Motions

 

A meeting of the City Council of the City of Belding, Michigan was convened in open and public session at 7:00 p.m. on Tuesday, October 6, 2015.

 

Mayor Protem Jones delivered the invocation.

 

The Mayor Protem led the audience in the Pledge of Allegiance.

 

The City Clerk took the roll call:

 

Members Present:        Council Members Dennis Cooper, Mike Scheid, Jerome Lallo and Tom Jones

 

Members Absent:        Council Member Ronald Gunderson

 

Council Member Scheid made a motion to excuse Council Member Gunderson from the meeting, per Section 4.5(f) of the City Charter, supported by Council Member Cooper.

Approval of Agenda

 

Mayor Protem Jones asked to move Item C of the Consent Agenda to New Business.

 

Council Member Scheid made a motion to approve the agenda as amended, supported by Council Member Cooper.

E.        Belding Band Invitational – Temporary Street Closure

 

RESOLUTION NO. 2015-10-72

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AUTHORIZING THE TEMPORARY CLOSURE OF WILSON STREET AND SUSPENSION OF THE BELDING CODE OF ORDINANCES SECTION 34, ARTICLE IV – NOISE CONTROL, SECTIONS 34-76 AND 34-77 FOR THE BELDING BAND INVITATIONAL. 

 

WHEREAS,   the Belding High School is sponsoring the Belding Band Invitational at Rudness Field on Saturday, October 17, 2015 from 12 noon to 10 p.m.; and

 

WHEREAS,   a request was received to temporarily close Wilson Street between E. Washington and Center Streets from 12 noon until 10 p.m. to provide space for the bands and their support vehicles and equipment; and

 

WHEREAS,   a request was received to temporarily suspend Belding Code of Ordinances Section 34, Article IV – Noise Control, Sections 34-76 and 34-77 for the event.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that Wilson Street, between E. Washington and Center Streets be temporarily closed and the Belding Code of Ordinances for noise control be temporarily suspended for the Belding High School Band Competition on Saturday, October 17, 2015 from 12 noon to 10 p.m.

 

F.         Appointments to the Historic District Commission

 

RESOLUTION NO. 2015-10-73

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPOINTING THE MEMBERS OF THE HISTORIC DISTRICT COMMISSION.

 

WHEREAS,   authority to appoint members to a Historic District Commission was established by Ordinance;

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Belding has authorized the reformation of the Historic District Commission; and 

 

BE IT FURTHER RESOLVED that the City Council of the City of Belding appoints the following individuals with the terms of office to the Historic District Commission:

G.        Appointment of John LaClear to the Planning Commission

 

RESOLUTION NO. 2015-10-74

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPOINTING JOHN LACLEAR TO THE PLANNING COMMISSION.

 

WHEREAS,   a vacancy will exist on the Planning Commission with the resignation of Max Gibbs Jr.; and        

 

WHEREAS,   John LaClear has indicated that he is interested in serving a term on the commission.

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that John LaClear be appointed to the Planning Commission to fill the unexpired term of Max Gibbs Jr. until January 3, 2016.

 

H.        Appointment of David Mierendorf to the Construction Board of Appeals

 

RESOLUTION NO. 2015-10-75

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPOINTING DAVID MIERENDORF AS A MEMBER OF THE CONSTRUCTION BOARD OF APPEALS.

 

WHEREAS,   the term of office for David Mierendorf on the Construction Board of Appeals has expired; and

 

WHEREAS,   David Mierendorf has indicated that he is interested in serving another term on the Construction Board of Appeals.

 

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that David Mierendorf is appointed as a member to the Construction Board of Appeals with a term to expire on October 6, 2018.

 

Reports by Council Liaisons

 

Council Member Cooper stated there was no Rec Board meeting.

 

Council Member Scheid stated the Housing Commission met last month.  The next meeting will be two weeks from Thursday.  There were three vacancies, but one may be rented.  There was a discussion on things to do in the future at Taft Court. 

 

Council Member Lallo stated the Museum Board met and the barn quilts have been delivered.  Bruce Feuerstein will have one. 

 

Council Member Jones stated the Planning Commission recommended the rezoning of 100 East Main to PR from RM-1.  They recommended the appointment of John LaClear to the Planning Commission.  There was a discussion on the Vietnam Wall and Dennis was there.  Bruce will expedite the process as soon as possible for the permits, so they can resume construction.  They discussed the consulting services and the sidewalk policy.

New Business

 

A.        Approval of Fee Structure for Parks Rental Agreement

 

RESOLUTION NO. 2015-10-71

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AUTHORIZING THE IMPLEMENTATION OF A REVISED PARK RENTAL AGREEMENT WHICH INCLUDES FEES ASSOCIATED.

 

WHEREAS,   city staff has concluded that a fee structure should be implemented to the park rental agreements to benefit both city residents and the city park budget; and

 

WHEREAS,   the revised agreement would be executed on January 1, 2016.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that the City of Belding implement and execute a revised park rental agreement which now includes a fee.

 

Council Member Cooper made a motion to approve Resolution No. 2015-10-71, seconded by Council Member Lallo. 

 

Keven Krieger stated vandalism is getting pretty bad in the parks, and the parks budget is slim.  They have been planning this for a couple of years.  He checked with other cities.  In Belding, they use the pavilions free of charge for all day.  A lot of people are from out of town.  Most cities charge for their pavilions and parks, and Belding does not.  He called Portland, Sparta, Rockford, Cedar Springs, Greenville, Ionia and Wyoming.  The fee may range from $24 to $40 for four hours.  The city could still do the all-day rental, which would be $20 for an in town resident, which is very affordable.  There would be a $30 fee for non-resident.    

 

A lengthy discussion was held with the following points clarified:

 

Residents are not given preference.  Reservations are taken on a first come, first basis starting January 1 or each year. 

 

Money collected would be earmarked to the Park Fund.

 

The signage at the park entrances does include the number to call for reservations, but the wording could be expanded.  A person reserving a pavilion does get a copy of the reservation form.     

 

It is not believed that the groups using the facilities are causing vandalism. 

 

Council Member Lallo stated his concern was they should do it across the board, like Demorest, and not for just certain parks.  His other concern would be that they may be telling people not to come to town?

 

Mr. Krieger stated anyone could still come here for $30 for all day.

 

Council Member Lallo asked where the money came from that the city put toward the flower beds?

 

Mayor Protem Jones stated there was a memorial with funds that the Garden Club uses to plant flowers.

 

City Manager Brown stated about $7,600 was spent this year.  Most was for removing landscaping and replacing it with grass.  $5,000 was involved with cleaning up Bridge Street.  He brought Craig in to help clean up the beds before Labor Day.   

 

Council Member Lallo stated some of that money could be allocated toward parks next year. 

 

Council Member Cooper stated the flower bed situation was a one-time thing, not an annual basis.    

 

City Manager Brown stated the parks budget was cut this year and they were given the Electrolux property to mow. 

 

Mr. Krieger stated it would not be a huge money maker, possibly $2,500 to $3,500 a season. 

 

Council Member Cooper stated it would just be sustainability.

 

Council Member Lallo stated there would be a lot of resistance.  He asked if people from out of town were using Demorest?

 

Mayor Protem Jones stated there is a person that wants to set up a program next year.  He would expect by next spring there would be a recommendation for a fee structure for Demorest, at that point.  They have not had any regular league play, other than Little League.  The Rec Board should address that by spring, regarding the people forming the league.      

 

Mr. Krieger stated he could do research on fee structures for fields. 

 

Council Member Lallo made a motion to table Resolution No. 2015-10-71 until the Rec Board decides on the other fee schedule for Demorest, seconded by Council Member Scheid.

Mr. Krieger stated he did research on the pavilions, and will call Ionia and Greenville to see how they figure fees, as well.   They had wanted notification out for reservations of pavilions beginning on January 1, 2016.

 

Mayor Protem stated he should get his direction and the time frame that the Rec Board wants to move into.    

 

Public Comments

 

Jeff Hunter, Zahm Rd., stated they had twenty minutes of discussion on where money comes from for the flowers and weeds.  What could they do with $34,000 to $36,000 a year?  How come they don’t ask that they don’t dump fluoride in public water?  It doesn’t do to the human body what it claims it does.  They talk about cutting jobs and services.  Cities have stopped dumping it in the water.  That discussion does not come up.  He doesn’t get it.  Keep poisoning people like they have done for years.

City Manager Brown had no comments.

 

Council Comments

 

Council Member Cooper thanked everyone for being here.  Sam and Bonita had an application approved, and he looks forward to it. 

 

Council Member Scheid thanked everyone for being here.  There are some things Bruce is going over, and he doesn’t know if this is one of them.  A lot of cities have taken fluoride out.  Do the problems outweigh the benefits?  Bruce should look at it.

 

Council Member Lallo asked that they keep the students in Oregon in their prayers, and those in the Carolinas.

 

Mayor Protem Jones thanked everyone for being here.  He has not studied it, but he heard there were articles for and against it.  Maybe Bruce can find documentation one way or the other.  They have two vacancies on the Planning Commission.  If interested, fill out the application.
