuesday, October 4, 2016.
Mayor Gunderson delivered the invocation.
The Mayor led the audience in the Pledge of Allegiance.
The City Clerk took the roll call:
Members Present: Council Members Brad Miller, Tom Jones and Ronald Gunderson
Members Absent: Council Members Douglas Feehan and Mike Scheid
Council Member Jones made a motion to excuse Council Members Feehan and Scheid from the meeting per Section 4.5(f) of the city charter, supported by Council Member Miller.
The question on the motion was called and the result of the voting is as follows:

Nays: None
Council Member Jones made a motion to approve the agenda as presented, supported by Council Member Miller.
Mayor Gunderson stated Mr. Brown would like to go into closed session for the evaluation.

Approve Chemical Bank Checks 6977 to 6982 in the amount of $201,459.96
Council Member Miller made a motion to approve the consent agenda, supported by Council Member Jones.

Following are the resolutions contained in the Consent Agenda.
C. “B Foundation Flow Walk/Run” use of city streets approval
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AUTHORIZING THE USE OF CITY STREETS AND GRANTING A NOISE CONTROL SUSPENSION FOR A 5K RUN/WALK TO SUPPORT THE “B” FOUNDATION.
WHEREAS, a request was received to use city streets after a Belding High School football game for a 5K Run/Walk to support the “B” Foundation on October 14, 2016 from 9:45 to 11:45 p.m.; and
WHEREAS, the route will include Hall, E. Washington, Hanover, Congress, Broas, Depot, N. Bridge, W. Ellis to the Candlestone drive; and
WHEREAS, W. Ellis to Storey Rd. (M-91) will be closed during the race; and
WHEREAS, intersections along the route will be blocked by barricades and guarded by volunteers and Police Department full time and reserve officers; and
WHEREAS, the Belding Code of Ordinances Section 34, Article IV Noise Control, Section 34-76 and 34-77 will be suspended for the event.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that the designated city streets may be used for a 5K Run/Walk on October 14, 2016 to benefit the “B” Foundation from 9:45 p.m. to 11:45 p.m.; and
BE IT FURTHER RESOLVED that Belding Code of Ordinances Section 34, Article IV Noise Control, Section 34-76 and 34-77 is suspended for the event.
D. “B Foundation Glow Walk/Run” DART shuttle service approval
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AUTHORIZING THE USE OF BELDING DIAL-A-RIDE BUSES FOR SHUTTLE SERVICE.
WHEREAS, a request was received to use a City of Belding Dial-A-Ride bus to shuttle participants for the “B Foundation Glow Walk/Run” from Candlestone Golf Resort to Rudness Field.; and
WHEREAS, one City of Belding Dial-A-Ride staff will donate their time and expertise to transport the participants.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that the City of Belding Dial-A-Ride buses may be used for transporting participants for the “B Foundation Glow Walk/Run” on October 14, 2016.
E. Belding Band Invitational use of city streets and noise ordinance suspension
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AUTHORIZING THE TEMPORARY CLOSURE OF WILSON STREET AND SUSPENSION OF THE BELDING CODE OF ORDINANCES SECTION 34, ARTICLE IV – NOISE CONTROL, SECTIONS 34-76 AND 34-77 FOR THE BELDING BAND INVITATIONAL.
WHEREAS, the Belding High School is sponsoring the Belding Band Invitational at Rudness Field on Saturday, October 15, 2016 from 12 noon to 10 p.m.; and
WHEREAS, a request was received to temporarily close Wilson Street between E. Washington and Center Streets from 9 a.m. until 10 p.m. to provide space for the bands and their support vehicles and equipment; and
WHEREAS, a request was received to temporarily suspend Belding Code of Ordinances Section 34, Article IV – Noise Control, Sections 34-76 and 34-77 for the event.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that Wilson Street, between E. Washington and Center Streets be temporarily closed and the Belding Code of Ordinances for noise control be temporarily suspended for the Belding High School Band Invitational on Saturday, October 15, 2016 from 9 a.m. to 10 p.m.
F. Appointment to Historic District Commission – Chris Breimayer
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPOINTING CHRIS BREIMAYER TO THE HISTORIC DISTRICT COMMISSION.
WHEREAS, Chris Breimayer has previously served on the Historic District Commission, and is willing to serve another term on the commission.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Belding hereby appoints Chris Breimayer to the Historic District Commission with a term to expire on October 4, 2019
G. Appointment to Historic District Study Committee – Ronald Gunderson
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPOINTING RONALD GUNDERSON TO THE LOCAL HISTORIC DISTRICT STUDY COMMITTEE.
WHEREAS, the City of Belding does support historic preservation activities in the community with the purpose to safeguard heritage; stabilize and improve property values; foster civic beauty; strengthen local economy; and promote education, pleasure and welfare of its residents; and
WHEREAS, the State of Michigan through its State Historic Preservation Office and the adoption of Public Act 169, as amended, does also support historic preservation by many various activities; and
WHEREAS, one of the activities that does support Historic Preservation and all of its benefits has been determined to be through the formation of Local Historic Districts; and
WHEREAS, in establishing a Local Historic District as described in the Public Act 169, as amended, it does require that the local governing body establish a Local Historic District Study Committee; and
WHEREAS, within the Public Act 169, as amended, specific guidelines are outlined as to how to form a Local Historic District Study Committee; and
WHEREAS, the State Historic Preservation Office does provide a Manual and technical assistance as to how to form a Local Historic District Study Committee through member appointments; and
WHEREAS, local residents have called upon the City of Belding to established a Local Historic District to preserve historic structures located within the City of Belding; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Belding authorized the formation of a local historic district study committee; and
BE IT FURTHER RESOLVED that the City Council of the City of Belding appoints Ronald Gunderson to the Local Historic District Study Committee.
H. Appointment to Historic District Study Committee – Renee Reed
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPOINTING RENEE REED TO THE LOCAL HISTORIC DISTRICT STUDY COMMITTEE.
WHEREAS, the City of Belding does support historic preservation activities in the community with the purpose to safeguard heritage; stabilize and improve property values; foster civic beauty; strengthen local economy; and promote education, pleasure and welfare of its residents; and
WHEREAS, the State of Michigan through its State Historic Preservation Office and the adoption of Public Act 169, as amended, does also support historic preservation by many various activities; and
WHEREAS, one of the activities that does support Historic Preservation and all of its benefits has been determined to be through the formation of Local Historic Districts; and

J. Disposal of surplus property
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN DECLARING CITY-OWNED PROPERTY AS SURPLUS PROPERTY.
WHEREAS, Section 2.392 of Chapter 2 of the Code of the City of Belding states that City Council may declare city-owned property that is no longer needed as surplus; and,
WHEREAS, the surplus property may be sold through an online bid process.
NOW, THEREFORE, BE IT RESOLVED by the City Council that the following City-owned property be declared as surplus and sold through an online bid process:

K. Appointment to Library Board – Robert Ware
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN, APPOINTING ROBERT WARE TO THE ALVAH N. BELDING MEMORIAL LIBRARY BOARD.
WHEREAS, the City Council of the City of Belding, Michigan, desires to fill the term of Maria Jimenez; and,
WHEREAS, the City Council desires to appoint Robert Ware as a member of the Library Board; and,
WHEREAS, the Alvah N. Belding Memorial Library Board members have recommended the appointment of Robert Ware to this board; and,
WHEREAS, City Council has determined that Robert Ware meets the eligibility requirements for appointment to the Library Board as set forth in the City Charter, Section 4.4(f).
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan, that Robert Ware be, and the same hereby is, appointed as member of the Alvah N. Belding Memorial Library Board with a term to expire on December 31, 2017.
Council Member Miller stated the next Historic District Commission meeting is on the third Thursday.
Council Member Jones stated the Planning Commission met on September 27 and approved a formal policy for sidewalk exemption. A public hearing is scheduled for October 23 for Dave Scheid on a special use permit on W. State. Bruce has started on the zoning ordinance revision. He distributed the first three chapters for them to look over and give him input. He will present a couple more sections at the next meeting.
Mayor Gunderson stated the Library Board has put policies into place regarding children who were unattended during the summer. More policies are on the way.
There was no unfinished business.
Council Member Jones made a motion to bring the issue to the floor, supported by Council Member Miller.
Council Member Miller made a motion to go into closed session at 7:07 p.m., supported by Board Member Jones.

Mayor Gunderson stated Bruce Brown had his evaluation, and council gave him a superior rating. He has exceeded expectations, and they are very pleased and feel very fortunate to have him.
Cort Hile stated this is Mr. Jones last meeting and they are personal friends. They moved here in 1975 and the Jones befriended them and it grew from there. Tom ran a business in the proper way, and served on the school board and city council. With his business, he interrupted his schedule to take care of whatever they needed. He thanked Tom for all the services to the community.
City Manager Brown had no comments.
Council Member Jones stated he was glad Robert Ware went back on the Library Board. He is a good person on there. He knows finances. He stated it was with regret that he is tendering his resignation on October 15 as city council member. Two places are too much to take care of and their heart was in the cottage. With Bruce’s guidance they have reversed the tension in the community and made it a better place to live. He appreciates his work. He hopes the city council can keep the politics out of the city council chamber and remember that even though they don’t get their way on a particular vote, that is the democratic process. Once the voting is done, he was ready to support what was done at the city council meeting. One reason he got on the city council was there were too many grudges as a reason to get on council. He wanted to move Belding forward, and get progression. He has heard a lot of complaints about the amount of residential taxes. People have to realize it is industry and business that pay the bills in the community. They have to work to get industry and business in town. They support the local community as they ultimately pay the tax bill. As city manager and council, DDA and Chamber of Commerce, they should work together to get those two areas growing in this town. With Bruce revising some of the zoning to make it more user friendly for the community, he has made big changes. He is really glad he has been here. He wished to thank his wife, as she kept saying no. He told those wanting him to serve to convince Maggie, and he thanked her for finally saying yes to him serving. If he was not moving, they would have another name on the ballot. He thanked everyone for their support. He thanked Ron for being mayor. He has done an excellent job, and has taken a lot of abuse from the audience from time to time. He respects him with his whole heart for what he has put into it. He stated Brad would be a very good council member and wished him luck on the election. He thanked the city staff who put their whole heart into the thing and Kareen for the work she does for Bruce.
Council Member Miller thanked everyone who stayed during the closed session. It is great to have Bruce on board and he thanked him for moving the City of Belding forward. They are moving in the right direction. He thanked Tom for his wisdom and leadership. He lost to the solo cup of destiny. Everything happens for a reason. Tom has done a lot for the community that maybe he couldn’t have done. He thanked Tom for his commitment. It is a thankless job and someone has to be motivated for the community. He was a great peer.
Mayor Gunderson thanked Bruce for being on board. He received a superior rating. The members that were absent would also support that. He thanked everyone for coming. He stated he and Tom had the agreement they would not agree every time. They go back ten years. They would call each other up and agree not to agree. He has been professional and very well mannered. As council, they are held to a higher standard and he has been able to do that. Tom has been through the school system and city council, being through more than he has. Tom has endured through circumstances they hope they don’t see again. They are not on council for their agenda, but for the residents of the community. Tom has held his position with high esteem. He thanked Tom for his time and said he would be missed.
Council Member Miller moved to adjourn the meeting, supported by Council Member Jones.
