A meeting of the City Council of the City of
Council Member Scheid delivered the invocation.
The Mayor ProTem led the audience in the Pledge of Allegiance.
The City Clerk took the roll call:
Members Present: Council Members Dennis Cooper, Mike Scheid, Jerome Lallo and Tom Jones
Members Absent: Council Member Ronald Gunderson
The City Clerk read the preamble to the resolution.
Council Member Scheid moved the passage of the resolution and the motion was supported by Council Member Cooper.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
APPROVING THE EXCUSED ABSENSES OF MAYOR RONALD GUNDERSON FROM PRESIDING AT CITY COUNCIL MEETINGS DUE TO A MEDICAL CONDITION, UNTIL RELEASED FROM HIS PHYSICIAN.
WHEREAS, Section 4.5(f) Vacancies in offices of the Belding City Charter - Any elective city office shall be declared vacant by the Council upon the occurrence of any of the following events before the expiration of the term of such office: (f) In the case of members of the Council, if such officers shall miss two (2) consecutive regular meetings of the Council or from five (5) regular meetings in any calendar year, unless such absences be for confining illness or be excused by the Council at the time they occur; and
WHEREAS, Mayor Ronald Gunderson will be absent from upcoming city council meetings on the advice of his physician due to a medical condition, and wishes to have his absences excused by the Council; and
WHEREAS, the Mayor ProTem will preside at the city council meetings in the absence of the Mayor.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that the absences of Mayor Ronald Gunderson from presiding at city council meetings are hereby excused, due to a medical condition, until he is released from his physician.

Council Member Scheid made a motion to approve the consent agenda, supported by Council Member Lallo.

D. Appointment of Max Gibbs Jr. to the Planning Commission
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN
APPOINTING MAX GIBBS JR. TO THE PLANNING COMMISSION.
WHEREAS, the term of office for Max Gibbs Jr. on the Planning Commission will expire on July 3, 2015; and
WHEREAS, Max Gibbs Jr. has indicated that he is not interested in serving another full term on the board, but would be willing to serve for six months, until another member can be appointed.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that Max Gibbs Jr. be appointed to the Planning Commission with a term to expire on January 3, 2016.
E. Approval of ADA Complaint Policy
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AUTHORIZING THE A.D.A. COMPLAINT POLICY FOR BELDING DIAL-A-RIDE.
WHEREAS, the American Disability Act (ADA) of 1990 Title II and III provides that “…no entity shall discriminate against an individual with a disability in connection with the provision of transportation services; and
WHEREAS, the ADA, FTA, and MDOT require that all transit agencies implement an ADA Complaint Policy for its passengers; and
WHEREAS, the City Council of the City of Belding would re-appoint Keven Krieger, Director of Belding Dial-A-Ride, as the ADA Coordinator for Belding Dial-A-Ride.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Belding,
Michigan that the City of Belding authorizes the ADA Complaint Policy for the City of Belding Dial-A-Ride.
F. Approval of FOIA Procedures and Guidelines, and FOIA Written Public Summary of Procedures and Guidelines
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN ADOPTING THE CITY OF BELDING FREEDOM OF INFORMATION ACT PROCEDURES AND GUIDELINES AND WRITTEN PUBLIC SUMMARY OF THE FOIA PROCEDURES AND GUIDELINES.
WHEREAS, the State of Michigan passed the Freedom of Information Act, Public Act 442 in 1976, to provide for public access to certain public records of public bodies; and
WHEREAS, the State of Michigan passed PA 563 of 2014, which requires public bodies to establish specific written procedures and guidelines for FOIA requests, including a separate written summary; and
WHEREAS, the City of Belding has prepared and wishes to adopt the FOIA Procedures and Guidelines, and Written Public Summary of FOIA Procedures and Guidelines, as required by PA 563 of 2014.
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Belding, Michigan
hereby adopts the City of Belding Freedom of Information Act Procedures and Guidelines, and Written Public Summary of FOIA Procedures and Guidelines, required by PA 563 of 2014, effective July 1, 2015.
G. Authorizing solicitation of bids for South Bridge Street Reconstruction Project
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUTHORIZING THE SOLICITATION OF PROPOSALS FOR ENGINEERING SERVICES FOR THE SOUTH BRIDGE STREET RECONSTRUCTION PROJECT FUNDED IN PART BY THE MDOT SMALL URBAN PROGRAM.
WHEREAS, the South Bridge Street Reconstruction project has been approved for funding by the MDOT Small Urban Program for the construction years of 2016 and 2017; and
WHEREAS, South Bridge Street is classified as a major street through the National Functional Classification and this street reconstruction project is of the highest priority to the City of Belding; and
WHEREAS, City staff would recommend that proposals be requested for design and construction engineering services to meet the Local Agency Program Planning Guide.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that authorization is given to request proposals for engineering services for the South Bridge Street Reconstruction Project.
Council Member Cooper stated there was no meeting.
Council Member Scheid stated the Housing Commission meets on Thursday.
Council Member Lallo stated there was no Museum meeting. The VFW will hold a chicken dinner on June 26, as a fundraiser for the Labor Day Committee.
Mayor ProTem Jones stated Max Gibbs agreed to extend his term on the Planning Commission. There are two vacancies at this time. Max will stay on until there is a replacement for him. They need three people. Max will stay six months. Wade Trim is recommended for a service agreement for planning and zoning.
There was no unfinished business.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN APPROVING A PROFESSIONAL SERVICES AGREEMENT WITH WADE TRIM.
WHEREAS, the City of Belding wishes to enter a Professional Services Agreement for Planning Consultant services; and,
WHEREAS, the Planning Commission has recommended that Wade Trim be approved to provide certain professional services for the City of Belding; and,
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that the Professional Services Agreement with Wade Trim be approved for planning consultant services.

Council Member Scheid moved the passage of the resolution and the motion was supported by Council Member Cooper.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELDING, MICHIGAN AMENDING THE FISCAL YEAR 2014/15 BUDGET.
WHEREAS, on May 20, 2014, the Council of the City of Belding, Michigan adopted its 2014/15 Fiscal Year Budget for the administration of all funds and activities; and,
WHEREAS, unanticipated revenues and expenditures are projected which may exceed budget appropriations listed in said budget; and,
WHEREAS, the Fiscal Year 2014/15 Budget must be changed to reflect these adjustments;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Belding, Michigan that the Fiscal Year 2014/15 Budget be amended pursuant to the attached worksheet.
Council Member Cooper asked for an itemization on the Building & Grounds Maintenance budget amendment.

There were no public comments.
City Manager Brown stated Pleasant Street, south of M-44, would be torn up for the new waterline installation. FOIA and OMA training will be held next Tuesday from 5:30 – 8:30 p.m. MML will send an attorney. The session will be held at the depot. The city council, staff, and board and commission members were invited.
Mayor ProTem Jones asked if everyone on S. Pleasant that would be affected was contacted?
City Manager Brown stated he would make sure they were. The project will not start until next Tuesday.
Council Member Cooper stated Dale was reimbursed for salvage reimbursement. He asked if this was part of his duty as chief or independent?
Police Chief Nelson stated he was a certified inspector through the State of Michigan. He inspects the parts used for repairs and makes sure it is done correctly. He certifies it and then the vehicle gets recertified to get back on the road.
Council Member Cooper asked why it goes through the city?
Police Chief Nelson stated you have to be affiliated with a police department, as it is a provision in the law. The inspections are done outside of regular work hours. The paperwork is submitted. The inspections are $100, of which the city gets $15 and he gets $85.
Council Member Scheid asked everyone to have a good rest of the week.
Council Member Lallo stated pay attention to kids with school out.
Mayor ProTem Jones thanked everyone for coming. They will have some dry weather. He thanked the community and staff, and Bruce for the work he has done. He is bringing the community back together. People in the community that were upset are being soothed a little bit, and happier with the way things are going. He thanked council for working together.
Council Member Scheid moved to adjourn the meeting, supported by Council Member Lallo.
