A meeting of the City Council of the City of Belding, Michigan was convened in open and public session at 7:00 p.m. on Tuesday, October 20, 2015.

 

Council Member Jones delivered the invocation.

 

The Mayor led the audience in the Pledge of Allegiance.

D.        Temporary Street Closure for Halloween Event

 

RESOLUTION NO. 2015-10-76

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN SUPPORTING THE FIRE DEPARTMENT’S REQUEST TO TEMPORARILY CLOSE A PORTION OF WEST CONGRESS STREET FOR THE FIRE DEPARTMENT’S ANNUAL HALLOWEEN PARTY AND OPEN HOUSE.

 

WHEREAS,   the Belding Fire Department would like to temporarily close West Congress Street from Bridge Street to Pleasant Street on Saturday October 31, 2015 from 5:00 P.M. until 9:00 P.M. for the purpose of hosting their annual Halloween Party and Open House.

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Belding, Michigan supports the temporary closure of West Congress Street.

 

E.        Appointment of John LaClear to a full term on the Planning Commission

 

RESOLUTION NO. 2015-10-77

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN

APPOINTING JOHN LACLEAR TO THE PLANNING COMMISSION.

 

WHEREAS,               John LaClear was appointed to the Planning Commission to fill a vacancy that would exist on the Planning Commission with the resignation of Max Gibbs Jr., to expire on January 3, 2016; and     

 

WHEREAS,               Max Gibbs Jr. has indicated that he will fulfill his term until January 3, 2016, as there are still vacancies on the Planning Commission.

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that John LaClear be appointed to a full term on the Planning Commission to expire on October 20, 2018.

 

F.         Appointment of Ken Krueger as Alternate for Prop. Maint. Code BOA

 

RESOLUTION NO. 2015-10-78

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN  APPOINTING KEN KRUEGER TO THE PROPERTY MAINTENANCE CODE BOARD OF APPEALS AS AN ALTERNATE MEMBER.

 

WHEREAS,    the City of Belding enforces the Property Maintenance Code; and 

 

WHEREAS,   in order to provide these inspections a Property Maintenance Code Board of Appeals must be in place; and

 

WHEREAS,   Ken Krueger has indicated his willingness to serve another term on the board as an alternate member with a term to expire on October 20, 2018.

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that Ken Krueger be appointed to the Property Maintenance Code Board of Appeals as an alternate member.

 

G.        Surplus Property Disposal

 

RESOLUTION NO. 2015-10-79

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN DECLARING CITY-OWNED PROPERTY AS SURPLUS PROPERTY.

 

WHEREAS,   Section 2.392 of Chapter 2 of the Code of the City of Belding states that City Council may declare city-owned property that is no longer needed as surplus; and,

 

WHEREAS,   the surplus property may be sold through an online bid process.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council that the City-owned property be declared as surplus and sold through an online bid process.

 

H.        Water Service Policy Report

 

This statement is a compilation of pertinent requirements related to water service in the City of Belding.  It shall be superseded by those requirements contained in the City Charter and the City Code of Ordinances.

 

Chapters 13 and 15 of the City Charter grant to the City Council authority to require installation and control of public utilities, including water services, to the city. Each person desiring to connect to the city’s water system shall pay a charge for the privilege, such charge to be set by the City Council.

Regulations related to water service are found in the Code of Ordinances:

 

·         Application for water service is made to the Department of Public Works by the property owner on forms provided by the department (Section 86-26)

 

·         Water service is installed following the receipt of the required connection fee and meter installation fee.(Section 86-27)

 

·         The City Manager may make and issue rules related to the water system (Section 86-39)

 

·         The city is responsible for the operation, maintenance and repair of water mains and appurtenances up to the curbside of property receiving the service. The customer is responsible for the maintenance and repair of the service laterals and water mains from curbside to the structure  and within the structure receiving the service.

 

·         Water charges are billed quarterly on the first of March, June, September and December to the owner of the property. They are due and payable on the 30th day of the month in which they are billed. If charges are not paid on or before the due date, then a penalty of 10% is assessed on the unpaid balance and added to the bill. A 15 day grace period following the due date of the 30th of the month is allowed for payment. If payment is not received, then a water shutoff notice is issued to the owner of the property, a $75.00 shut off-fee added to the bill, and the service discontinued. Services so discontinued shall not be restored until all sums then due and owing, including penalties, shall be paid in full, plus a shut-off and turn-on charge. Partial payment does not cancel the shut off. (Section 86-201b)

 

o       The Public Works Department may, at its discretion, elect to suspend a shut off action due to severe winter weather, or when in its opinion, a discontinuance of service would threaten the ability of the city to provide water service due to potential frozen laterals from the point of city service to the structure. During these periods of suspended shut-off action customers are encouraged to allow water to run in their residence to prevent the potential loss of service.

 

o       No additional extensions will be authorized for payment of the water bill.

 

·         Delinquent charges for an unpaid water bill shall be considered a lien on the property. Charges that are delinquent for six months or more, will be certified as such and added to the next tax role against the premises (Section 86-202)

 

·         Property owners have the right to appeal the basis for any charges levied for water service. Appeals are to be directed to the City Clerk in writing along with any supporting documentation needed to illustrate the issue. Resolution of appeals shall be made within 30 days of the filing of the appeal with the City Clerk. In no event shall appeals be accepted that would require a variance in the methods of charge calculations established and in force. All bills for water service outstanding during this process, including all penalties and delinquency charges, shall be due and payable. Pending resolution of the appeal,  the Finance Department shall adjust charges accordingly, including any refunds due. Refunds shall be retroactive to the previous four quarters billing only (Section 86-207)

I.          Sidewalk Policy Report

 

This statement is a compilation of pertinent requirements related to sidewalks in the City of Belding. It shall be superseded by those requirements contained in the City Charter and the City Code of ordinances.

 

It is the policy of the City of Belding that sidewalks be installed on every property within the city limits abutting a public street.

 

The City Charter contains verbiage in Chapter 3 that allows the City Council to “require owners of real property to build and maintain public sidewalks in the area of streets immediately adjacent to such property and, upon failure of any owner to do so, construct and maintain such sidewalks and assessing the cost thereof against the property as a special assessment”.

 

This wording, in and of itself, is not “implementing” and required that the City Council enact an ordinance specifically requiring sidewalks for all properties on a city-wide basis. That was accomplished when the City Council adopted the Zoning Ordinance (Chapter 98 of the Code of Ordinances) as every zoning district requires that sidewalks be built on “all sides of the property abutting a public street”. The Subdivision Ordinance (Chapter 78 of the Code of Ordinances) also requires that sidewalks be built for projects approved under it provisions.

 

Properties that did not have sidewalks at the time of adoption of the Zoning Ordinance became “Non-Conforming”. They could continue as such until such time as a change was made to the property (change or modification of a building, structure, lot or use) then the property would lose its non-conforming status and the entire property would have to be in conformity with the provisions of the Zoning Ordinance (usually involves the paving of driveways and installation of sidewalks).

 

The Zoning Ordinance allows for an appeal of its provision s to the Zoning Board of Appeals.

 

Two other sections of the Code of Ordinances have provisions pertaining to the sidewalk issue:

 

            CHAPTER 70

·         Assessment process that would be followed if the city installed the sidewalks and assessed the costs and expenses therefore back to the property owner.

CHAPTER 74

 

·         City Manager has general supervision and control of all sidewalks and the construction and maintenance thereof.

·         City Council, by resolution, can declare a necessity for and direct the installation of sidewalks anywhere in the city.

·         City Manager can declare a sidewalk to be unsafe and have the City Council, by resolution, order it repaired or replaced.

·         The property owner may install or repair the sidewalk themselves – at city standards.

·         If the property owner has the city install the sidewalk, they are responsible for reimbursement to the city all costs and expenses associated with the project. If the property owner fails to reimburse the city, the costs thereof are assessed as a penalty and interest of 1% per month from the date of the repair or installation.

·         The City Council may, at its discretion, agree to share in a portion of the cost of constructing, rebuilding or repairing sidewalks.

·         No occupant or owner of any premises or property shall fail to keep sidewalks in front or adjacent to such premises or property clear of ice and/or snow, so far as to facilitate pedestrians.

L.        Appointment of Bruce Brown to the DDA

 

RESOLUTION NO. 2015-10-80

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPOINTING BRUCE BROWN TO THE DDA BOARD.

 

WHEREAS,    a vacancy exists on the Downtown Development Authority due to the resignation of Ronald Gunderson; and         

 

WHEREAS,   Downtown Development Authority Act 197 of 1975 states the Chief Executive Officer, being the mayor or city manager, will serve on the board;

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that City Manager Bruce Brown be appointed to the DDA with a term of office to expire on December 3, 2017.

 

Reports by Council Liaisons

 

Council Member Jones reported that the Planning Commission’s next meeting is 10/27/15, and a special meeting scheduled for Monday, November 2 to handle the Vietnam Memorial request.  

 

Council Member Scheid reported that the housing commission hasn’t had a meeting for since the last meeting the Council had. There was talk about the next meeting date being changed but he said he hasn’t heard anything yet.

 

Council Member Lallo had nothing to report.

 

Council Member Cooper reported that the Rec Board meeting was productive. The bulk of the discussion was about the fee schedule and some other issues like the location of the dog park and hopefully they can get that hammered out.

 

Mayor Gunderson gave the Library report. He said there had been three interviews for head librarian position and they are moving ahead with that. There will be an open house for Betty Jenkins this Friday, October 23 from 2-4. She has been there for forty years.

Council Member Scheid  made a motion to bring this item to the floor, supported by Council Member Cooper.

 

Discussion:

 

Council Member Cooper said there was check for nearly eleven hundred dollars for service from G&D Electric.  He called the two businesses in town, and one was a little upset and wants to talk. The other one didn’t get an opportunity to service and he’s a master electrician right around the corner from Parts Plus. Dennis is hoping the City gets that straightened out.  He said he can’t support the passing of this.

 

Council Member Scheid said he understands where he’s coming from. Unfortunately it went the way it did.

 

Council Member Lallo asked Manager Brown if there is a policy or history why they didn’t go through those individuals. Manager Brown said there is a history with one but didn’t feel this was the place to discuss it. He’d rather talk to him. Council Member Cooper said the other one is fairly new in town but is a Master electrician, and he will get a hold of Hansen and get his number so that City Manager Brown can speak with him.

Item H. Water Service Policy Report

 

Council Member Jones made a motion to bring this item to the floor, supported by Council Member Scheid.

 

Discussion:

 

Council Member Cooper said he had two issues. The biggest issue was the bottom half of it, with the discretion of the Department of Public Works to shut off discontinued service. Essentially it’s talks about cutting off from curbside to the house. In case that freezes it could jeopardize service to the other houses. He’s not sure that would happen but his issue is the tenant issue. There are people in our community who own pieces of property and if tenants aren’t paying their rent or their water bill and the water bill doesn’t get shut off then we can’t get the tenant out of the property. Then it leaves a water bill that the property owner is on the hook for, when in fact, this should be shut off by the City.

 

Council Member Jones said to make sure both tenant and owner are notified in case of non-payment. City Manager Brown talked about other landlords outside the city whose tenant moved and he didn’t know it but found the water bill kept rising. He wants us to do away with it but it’s not our job to monitor and take a look at others’ property; it’s the landlord’s job.

 

Council Member Jones said he’d like us to look into a way when this happens to notify owner if tenant is not paying; when it goes into arrears. City Manager Brown said they could do that.

 

Council Member Scheid said when someone comes in to get the water hooked up there should be a line item for owner’s name and contact information of owner. Manager Brown said that on the form they use there is a sentence that says, “You are responsible for whatever happens regarding the utility.” Councilman Scheid feels we should still include contact information for whoever owns it, that way if the renter doesn’t pay it we can call the owner and say “this is the problem, do you want us to shut the water off.”  He doesn’t see what problem there should be if water main is shut off. Mayor Gunderson says it would on a dead end.  Councilman Cooper says he doesn’t understand why they can’t just shut the water off. Mayor Gunderson said they’re trying to get everything in property owner’s name, that way the bills will go to them and the notices will go to them. Because they are responsible for the property and that’s what City Hall has been working on.

 

Council Member Lallo had no comment.

 

Council Member Cooper is concerned and wouldn’t want to have property here with this policy. Mayor Gunderson said that it’s been in place, and this is just information for us. Councilman Cooper said he understands that but he feels it shouldn’t affect other properties to shut my property water off.  He gave an example of his folks owning eight or nine different rental properties and they could end up with a huge bill. Councilman Scheid asked for clarification on the dead end; if that’s where the run stops. Mayor Gunderson clarified that.

Public Comments

 

Jeff Hunter, 6202 Zahm Road, stated he wants to know what information the City has gathered regarding no fluoride in the water. He asked if anyone is going to give the information/findings to the public. He is upset because the City isn’t telling the citizens.

 

Dave Hodges, Ionia County Commission, stated that so far this month they’ve had two Commission meetings. October 13th was their yearly budget hearing. He has expressed to some of the Council Members the size of the budget of the County. Being a former school board member he said he knows the revenues that it takes to run our school district. He assumed the County would need more money than that, but he was wrong. Their budget this year is just over nine million dollars, and if you add in the grant monies and federal monies they come up with 12.3 million dollars. In that budget all the employees got a 1% raise in January and 1% raise in July. The Board got no increase but we do it because we love and not for the money. He said they had to use about ninety-six thousand dollars out of the fund equity for extending the Four H director’s position from a halftime to a full time. Years ago it used to be fulltime and then it was cut back which effects a lot of kids in the county so we are hoping to get that built back up. We also had to pay for a halftime police officer that was added for Otisco Township. They had a dedicated officer halftime and it’s going to rotate for the County. The fund equity for the County right now is at 18%, so pretty healthy. They covered other items at that meeting such as giving money to the County to do drug testing to be sure people are staying off drugs.  We got a hundred twenty thousand dollars this year and that’s up from a hundred and twelve thousand last year. To keep this in perspective, they use all the money because each test is twenty dollars. It tells you they run a lot of tests. Another thing they did was actually buy from the City of Ionia the lot where the new maintenance building will be built on. It cost one dollar, and will start in the spring. Dave Scheid construction from Belding is going to build it; it’s phase one of the new facilities for the County. There will also be a new building connected to the court house and it’ll have the Friend of the Court in there, and they’ll move some of the courts around and then they’ll have a one-stop security. Right now the Friend of the Court has no security at all. They also filled several committees with new members. They had a meeting today where department heads come and give their quarterly reports.

Council Member Lallo said the Rec Board had a nice discussion and he feels it’s nice what they do for us. He also thanked Police Chief Dale because there were solicitors who were going throughout the City and they were from Direct Energy. Any solicitors coming door to door have to check with the City first and they have to have a solicitors badge with the City logo on it. If they don’t have the badge you don’t have to talk to them. He cautioned people about solicitors coming to the door.

 

Council Member Cooper stated he is disappointed with the water policy, and he thank everyone for coming tonight.

 

Council Member Jones thanked Bruce for his work with getting the Vietnam Memorial paperwork done. He also gave a general thanks to all staff, DPW, Police, secretaries who take the notes, even when they don’t feel well.

 

Mayor Gunderson thanked everyone for coming.

 

Council Member Scheid said he did want to mention the Enbody gentleman who works for DPW. Councilman Scheid said he had a citizen call him and wanted him to forward a thank you to Mr. Enbody because he was very nice, gentlemanly, took care of everything and offered the citizen to call him back in on Friday if they needed anything else because he would be on duty all day.

 

Adjournment

 

Council Member Scheid  moved to adjourn the meeting, supported by Council Member Lallo.

 

The question on the motion was called and the result of the voting is as follows:

 

Ayes:               Council Members Cooper, Scheid, Lallo, Jones and Gunderson.

            Nays:               None.

           

The Mayor adjourned the meeting at 7:27 p.m.
